Recently, conservatives have been rallying behind Karl Rove’s call to obstruct Attorney General nominee Eric Holder’s confirmation hearings, citing the 2001 pardon of Marc Rich. Today, former deputy attorney general Jim Comey, who famously clashed with the Bush administration on illegal wiretapping, endorsed Holder, saying he will ensure that the DOJ is free from political influence:
I know a lot of good people who have made significant mistakes. I think Mr. Holder’s may actually make him a better steward of the Department of Justice because he has learned a hard lesson about protecting the integrity of that great institution from political fixers. I’m not suggesting errors of judgment are qualification for high office, but in this case, where the nominee is a smart, decent, humble man, who knows and loves the Department and has demonstrated his commitment to the rule of law across an entire career, the error should not disqualify him. Eric Holder should be confirmed as Attorney General.

December 22nd, 2008 at 8:11 pmWhat should be of serious concern to all Americans regarding the Mark Rich and other midnight pardons is not so much that the pardons were ill-advised but that Eric Holder repeatedly failed (as far as we know) to stand up to the President who issued the pardons.
We have already heard rumblings that Barack Obama plans to shuffle the Bush-era war crimes issue off to some commission if he can’t forget about them altogeher (maybe in the spirit of ecumenicism, he’ll let Rick Warren investigate them). As Glenn Greenwald pointed out today, top Democrats in Congress were complicit in at least the secret wiretapping of Americans, so it’s unlikely that a Democratic Congress is going to investigate itself. That leaves only the Justice Department. We must have a strong-willed, independent-minded Attorney General, one who is willing to appoint a special counsel, if there is to be any day of reckoning for Bush criminals. Unless Holder has had a spinal replacement in the last eight years (and perhaps Comey has some reason to think he has), Holder is not the guy for the job.

December 22nd, 2008 at 8:36 pmKarl Rove is afraid, deathly afraid, that someone competent and honest will be put in charge of the U.S. Justice Department (after years of Ashcroft, Gonzales and Mukasey), someone competent and honest who will actually investigate and prosecute any crimes committed by Republicans over the past eight years…including Rove’s involvement in the outing of covert CIA agent Valerie Plame Wilson in 2003 and his central influence in the firing of U.S. Attorneys who wouldn’t politicize their office for purely-partisan Republican purposes.
Rove should be afraid, very, very afraid, that he more than likely will be spending some of his twilight years behind bars…a fitting tribute for a rabid, radical political career.

Well, I’d be curious to know what legal precedent or case history exists to limit the power of the President to issue pardons for any crime, for any reason. I haven’t heard of any. It’s tough to stand up to somebody if the legal legs to stand on aren’t there. To claim that a given Presidential Pardon is illegal would be breaking new legal ground, AFAIK.
