Bloomberg reports that the first female deans of the Harvard and Stanford law schools — Elena Kagan and Kathleen Sullivan — “are the top candidates to serve” as Barack Obama’s Solicitor General. No woman has ever served in that position on a permanent basis. Kagan “became a top candidate for solicitor general after being passed over for deputy attorney general, a slot set to go to Washington lawyer David Ogden.” The Solicitor General is charged with litigating on behalf of the government before the Supreme Court and determining whether lower court decisions should be appealed.

Aside from teaching and university admin, she’s authored a book on the President’s role in administrative and regulatory law, written some 1st amendment stuff and is credited for “employing a consensus-building leadership style” at Harvard Law. Sounds like a great fit for Obama.

She clerked for Mikva and has other strong Chicago ties, as well as being a former Clinton Admin appointee — so she has a lot of connections that might help her. She also verked for Thurgood Marshall, which is interesting.

Larry Summers is a big fan — not sure if that helps or hurts her…
She was also nominated for a court appointment under Clinton and the GOP failed to consider her nomination — which probably says less about her than about the GOP, I would imagine.
Sullivan is impressive but the failure to pass the bar the first time isn’t fab optics, could give the Obama people pause…who knows tho…will be interesting to see how this plays out. SG is a critical post.

Um yes, the position in question is called “Solicitor General.” It’s not like Obama made that up or anything.
And having people in charge of executing the law who actually have some idea what the law is might be a good idea for a change, no?
