One of the saddest, most hysterical crusades by conservatives over the past few years involved their intervention in the case of critically brain-damaged woman Terry Schiavo. Conservatives — including former Senate majority leader Bill Frist and former House majority leader Tom DeLay — brought the personal tragedy to national attention in 2005 by trying to write legislation forcing doctors to reinsert her feeding tube and taking the “extraordinary step” of subpoenaing Schiavo to testify to Congress.
These conservatives claimed that they had the best interests of Schiavo in mind (even though they had never spoken to her). But there’s no doubt that cold political calculations were really driving their actions. A GOP memo described their efforts:
“This is an important moral issue, and the pro-life base will be excited that the Senate is debating this important issue,” said the memo, reported by ABC News and later given to The Washington Post. “This is a great political issue, because Senator Nelson of Florida has already refused to become a co-sponsor and this is a tough issue for Democrats.“
Conservatives are now brushing off the Schiavo case to use it against Thomas Perrelli, President-elect Obama’s pick for the no. 3 spot at the Justice Department. Right-wing websites are outraged at Obama’s association with Perrelli, since he was one of the lawyers who represented Michael Schiavo, who wanted his wife’s feeding tube removed. The Washington Times today reports that these conservatives are now gearing up to fight Perrelli’s nomination:
Andrea Lafferty, executive director of the Traditional Values Coalition, derided Mr. Perrelli’s selection as “just another death-peddler Obama has added to his list of nominees.” She said he’s earned the nickname among pro-lifers of “Piranha Perrelli” for his work on the case.
Tom McClusky, vice president for government affairs at the Family Research Council, said several end-of-life issues could make their way to the federal level in the next four years and having Mr. Perrelli at the department means pro-life causes would have a tougher time winning those debates.
“If the Justice Department isn’t going to do anything about it, the states, what’s to stop them from cases like Schiavo and even worse cases,” Mr. McClusky said.
Reviving the Schiavo case may not be the best decision. After all, 63 percent of the public supported the removal of the feeding tube. More importantly, 70 percent said it was inappropriate for the federal government to involve itself in the case, and 67 percent believed that these politicians were “trying to keep Schiavo alive are doing so more for political advantage than out of concern for her or for the principles involved.”

I beleive clinically brain dead is the proper term. Not sure what the technical definition of brain death was but the uncontroverted expert opinion, confirmed by an autopsy, was that this woman had no vestigate of consciousness remaining and that her actions were essentially reflexes and nothing more. Since the autopsy showed Terri to be effectively DEAD at the time her feeding tube was removed (with some body systems being kept alive by artificial means), we now know that Michael Schiavo and his team of lawyers (including Perrelli) did the right thing.
So who’s gearing up for this fight? There are a lot of malcontent wingnuts out there who will clutch any straw they can to fight against ANY Obama appointee, and this is the rather silly straw they’ve got against Perrelli. Problem is, they have to get enough Senators on their side to make obstruction effective. I consider “murder” to be reserved for killing a person. From all that we know about the human body, you are not a person – i.e. have no mind/soul – if you have no electrical activity in your brain. As such, your complaint is equivalent to protesting that burying someone who’s heart isn’t beating is also “murder.” It’s not. They’re already dead. And the same held true for Schiavo.

Michael Schiavo recognized that his wife was no longer there because she was in a permanent state of brain death. He also was fully aware of her wishes should she find herself in that situation, and fought to have her own wishes executed. Her estranged family didn’t care about her medical condition or her wishes, merely their own agenda. The House Republicans obviously didn’t care about her at all, they just wanted to posture and grandstand for their “base” of issue-blinded puppets. Now they want to do it again.
I think it’s pretty obvious who the “dirtbags” were/are in that situation.

I remember that doctor that stood on the senate floor and diagnosed Schiavo from a ten minute film. He said he could see her eyes move and follow people around the room. He said she was sensate and aware.
They stepped in and tried to savage her husband. Bush came back practically in his pj’s to sign a law. I watched people that knew nothing, that had no business and no stake in this woman’s life. I listened to all the best doctors and neurologists who examined this woman over the years all said she would not recover. She was nearly brain dead. All this for 15 years.
Well as it turned out, after the autopsy she was brain dead. Half of her brain was gone. The part of the brain that dictates sight and movement. And the eye movements were spasms and her so called speaking was false too. The part of her brain that promoted speech was gone. That so called diagnosis was a cruel Republican joke. A play for the right wing nut jobs. This woman had a husband that stuck with her for 15 years and finally had begun a life again.
Her father and mother could not stand the thought of that. They could not bear to think of her never getting well. So they fought her husband. The lies that surrounded her illness were legion. And the so called right to life people, total strangers got into it.
And who would be responsible for her life after her parents died? How good would the care be in an institution and left in a bed? What about the quality of life for someone who could not hear, see, or eat,or move on her own?
Surely the quality of life should come into play somewhere. And surely her husband and so many years of doctors must have some more humane idea of what her lack of life must be. Should not her husband have been able to say as he did, she would not want to exist like this?
Now these idiots who have no idea of such a life want to resurrect the whole idea of life no matter what. What kind of brain dead idiots live here? In the name of religion evidently any outrage is allowed.

The problem with this line of thought is that it’s the other way aroung – they got away with such ridiculous issues back then specifically because they had a strong enough majority that they could afford to. They can’t afford to be so silly today.
In a current political climate in which they’re already being drubbed mercilessly, there aren’t many voters who are going to be interested in such issues who weren’t already voting R anyways. As such, they’re just playing to a smaller and smaller segment of their already shrinking base.

hey there! i am a staunchly pro-choice democrat. i am also a person with a disability. the schaivo case was not just fought by pro-lifers. it was and continues to be fought by people with disabilities themselves, because we recognize that the medical profession and the world do not value us and continually underestimate our quality of life. so go ahead and celebrate, my fellow democrats, but this is a civil rights issue and we will not stand by while you so callously disregard the value of our lives. i want this to be the end of this discussion until this community is educated on this issue from a disability rights perspective.
you should look up the real facts of the case. the only reason it made it to court was all the money she had. someone on medicaid would have had thier plug pulled within 10 days, whether or not the entire family disagrred. that’s called “futile care”. nice, huh?
