Kyl Falsely Claims Holder Doesn’t Support Patriot Act, Says He Shouldn’t Be AG If He’s Against Torture

070601_jonkyl.jpgConservatives, led by former Bush adviser Karl Rove, are hoping to use the upcoming confirmation hearing of Eric Holder, President-elect Obama’s nominee for Attorney General, to “lay down a marker” that will show they “they can remain relevant” after their electoral losses. Though GOP opposition is mainly focusing on Holder’s role in the pardon of Marc Rich, Senate Minority Whip Jon Kyl (R-AZ) claimed yesterday that Holder’s views on terrorism laws will be an issue too.

Speaking to right-wing radio host Hugh Hewitt, Kyl said that Holder had made “some very unfortunate statements about our interrogation” of terrorists, which made him think “he is not going to be supportive of the Patriot Act [and] the FISA law.” Kyl claimed this may be reason to oppose his nomination:

KYL: I think Eric Holder will have some problems. He has not been able to stand up to his bosses in the past, President Clinton when he wanted to do pardons that I think Holder must have realized were big mistakes but he facilitated. And he’s also made some very unfortunate statements about our interrogation of prisoners, terrorists, and other things that lead me to believe that he is not going to be supportive of the Patriot Act, the FISA law, and others. And if he can’t be supportive of those laws, then he shouldn’t be Attorney General.

Though it’s true that Holder has spoken out strongly against the excesses of the Bush administration, Kyl simply has his facts wrong about Holder’s position on the Patriot Act. In 2004, Holder told CNN that he doesn’t question “the need for the Patriot Act.” At the same time, Holder believes that enforcement of the law needs oversight:

HOLDER: I think in a lot of ways, the problem that I had with the enforcement of the act is that this administration said essentially trust us. We’re not going to involve judges, we’re not going to report to Congress on what we’re doing, and I think our history has shown us that we are best when we operate as people governed by the law as opposed to putting our trust in people and that’s the problem I have.

As for Holder’s views on FISA, he’s on the record opposing President Bush’s bypassing of the law, saying in June that he never thought he “would see that a President would act in direct defiance of Federal law by authorizing warentless NSA surveillance of American citizens.”

Apparently, Holder’s belief that “we are best when we operate as people governed by the law” is reason enough for Kyl to oppose Holder’s nomination to be the nation’s chief enforcer of the law.

    I think this is a great talking point for the Republican party, and they should push it to – nay, beyond – the limit. It spins a lot of past negatives into a positive. For example, it’s not a failure of the Bush administration to have appointed incompetents and criminals to the DoJ; it is in fact an important policy decision to do precisely that.

    Enforcement of the rule of law is just a bunch of liberal claptrap, and the GOP stands firmly against it. Best of luck with that!

Theirs is a world where – because of their own obstruction – the worse the condition of this nation, the better they believe their chances of re-gaining power in ‘10 or ‘12. Holder wont have to prosecute any Bush appointees or staff who committed torture the other countries will bring charges after they see the condition of the Gitmo prisoners. Even a pardon from Bush wont save them from an International Trial. Even some of those Bush criminals left in place will be see they will have to lawyer up.

    Some time ago Rove explicitly stated that the R’s should focus on blocking Holder. Then they started asking for more time and requesting information related to him about a number of utterly ridiculous old issues. So yeah, they’re basically following the orders of a de facto shadow government headed by Karl, in which he transmits his instructions to them through FAUX News. It would be scary if they actually had any power, or weren’t racing to the bottom in terms of irrelevancy.

    Me, I’m looking forward to the Holder show. I hope he beats those scumbags like they’re Mike Tyson’s girlfriend.

    Apparently, Kyl is of the opinion that the PATRIOT act authorizes and/or mandates torture. It does not. As it turns out, a surprisingly small number of U.S. Senators have any idea what the laws they’ve passed actually say.

The dictators placed by the US during the 60’s, 70’s up to the 80’s, they all have been trained in the ‘School of the Americas’ on techniques of Torture. Thousands were tortured by CIA agents in South America during operation CONDOR.

    It really is getting ridiculous. In the past month an increasing number of people are actually coming out in public forums and baldly stating…”yeah, I’ve been screwing up and intend to continue to screw up…so what?” or words to that effect.

    Sun spots? Excess cosmic radiation? Too much fluoride in the water? Has anyone checked the status of the lemmings lately? Don’t get me wrong, I love the idea of self incrimination on national TV but it is sort of spooky as to why they think no one will notice.

    I wonder what some of these good ole boys and girls would say if they were taken off the plane to Dubai and rendered extraordinarily to some cozy little cell under charges of war crimes? Kept incommunicado and ‘creatively interrogated’ until they fessed up. I wonder how loud they would be screaming for a lawyer and their rights?

    Good news is, we would probably never know. Bad news is it wouldn’t happen.

    Unfortunatly the reality is that the USA has used torture since WWII. I’m from South America. The dictators placed by the US during the 60’s, 70’s up to the 80’s, they all have been trained in the ‘School of the Americas’ on techniques of Torture. Thousands were tortured by CIA agents in South America during operation CONDOR.

    Definitely worth a reminder, thanks. Now that we’ve moved from sponsoring fascists to trying to take on fascist policies ourselves, we can have an open discussion about it and hopefully put a stop to all forms of involvement in state-sponsored-terror.
