Conyers introduces bill creating commission to investigate Bush’s torture and wiretapping policies.
TPM notes that House Judiciary Chairman John Conyers (D-MI) has introduced legislation setting up a National Commission on Presidential War Powers and Civil Liberties. The panel’s goal is to “establish a Blue Ribbon Commission comprised of experts outside government service to investigate the broad range of policies of the Bush administration that were undertaken by the Bush administration under claims of unreviewable war powers.” While he is unlikely to prosecute Bush officials for war crimes, President-elect Obama has hinted at support for such a commission.

Obama/Biden might be impeached for doing the job of the people if they are careful. These Corrupt Republicans and Democrats are Senior Members and aren’t likely to give up the easy job of stealing taxpayers money without a fight. To bad McCain/Palin didn’t steal the election then the Bush/Cheney plan could continue without problems. Stop Gitmo from closing and stop all the crimes the Bush Administration from coming out as the AG is doing the best he can but he needs the help of all who profitted.

But it is good to refresh the minds of those brain-washed Republican voters, of what their hero (W & Cheney) have done to our country.
One last thing on the Bush Library. How about a photo of every human being that was either killed or severely wounded as a result of the Bush Administration. Instead of a building, it should be a staircase (with before and after photos of the victims), there would probably enough floors to reach the center of the earth.

Listening to Jonathan Turley last night on Rachel Maddow (or was it countdown) I have a terrible feeling that we are going to drop the ball on this and then some other country is going to go after Bush/Chaney for war crimes. That will certainly not help our standing in the world and will be a horrible embarrassment to our government to have some foreign government clean up the mess our government made.

Human Rights Watch has called on Israel to stop using white phosphorus which it says has been used in military operations in the densely populated Gaza Strip.
The US-based group said that its researchers observed the use of the chemical, which can burn away human flesh to the bone, over Gaza City and Jabalya on Friday and Saturday.
“We went by Israeli artillery units that had white phosphorus rounds with the fuses in them,” Marc Garlasco, a senior military analyst at Human Rights Watch, told Al Jazeera.
“Clearly it is [white phosphorus], we can tell by the explosions and the tendrils that go down [and] the fires that were burning,” he said.
“Today there were massive attacks in Jabalya when we were there. We saw that there were numerous fires once the white phosphorus had gone in.”

January 10th, 2009 at 5:48 pmI have a little more confidence this time around, that since we have an incoming democratic administration we will see findings presented by any commissions taken seriously — previous commissions included — like 9/11, Iraq Study Group, etc. If I were President I’d breath a sigh of relief at not having to turn over those heavy stones. My job would be to sift through the relevant conclusions and advice and add to the luster of the commissions process itself by translating findings into action.
I don’t think President-elect Obama is going to have these panels sweat and toil just to add another shelf of papers to the Library of Congress.
January 10th, 2009 at 5:48 pmI don’t have hight hopes for this. While it’s all well and good, it won’t go anywhere. Even if it said everything they’ve done is illegal and unconstitutional in very clear terms, no consequences are likely follow.
Some different process would need to be started for justice to be done, and it may be able to use the commission’s findings as a starting point or guide. But that’s about all it’s good for at most.

January 10th, 2009 at 6:00 pmMy own take on the cynicism about Obama about is that the current president has injected so much paranoia into the political process that very smart people are nit-picky and fearful of the next leader’s every move — they do not want to wake up in the middle of the night and see the ghost of Bush.
Just yesterday, however, I read Al Gore’s Wikipedia bio. I was caught by surprise that he was generally a conservative democrat during his days in congress, while, of course, noted for his keen knowledge and foresight abilities on environmental and technology issues and being the first congressman to appear on C-Span. But during his eight years as Vice President, he ironed out any kinks he had and we can’t think of him as anything else but a solid progressive. The one thing I don’t like about Joe Biden was his sponsorship of the bankruptcy bill, and maybe he’ll iron out that kink while in the Vice Presidency, especially since Obama voted against that bill.

The analyst Mark Danner said in realtion to the precedent’s use of torture:
“… When it comes, for example, to presidential power, if you look at these memos, and in particular the torture memo, you see one of its arguments is that the president in essence during wartime can do what he wants. There is a very strong argument, or at least very vigorous argument, saying that in effect, you cannot limit the president’s power to interrogate a prisoner as he wants, because it’s in his power; that is, the executive and international treaties cannot so limit the president.
Now, that particular argument, so far as I can tell, is not accepted by the mainstream at all of legal opinion in this country. In the memo, you do not see cited major precedents. The actual key precedents on issues of presidential power, one of which is Youngstown Steel, which had to do with President Truman seizing the steel mills during the Korean War, very famous case, key case on the limitation of presidential power, it’s not even in the memo.
So in order to argue that in essence these are nonpolitical arguments, these are simply lawyers telling you what they believe, it seems to me you have to have at least a mildly convincing argument that the legal homework has been done. And if you look at these documents, as far as I can tell, the legal homework hasn’t been done. What they are doing is arguing very strongly a particular position in the guise of giving you a neutral legal opinion.”

Listening to Jonathan Turley last night on Rachel Maddow (or was it countdown) I have a terrible feeling that we are going to drop the ball on this and then some other country is going to go after Bush/Chaney for war crimes. My thoughts exactly… how many years/times has it been that Conyers or another were going to investigate, maybe prosecute, bring charges but eventually all is forgotten?

If American war criminals are tried in the international courts, it will be more than just an embarrassment for us; our word, our government, our democracy and everything we have ever stood for in the world will be finished.
We have to do it ourselves – maybe history will not be repeated here – maybe a commission is the way to start.
We are going to let those bastards off Scot free. We have thousands and thousands of people in prison for relatively minor offences and these traitors and War Criminals are going to retire with their loot.

If, on the other hand, the commission were to determine that criminal investigation was appropriate, it already would have created essential public support for such action.
From what source would the commission draw its authority? The most obvious place would be the executive branch itself. […] The problem with presidential commissions is that they can easliy be accused of covering up for previous administrations or, conversely, of seeking “victor’s justice”.
The alternative is a hybrid – an executive-legislative commission that would be created by an act of Congress but would draw also on the authority of the president. This alternative typically involves an elaborate process for the appointment of commissioners by both the White House and the congressional leadership.
