Actually her job summary showed she had travelled out of the country at least seven times om the previous three years sometimes under NOC cover sometimes under official cover but ALWAYS undercover. We dont KNOW when nor do we KNOW which times she was under NOC cover.

All that wingnuts care about is who screwed up. The intention behind it, and the consequences of it don’t matter to them. It’s either a point for their side or a point for ours. Real lives don’t matter. As far as they’re concerned, it’s all just a big game of Friday Night Football.

In Sandy Berger’s case, no one has been able to demonstrate that he had any ill intent in taking the documents with him. Also, no one who wasn’t authorized to see them did. He certainly broke an important rule, but there was no ill intent, and there were no negative consequences.

Ill intent is obvious in the outing if Valerie Plame. She was exposed because her husband published information that the Bush administration found inconvenient. And there are consequences as well – the CIA can’t use her expertise any more like they previously could. So the Bush administration broke an important rule (Plame’s identity as a CIA agent was at least as classified as the documents that Berger took) but they did so with ill intent, and caused negative consequences.

So there’s a distinct difference there, other than “which side scores a point.”

She was literally designated by the CIA as a covert agent. That’s what their paperwork said. She was not acting openly or telling anyone, but she hadn’t done any clandestine work in some time, but kept the designation in case they wanted to use her in a covert capacity later on. Now you and I can disagree with each other, but the CIA agrees with my side. That’s just fact.

But even if you say “it was just a technicality that got violated,” then you’ve got to admit that Berger’s mishandling of documents was also “just a technicality.” Which you refuse to do. Because you don’t actually care about the law, the intent, or the consequences.

It is clearer than THAT even. The term covert is defined in the statute about exposing covert agents. By its definition her job summary left NO DOUBT she was covert as the statute defined.

Not openly practiced, avowed, engaged in, accumulated, or shown

Now, since she was a secretive CIA agent that was working on Iran’s capability for nuclear weapons, once she was outed, she was now “open” and thus no longer COVERT.
