After Trying To Abolish Filibusters Of Judicial Nominees In ‘05, GOP Threatens To Filibuster Obama’s Nominees

hatch.jpgIn 2004, frustrated by successful efforts by Senate Democrats to block 10 of President Bush’s judicial nominees, Senate Republicans threatened use the “nuclear option” to remove the minority’s right to filibuster judicial nominations. “One way or another, the filibuster of judicial nominees must end,” said then-Senate Majority Leader Bill Frist (R-TN) in a speech to the Federalist Society.

But now that they are out of power and President Obama has the ability to appoint judges, Republicans are threatening a filibuster of judges if Obama doesn’t appease them. In a letter to the White House yesterday, all 41 Senate Republicans “requested that Obama respect the Senate’s constitutional role in reviewing judicial nominees by seeking their consultation about potential nominees from their respective states.” Politico explains their obstructionist threat:

“Regretfully, if we are not consulted on, and approve of, a nominee from our states, the Republican Conference will be unable to support moving forward on that nominee,” the letter warns. “And we will act to preserve this principle and the rights of our colleagues if it is not.”

In other words, Republicans are threatening a filibuster of judges if they’re not happy.

As RightWingWatch notes, this letter represents the GOP’s “evolving definition” of the Senate’s “advice and consent” role. For instance, in 2005, Sen. Orrin Hatch (R-UT) — who signed the GOP letter — wrote:

Focusing on President Clinton’s judicial nominations in 1999, I described what has been the Senate’s historical standard for judicial nominations: “Let’s make our case if we have disagreement, and then vote.” Democrats’ new filibusters abandons this tradition and is unfair to senators who must provide the “advice and consent” the Constitution requires of them through a final up or down vote. It is also unfair to nominees who have agreed, often at personal and financial sacrifice, to judicial service only to face scurrilous attacks, trumped up charges, character assassination, and smear campaigns. They should not also be held in permanent filibuster limbo. Senators can vote for or against any judicial nominee for any reason, but senators should vote.

As RightWingWatch points out, it’s “amazing” how soon after trying to “blow up the Senate with the ‘nuclear option’ in order to get rid of the filibuster, the Republicans in the Senate are now demanding a veto over the President’s nominees and threatening to filibuster if they don’t get their way.”

But the Senate GOP’s filibuster flip-flop should come as no surprise. In fact, their opposition to judicial filibusters during the Bush years was itself a change from their previous position, which supported filibustering Democratic-appointed judges.

    It’s one thing to oppose policies and to propose different policies, but to boldly assert, “I hope Obama fails” begs scrutiny.

    In carrying out that wish, does the GOP intend to undermine all Obama policies, even those with which it agrees, simply in order to insure failure? That sounds a whole lot like treason. If the GOP has policies and appointments it considers better, set forth the merits and argue the GOP cause on better grounds than “screw the American people, screw our country, Obama must fail in order for the GOP to regain power.”

    Ugh. This is OUR country…not a Red State managed by Karl Rove and Rush Limbaugh, where power is all-important, Americans’ well-being be damned.

    We can only hope. But I’m not sure that we need the nuclear option to make them implode. They seem to be doing a good job of it themselves without our help. I had a long conversation today with a life-long Republican and I have to say it wasn’t in the least complimentary to her party. She actually told me that the Republican party bears no resemblance to the party she has belonged to for 40 years and soon she will be re-registering as an Independent.

    In fact I thought carefully about what I wrote. We have online personae here. They are not our real identities, but they serve as such in this community. I know the regulars by their writing style, their voices, their politics. We have no need to keep changing identities because we stand behind what we say here and we’re here for conversation and exchange of ideas.

    The only ones who need to recycle login names are those who are only here to disrupt. The ones who don’t give a shit what they type because they don’t have to deal with any of the consequences — no loss of credibility, no ridicule, no accumulated history.

    I have seen trolls write negative stuff about George Soros (who for some reason is a boogeyman to you guys) without getting banned, and I have no idea why it would be relevant to discuss any aspect of a moderator’s sex life. Opposing voices are welcomed here, as long as they’re respectful and really here to discuss topics.

    I have no problem with TP banning trolls who are only here to amuse themselves with the 21st century equivalent of prank calling.

    Try doing a little Therausus check on “America.”

    I got nothing. America is a unique entity. We have a Bill of Rights within a Constitution, a document written by a Renaissance man, who knew about oppression, about French Huguenots, the Inquisition, the Islamic Extremists . . . the Druids … let’s just think of all of the religious extremests that the Declaration of Independence was designed to protect America from . . . if only Linmaugh could distinguish between the Declaration of Independence and the Constitution . . .it probably wouldn’t matter . . . as the nine memo’s released 3/2/09 indicate, we lived under a dictatorship for the entire Bush Presidency . . . Let’s get back to American principles . . . enough said.

    If the repubs decide to filibuster, it will be like blasting more holes in the bottom of their sinking ship.

    I think Dems should move forward with nominations of judges who can counter the extreme turn to the right of the Bush judges. We’ll see if repubs are willing to follow through on their threats.

    I know this is going down to the Reichpublican’s level, but I think that if they do indeed filibuster, then the Reid and the Dems should do a preemptive strike with the nuclear option (within the present context, of course).

    Let’s face it: If we don’t use it, they sure as hell will the next time they’re in power. Let’s hit them before they hit us!
