2001 Bush legal memo allowed ‘First Amendment speech and press rights’ to be ’subordinated.’

Yesterday, Attorney General Eric Holder released several Bush administration Office of Legal Counsel memos, which show the astonishing extent to which the administration expanded its wartime powers. An October 2001 memo from John Yoo, for example, states that the “Fourth Amendment would not apply” for domestic military operations. The memo also restricted basic First Amendment rights:

yoo.jpgIn perhaps the most surprising assertion, the Oct. 23, 2001, memo suggested the president could even suspend press freedoms if he concluded it was necessary to wage the war on terror. “First Amendment speech and press rights may also be subordinated to the overriding need to wage war successfully,” Yoo wrote in the memo entitled “Authority for Use of Military Force to Combat Terrorist Activity Within the United States.”

Freedom of speech is integral to a free society,” President Bush said in May 2008. After reading the memos, Harpers’ Scott Horton wrote, “We may not have realized it at the time, but in the period from late 2001-January 19, 2009, this country was a dictatorship.”

    This is the iceberg which will sink the SS Bush once and for all.

    These secret memos were bad enough on their own but the “coverup” of these practices by memos written in January just before heading out of Dodge will be the “indicting factor” for Herr Bush.

    This will definitely stick and he will be brought to trial for this. As John Dean said last evening about Nixon “the cover-up (memos rescinding the power in January ‘09) are worse than the original action.

    With this evidence surfacing coincidental to two committees beginning investigation into bushie’s crimes, the timing couldn’t be any more perfect.

    These memos are now prima facie evidence of Bush’s crimes against our Constitution and the “rescinding memos” written just weeks ago make the case for two facts: 1) They knew it was illegal and were trying to cover their a$$ – and 2) They didn’t want the precedent to continue to Obama.

    Either way – We will live to see Bush and his zombies being frogmarked into prison now.

    I think a lot of us did feel that we were living in a dictatorship. Bush asserted that no laws applied to his executive decisions. He flagrantly disregarded the first, fourth, and fifth amendments of the constitution, and possibly others. He refused to recognize the necessity for Congressional oversight. He created an extra legal judicial system. He all but declared martial law. He hired major news outlets to issue military propaganda. And, his cronies to this day refuse to submit to lawful subpoenas issued by Congress. We must hold Bush and his administration accountable for their crimes against this nation in order to help ensure that this gross abuse of power will not happen again.

    Question for you legal scholars out there: If Bush lied when he swore to uphold and defend the Constitution of the United States of America, is that perjury? Because we know he’s already committed crimes against the Constitution before his second swearing in ceremony.

    Can’t remember the source, but I heard a great response to the “Bush kept us safe for over seven years” argument that was something along the lines of:

    They claim he kept us safe for over seven years, but he was president for eight. It’s like saying that falling out of a window 80 stories up is safe for the first 79 1/2 stories of the fall.

    I’m wondering why Holder released these memos? I’m certainly glad he did, just wondering if there was some requirement to do so at this time.

    It makes me wonder if this is the angle that President Obama is taking to bring Bush’s crimes into the light of day – i.e., yesterday, Glenn Greenwald and others – rightfully, imo – hammered the president for some of the legal positions DOJ has taken that support the Bush/Cheney “state secrets” defense that has angered many of us over the past 8 years.

    I’m suggesting that Obama – by letting out memos such as this, a drip at a time – is, in essence, giving himself an “out”, hoping the public outcry/outrage over this type of bullsh*t forces the DOJ and Congress to proceed with criminal prosecutions, taking the issue “out of” Obama’s and Holder’s hands. If so, I’m all for it, and think it’s not only sneaky, but brilliant.

    Sorry for butchering this post – hope it makes some kind of sense.

    These are the words Bush stated — twice, and ignored summarily throughout his two terms.

    Reminds me of the stories we heard about the USSR when I was a child (aging myself, here, but we’re among friends). We were shocked at stories of their government’s freedom to spy on citizens without limit.

    We’ve been living that nightmare; we have no idea yet of the ramifications/damage.

    Unfortunately for the American people, the corporate media was all too complicit in cooperating with the Bush administration to lead us into war with Iraq, so suspending the first amendment wasn’t necessary for Bush’s purposes.

    The fact that Bush took us to war with Iraq so cavalierly, makes me cringe, and makes me hope that Bush cannot sleep at night. Sadly, I don’t think Bush cares about the people who lost their lives at his hand, and I think he sleeps just fine. Especially since he thought being President was “fun”.

    Since we are a representative government, (meaning WE are the Government) if our representatives vote to raise taxes on the maybe 300,000 people that make over 3 million dollars a year, for the benefit of us all, then I think that is fair. Not to mention that the people making over $250 K a year overwhelmingly voted for Obama, and they thought that it would be ok to have their taxes raised… The rich will be fine they always are. But right now, the middle class is struggling and needs a boost.

    Think of it this way: it can’t be any worse that the “majority” voting in California to eliminate the legal marriages of gay people, right?

    If you don’t want to help people, don’t help them. Nobody gives a damn that you’re a selfish asshead.

    However, it is the government’s responsibility to promote the general welfare of the country, and to do that, they must take some of your money. You consented to that when you became a citizen of the United States, either by birth or naturalization. If you don’t like it, there are plenty of other countries in the world that you’re more than welcome to immigrate to.

    In Mapp v. Ohio, 367 U.S. 643 (1961), the Supreme Court ruled the Fourth Amendment to be applicable to the state governments by way of the Due Process Clause of the Fourteenth Amendment. The Supreme Court ruled that certain searches and seizures violated the Fourth Amendment even when a warrant was properly granted.

    Hey John ; calling yourself “The Decider” doesn’t give one the ability to usurp the law ……….Regardless what you want to laughably claim or want to believe.

    I found the footnote citing a paper that one Lewis Libbey wrote title, “Legal Authority for a Domestic Military Role in Homeland Defense” interesting. Especially since it was written in 1999.

    To answer the question of who asked for these memos, it clearly states that they were written at the request and were addressed to Gonzales, in his role as counsel to the President, and Haynes of the DOD. The first sentence of the memo starts, “You have asked…”

    Since everyone knows the media was gutless during the ramp up to and during the occupation of Iraq (AKA “war”), was also in the tank for Bush in “catapulting his propoganda”, there is one and only one reason to suspend the First Amendment:

    stifle the left/opposition and those against the war. Period.

    Suspending the 1st would have had nothing to do with protecting the military, it’s plans or “combat the terrorists”.

    Let’s say the Obama administration wants to prosecute Bush&Co, but it would create a backlash at a critical time when that must be avoided. However, if evidence continues to surface, if people begin to complain louder, if testimony at hearings warrant it, well, then, the president will simply have to abide the wishes of the public and allow prosecutions.

    The end result would be what the Obama camp wants, but it won’t appear that they sought it aggressively.

    I think Roosevelt said: I agree with you, I want to do it, now make me do it.

    Everyone must pay taxes for the common good — we have all paid taxes for some things to which we objected, but we have also benefited from taxes on other things.

    Comet54 doesn’t seem to recognize that under Bush&Co (and for the most part of the past 30 years) he has paid taxes while the benefits he has received have been lessened as the wealth of the wealthy has increased exponentially.

The administration has suffered virulent backlash from the nuts on the right already and any serious proceedings may have to wait until the 2010 elections happen to ensure that partisan wrangling by the Republicans will be nothing more than background noise.

    I don’t think this will sink Bush. Nothing but a picture of Bush pissing on the Constitution physically will get him jailed. They will all remain free to make money and to laugh again at all of us.

    John Yoo is a war criminal and I am astonished that the faculty at Berkeley voted to give him tenure. Moreover, that he still has a job there ON TAXPAYER PAYROLL instead of a jail cell. He was another trusted flunky of the criminal enterprise that Cheney/Bush controlled our country with for eight years.
