Canadian Lawyers Seek To Ban (Or Prosecute) Bush For His Role In Authorizing Torture

bushcanadaweb2.jpgFormer President George W. Bush’s first post-presidency speech will take place on St. Patrick’s Day — March 17 — in Calgary, Alberta. Although organizers have declined to say if Bush will be paid, he once boasted that he hoped to make “ridiculous” money on the lecture circuit once he leaves office.

But instead of greeting Bush with open arms and (potentially) wads of cash, activists and human rights lawyers in Canada are hoping their government will greet him with handcuffs — or at the very least — bar him entry in to the country. In fact, Vancouver Lawyer Gail Davidson said the government has an obligation under the law to ban Bush from entering Canada because of his role in supporting torture:

Davidson says that because Bush has been “credibly accused” of supporting torture in Iraq and Guantanamo Bay, Cuba, Canada has a legal obligation to deny him entry under Canada’s Immigration and Refugee Protection Act. The law says foreign nationals who have committed war crimes or crimes against humanity, including torture, are “inadmissible” to Canada. “The test isn’t whether the person’s been convicted, but whether there’s reasonable grounds to think that they have been involved,” says Davidson.

Davidson is correct; Bush has been “credibly accused” of supporting torture. Earlier this year, Manfred Nowak, the United Nations Special Rapporteur on Torture, urged the U.S. to pursue Bush and Donald Rumsfeld on charges that they authorized torture and other harsh interrogation techniques. Indeed, Bush himself said last year that he was aware of his advisers’ discussions on torture and recently admitted that he personally authorized waterboarding Khalid Sheik Muhammad.

Davidson sent Prime Minister Stephen Harper a letter last month asking that the government “either bar Bush from Canada, prosecute him once he arrives, or have the federal attorney general consent to a private prosecution” but she has yet to receive a response.

If (or when) Bush is granted entry, Calgary activists will be waiting. “We want to give him the welcome that he deserves — which is we want him to go back to the States, or we want him arrested,” says organizer Collette Lemieux. “It’s very important that we keep the pressure up. …We have to make it clear that there’s accountability,” she said.

Davidson’s law firm sought to bring torture charges against Bush during his visit to Vancouver in 2004 but the Canadian government “used a claim of diplomatic immunity” to block them. Nonetheless, Davidson is determined to bring Bush to justice. “It’s now a matter of public record that Bush was in charge of setting up a regime of torture that spanned several parts of the globe and resulted in horrendous injuries and even death. Canada has a duty,” she said.

There’s not enough courage or political backbone in this country to fully tackle the “alleged” wrongs of the Bush administration. But that’s only here. If another country, using international law as it’s guide, finds that by allowing Bush into their country violates their own laws then they have a right and a duty to uphold them.

    StratRat Says:

I guess that why Bush bought all that land in Paraguay. With no extradition treaty, he might be safe. Hopefully he will go insane from the guilt he carries.

I don’t know how and when this myth got started, but the U.S. actually DOES have an extradition treaty with Paraguay, and it’s been in effect since 1913. It was updated during the Clinton administration in 1998 with a clause added that neither country would extradite the other country’s citizen directly to the Hague for prosecution. But if Bush were indicted in this country for war crimes, Paraguay would be obligation to extradite him back to us. Secondly, the story about the Bush family buying land in Paraguay may be a rumor anyway, which started when one of the Bush daughters went down there. To my knowledge, there’s no proof that any such real estate transaction occurred.

  37. winddancer says:

P.S. And yes, I would very much like to see Bush either barred from entering Canada or being arrested there.

Camera zooms in on Bush’s face as he stumbles into the brush – just like the brush that he once mastered, now it scratches him, mocking his situation. Stark horror fills his watering eyes as the sound of pursuit alights in the distance.

He pulls himself up and contiues to run.

Behind him appear figures on horseback. Thier uniforms red and black. They wait.

He runs faster, turning his head to look behind, then in front, then behind, then in front, then behind, then in front, then he runs right into a telephone pole and knocks himself out.

Yes, they probably would. You would have to go through immigration and a lengthy process of becoming landed. You can, however, get a 2nd home there if you don’t spend more than 6 months at a time (I think that is the law).

The Canadian economy is quite strong. Their banks are in good shape (they stayed away from the whole invest in sub-prime crap) and not one has failed or is looking to be anywhere near failing. Their home prices are generally stable (some of the towns hit by plant closings are probably less stable in housing but nowhere near what is in the US). They are not facing unemployment as we are.

Do yourself a favor and STFU. You are a moron. You are far too stupid to be taken seriously. Your projection about US not having original thoughts was funny. That is the only service you will ever perform. That is other than the pocketchange you make blowing homeless lepers no at truckstops. We can laugh at people as stunningly stupid as you. Just go quietly away. Your stupidity is a stench no one wants to be exposed to. You are disguting and you will always be a moron
