Obama administration withdraws ‘enemy combatant’ definition.

Today, the Obama Justice Department abandoned one of the most prominent phrases of the Bush administration — “enemy combatant.” In a filing with the DC District Court, the DoJ said that it would no longer use the term and asserted a new standard for the government’s authority to hold detainees at Gitmo. The Obama administration is still claiming that it has the authority to hold prisoners there, but it will now be based on authority from Congress and the international laws of war. The Bush administration claimed that the president could unilaterally hold prisoners without charge.

    I’m getting the impression it will be based pending a review of the detainee policy; although this phrase is somewhat troubling:

    In its filing today, the government bases its authority to hold detainees at Guantanamo on the Authorization for the Use of Military Force, which Congress passed in September 2001, and which authorized the use of force against nations, organizations, or persons the president determines planned, authorized, committed, or aided the September 11 attacks, or harbored such organizations or persons.

    It doesn’t say ‘congress,’ it says ‘the president.’ Not encouraging, if I read it correctly, however much a politician, any politician, is viewed as trustworthy.

    In a filing today with the federal District Court for the District of Columbia, the Department of Justice submitted a new standard for the government’s authority to hold detainees at the Guantanamo Bay Detention Facility. The definition does not rely on the President’s authority as Commander-in-Chief independent of Congress’s specific authorization. It draws on the international laws of war to inform the statutory authority conferred by Congress. It provides that individuals who supported al Qaeda or the Taliban are detainable only if the support was substantial. And it does not employ the phrase “enemy combatant.”

    The Department also submitted a declaration by Attorney General Eric Holder stating that, under executive orders issued by President Obama, the government is undertaking an interagency review of detention policy for individuals captured in armed conflicts or counterterrorism operations as well as a review of the status of each detainee held at Guantanamo. The outcome of those reviews may lead to further refinements of the government’s position as it develops a comprehensive policy.

    “As we work towards developing a new policy to govern detainees, it is essential that we operate in a manner that strengthens our national security, is consistent with our values, and is governed by law,” said Attorney General Holder. “The change we’ve made today meets each of those standards and will make our nation stronger.”

    In its filing today, the government bases its authority to hold detainees at Guantanamo on the Authorization for the Use of Military Force, which Congress passed in September 2001, and which authorized the use of force against nations, organizations, or persons the president determines planned, authorized, committed, or aided the September 11 attacks, or harbored such organizations or persons. The government’s new standard relies on the international laws of war to inform the scope of the president’s authority under this statute, and makes clear that the government does not claim authority to hold persons based on insignificant or insubstantial support of al Qaeda or the Taliban.

    The brief was filed in habeas litigation brought by numerous detainees at Guantanamo who are challenging their detention under the Supreme Court’s decision last summer in Boumediene v. Bush. A copy of the brief is attached.

    Ok, I have to interrupt for just a moment if I could. This is Archie’s Mom and I have some splainin to do.There’s a reason for Archie’s lack of self esteem and I hope that you can show some compassion.

    When Archie was but a child his father left us for his other cousin, she was younger than I and she had more teeth. I was left to fend for myself and I resorted to the “oldest profession” to keep Archie in cereal and food on the table, plus a little left over for the crack pipe.

    Little Archie was so cute, he used to clean me up for the next client and his little tongue was so gentle. Especially after I had been hit in the behind, which is also an explanation for the behavior badass pointed out.

The (alleged) president can just come up with some word and define a person as such and that somehow gives him the justification to lock them up indefinitely (and torture them and their children).

    If there’s no longer an “enemy combatant” designation, do the Gitmo prisoners have legal recourse to sue Bush administration officials, for adhering to a policy that had no legal precedent? Usually these things are sorted out in the Supreme Court, but since using the term in legal proceedings was an act unprecedented, don’t we now have an obligation to push this all the way to the SCOTUS for legal clarification, in the cases of prisoners’ civil suits?

We don’t have to grant them superpowers above and beyond the capability of actual combatants captured on the battlefield. We should treat all prisoners of war according to the rules of the Geneva Convention, just as we would have liked for Senator McCain and any other U.S. soldier to be treated in accordance with the convention.     California Judge Ruling in Keyes’ Lawsuit on Obama Qualifications

    March 13th, 2009

    On March 13, California Superior Court Judge Michael Kenney tentatively ruled against Alan Keyes, in the lawsuit concerning whether President Barack Obama meets the constitutional qualifications to be president, and whether the California Secretary of State should have put him on the ballot.

    The case is Keyes v Bowen, 34-2008-8000096-CU-WM-GDS. The 6-page opinion seems to strengthen the rights of political parties to place anyone they wish on the November ballot, regardless of that candidate’s qualifications.
    The decision says, “Defendants contend that Election Code sec. 6901 requires the Secretary of State to place on the ballot the names of the candidates submitted to her by a recognized political party and that she has no discretion to override the party’s selection.

    The Court finds that the First Amended Petition fails to state a cause of action against the Secretary of State…Federal law establishes the exclusive means for challenges to the qualifications of the President and Vice President. That procedure is for objections to be presented before the U.S. Congress pursuant to 3 U.S.C. section 15.”

    You mean “GOOD Things as they have been for the past 8 years”

    What sort of cult are you involved in here that you could quote the basis for Bush’s detainee policy, suggest it means POW status and court trials and then call this good, just because it’s being continued by Obama?

    Really. Try explaining this without brainwashing being involved.
