Spanish court agrees to consider criminal case against former Bush administration officials.

A Spanish court “has agreed to consider opening a criminal case against six former Bush administration officials…over allegations they gave legal cover for torture at Guantanamo Bay.” The officials include former attorney general Alberto Gonzales, former undersecretary of defense for policy Douglas Feith, former Cheney chief of staff David Addington, Justice Department officials John Yoo and Jay S. Bybee, and Pentagon lawyer William Haynes. The AP has more details on the case:

Spanish law allows courts to reach beyond national borders in cases of torture or war crimes under a doctrine of universal justice, though the government has recently said it hopes to limit the scope of the legal process. [...]

Human rights lawyers brought the case before leading anti-terror judge Baltasar Garzon, who agreed to send it on to prosecutors to decide whether it had merit, Gonzalo Boye, one of the lawyers who brought the charges, told The Associated Press. [...]

The judge’s decision to send the case against the American officials to prosecutors means it will proceed, at least for now. Prosecutors must now decide whether to recommend a full-blown investigation, though Garzon is not bound by their decision.

    Under Reagan, our CIA armed and trained a lot of right-wing fundamentalist peasants and urged them to attack the government of Afghanistan, which then was supported by the Soviet Union. Finally, the Soviet Union intervened and occupied Afghanistan and we racheted up our support of the anti-Soviet forces. When the Russians finally withdrew, in failure, we did nothing to help the people of Afghanistan avoid a rule by religious fundamentalists. No, we let the Taliban take over.
    Bush II didn’t like the Taliban government of Afghanistan since they would not allow American corporations to build oil pipelines across their country.
    So, using the Taliban support of Bin Laden as convenient cover for an invasion, Bush installed Karsai, a former CIA man and a former Union Oil Company of California executive, as the head of the new puppet government in Afghanistan.

    All the bombs, tortures, imprisonments and murders by US occupying military forces are not going to force the Afghanis to accept our puppet government in their country.

    Obama should stop committing war crimes in Afghanistan and withdraw all of our contractors, Nato forces and American military occupiers.

    The United States use of torture is a test for those who support human rights around the world. Is their commitment strong enough to bring a case against the world’s only superpower? Is their government going to back up the case with sanctions like those they would apply to any other country found to have committed human rights violations? I’m not optimistic.

    I think Obama has to focus on cleaning up the sh!tpiles left on the White House doorstep when he got there. People need help in their daily lives right now, the wars need to be managed now.
    I don’t believe that the prosecution of Bush&Co is off the table — I think it is a matter of priority.
    If Obama has any hope of passing his aggressive agenda to fix the economy and health care, all the while managing the fiasco in Iraq and Afghanistan, he cannot incur the wrath and backlash that would follow if he overtly went after Bush&Co.
    For now, let the committees work, let the private sector continue its investigations with FOIAs, and Obama can pick up the ball later.
    I hate the embarrassment of having other countries do what we should be doing ourselves (indeed, should have been doing for a long time)but we can’t change facts. Remember there is no statute of limitations on war crimes.

We send thousands to jail for relatively minor crimes. The crimes of the Bush Administration are too terrible to allow money and power to thwart Justice.

    it’s funny that the first defense the trolls can come up with to defend BushCo is “well obama killt civlluns’ too!!1″ betraying their lack of perception and comprehension skills. while I am of the opinion that any civilian casualty in a war zone should be treated as a murder, I am aware of the fact that I am a complete pacifist, and also a wuss. needless to say, common consensus that ‘inadvertant’ civilian casualties are usually viewed as nothing more than a ‘great tragedy’ with the worst punishment being the leader of the entity at fault basically promising not to do it again…

    the crux of these charges stem from allegations of torture and improper imprisonment at gitmo and other ‘extralegal’ military prisons… the president has categorically denounced any form of torture, which IS a war crime, period.

    While your anger is justified, it is still against US and international law to torture prisoners, regardless of the crime they may have committed. If you don’t like US law, you should move.

    celtic cynic 105, the same senario struck me. The poor boys may not be able to leave the continent. They will at least have second thoughts about leaving. The president made the right choise not persueing war crimes. This issue needs to rattle around in the public domain, or it would be labled political. We are dealing with Republicans. Once some of the fiscal problems are hammered out this is bound to make its way to the surface.
    The Republicans have been minding the store for 8 years,and we are just seeing the tip of an iceburg!

    The complaint was filed by a lawyer in Spain who did his legal studies while serving over seven years in prison for kidnapping and terrorism. His complaint accuses the U.S. government of systematically torturing war-on-terrorism detainees — something the terrorism manual advises all terrorists to do when captured. . He filed this complaint with Baltasar Garzon, an activist magistrate famous for championing the “universal jurisdiction” of Spanish courts. That magistrate is now asking a Spanish prosecutor to bring criminal charges on this matter against former U.S. Attorney General Alberto Gonzales and five over Bush Administration officials. The prosecutor has declined to being such charges.

    In an op ed in the Wall Street Journal, Douglas Feith has pointed our blatant errors in the allegations of the complaint, particularly the allegation that he advised George Bush to ignore the Geneva Convention that has been disproved.
