Last week, the ongoing legal battle between Democrat Al Franken and Republican Norm Coleman officially became the “the longest recount in Minnesota history.” Though Franken leads Coleman in the current vote tally, according to the Minnesota Supreme Court, he can’t be certified until after election challenges have been decided in the state courts.
If Coleman loses in the state courts, he and his Republican backers are indicating that they may seek to bring it to the federal level, which could keep the Senate seat vacant for much longer. National Republican Senatorial Committee Chairman John Cornyn told Politico recently that the party is willing to keep the seat empty for “years“:
Texas Sen. John Cornyn is threatening “World War III” if Democrats try to seat Al Franken in the Senate before Norm Coleman can pursue his case through the federal courts.
Cornyn, the chairman of the National Republican Senatorial Committee, acknowledges that a federal challenge to November’s elections could take “years” to resolve. But he’s adamant that Coleman deserves that chance — even if it means Minnesota is short a senator for the duration.
The threat of an empty Senate seat for years — which would hold the Democratic advantage in the Senate at 58-41 — does not appear to be a welcome concept to the people of Minnesota. The Star Tribune reported last week that “the prospect of a protracted battle irks some regardless of their political leanings.”
Additionally, Minnesota Gov. Tim Pawlenty (R) believes that only having one senator is hurting Minnesota. In February, Pawlenty told C-Span that “it has put Minnesota at a disadvantage when there’s only 100 senators total and you are missing one.” Watch it:
Sen. Amy Klobuchar (D-MN), who is serving as Minnesota’s lone voice in the Senate these days, says that it has been a “challenge.” Klobuchar told Politico in February that “her home-state office has been flooded with phone calls and said her staff has seen its casework double in size.”
Because, as is always the case now days, it is far more important to protect the ‘PARTY’ than to protect the people.

Lawyers from the Coleman camp are putting all of their eggs in one basket and will take their case to the Supreme Court using Gore v. Bush to prove their case.
They seem pretty confident that they constitutionally have a strong case with the Supreme court. If we have a repeat of Gore/Bush 2000 things are going to get really ugly here in Minnesota.

Hey, O-idiot, Minnesota law demanded a recount, not Al Franken. And all the legal ballots were counted, again per Minnesota law, the canvassing board judges, and both Coleman and Franken legal teams. So stuff it. Coleman is the sore loser looking for any way to overturn the valid outcome of the election. The only argument left to Coleman is that the entire election was invalid. Even Bush didn’t try to make that argument in 2000.

I wish I would have had my memory cap on when I read about this in the paper last weekend but (in my recollection) what the Coleman lawyers are going to push is that some absentee ballots were counted while others were disallowed which according to a section of the constitution about the right to vote, will be used. (Sorry for not knowing the exact wording or the section of the constitution)
All that is required to seat Franken is a certificate issued in the state of Minnesota. Whatever happens beyond that in the federal courts is irrelevant.

Coleman can appeal to the federal courts of course, but I would hope the state would seat Franken rather than wait for the outcome. Most election lawsuits take place after the elected has already been seated.

In order for a runoff election to take place, the law would need to be changed. I don’t think the Mn IR Party (our version of the GOP) has the political will or capital to make it happen. Heck! Most of the pro-Norm comments one still sees are copy-paste jobs form a Reichwing blog or partial transcripts from some ReichRadio scumbag. Even those who don’t realize they are repeating bald-faced lies are so wildly misinformed that they lack any semblance of credibility.

Imagine an ordinary citizens’ group saying they will start WWIII, or telling people to be armed & dangerous against the government (as Michelle Bachmann said). The FBI would be all over them. The GOP really is dealing in lies, smears & violence lately. No logic, no substance, no patriotism.

As the Republican Party descends deeper into fascism, they will continue to object to the results of elections, and as they continue to lose power, their use of dirty election tactic will increase in severity and frequency. We saw it with Bush and we see it with Coleman. We can expect lots more election nonsense from the Republicans in the coming elections.
The metaphor of starting world war III is a very fitting one. Once the GOP can no longer filibuster, they will become extremely frustrated and desperate. They might very well resort to a military coup of some type to take over the government of the United States. This would, of course, constitute civil war. Given the GOPs deviousness, they might attack another nation in an effort to, literally, start world war III, believing that they will somehow benefit if the United States gets into a world war.
I do want to disagree with some previous posters on the idea that world war III would necessarily be nuclear. It is entirely possible that a world war could be fought without nuclear weapons, although I agree that they would be used eventually, just as the losing side was about to be defeated.

Any legitimate case brought to the courts should be fast-tracked and a time limit set for seating the Senator. 6 months is too long but at this point, may be reasonable.

April 1st, 2009 at 5:58 pmNow that The Court has Ruled on Absentee Ballots and disenfranchisement, counting Ballots that are improperly rejected and disqualifying all the others which did not meet qualifying criteria; that issue becomes easier for the Appeals Court to decide upon. The central issue of “Double-counted” Absentee Ballots also Ruled on; leaving ex-Senator Coleman with one dying breath left: “Bush v. Gore.”
This Case is NOT going to be heard by the Unites States Supreme Court if Coleman Appeals using “Bush v. Gore” as a deciding precedent. The Supreme Court has already written its
position on hearing anything based on “Bush v. Gore” when they wrote: “The Supreme Court presented no relevant precedent for their interpretation of the equal protection clause in this ruling and further stated that this interpretation applied ONLY to Bush v. Gore and was not to be used as precedent in any future case. According to the decision, “Our consideration is limited to the present circumstances, for the problem of equal protection in election processes generally presents many complexities.”
The Supreme Court writes it in a manner which is clear and convincing, but difficult for anyone unfamiliar with how The Supreme Court politely warns you about what NOT to do.
What they mean, ex-Senator Coleman, IS: “Don’t come near here with any weak bullshit about equal protection in an Election.
The State Courts have already made the call and we DO NOT WANT TO ENTERTAIN an argument of that nature.”
