Today, the Alaska Republican Party called for Sen. Mark Begich (D-AK) to step down and allow for a new election, in the wake of Attorney General Holder voiding former senator Ted Stevens’s guilty verdict, due to prosecutorial misconduct. This afternoon, Gov. Sarah Palin (R-AK) echoed those calls and pressed for a new election:
“A special election will allow Alaskans to have a real, non-biased, credible process where the most qualified person could win, without the manipulation of the Department of Justice,” the release stated.
“I absolutely agree,” Palin responded in an e-mail to the News-Miner. She said Begich should step down pending a special election.
Though Palin is now enthusiastically jumping back on the Stevens bandwagon, she was more wary when he was first convicted, backing away from an earlier call that he resign and refusing to say whether she would vote for his re-election.
Somehow I doubt if shewould agree if the R and D after their names were reversed…

A judge decided the prosecutorial misconduct was not bad enough to dismiss the case, and a jury convicted him. No appeals court overruled the judges decision on this matter. Given the fact this was a bush justice department, the prosecutorial misconduct might as easily have been intentional as it was incompetence. Although the proof against stevens the he received gifts he didnt report was ironclad (they had him on tape for chrissakes), and his excuse laughable (I was waiting for years to get a bill and didnt ask any questions when I never got one), it looks like the bush justice department defenitely had some of its members sabotage the case. Even though stevens is guily as sin, and in fact the statute of limitations was the only thing that prevented charges of outright bribery from being piled on as well, unfortunately if the case against Stevens was taken up again, the pundits would be screaming “political prosecution of a poor old republican”…in many, many ways, Obama has bigger fish to fry and other things to spend poltical capital on.. Also, as one commententor mentioned, someone at the bush department may have so badly sabotaged the case that, were their appeal to have succeeded, getting a conviction on retrial, or even avoiding a motion to dismiss by the defense, may have been impossible. If you are a prosecutor, there are many instances where the toothpaste cannot be put back into the tube, so to speak…Look at it this way…A federal judge didnt think the prosecutorial misconduct was bad enough to dismiss the case, and federal judges don’t like to make decisions that would be overturned on appeal….stevens is now known as a bribe taker, he’s out of the senate, and hopefully his political career is over, so honestly, the positive results of exposing his criminality have be acheived..

He has, apparently, determined that the prosecution was screwed up so royally that it would be impossible to justify a new trial. Stevens has not, however, been acquitted.

April 2nd, 2009 at 9:13 pmThese bozos holding pity parties for Stevens and calling for Begich to step down are the same bozos who, if it were anyone other than Stevens or some other Republican politico, would be calling for the lynching of any judge or prosecutor who would dare dismiss charges against an accused criminal on a legal technicality. (O’Reilly would have little Jesse stalking Holder and demanding to know why he put this criminal back on the streets.) And, essentially, that IS why Holder requested dismissal, a technicality. The Bush DOJ had a good evidentiary case against Stevens but mucked up the prosecution of it so badly, that it would be impracticable (if not unethical) for Holder to go forward on appeal. The evidence of Steves’s many wrongdoings (all seven counts of them) is still there. The prosecution’s wrongs, don’t make Stevens’s conduct right.

We occasionally have people who drop by pretending to want to learn or debate, but they’re really only here to amuse themselves, kind of like the blog equivalent of prank calling (although, at 18, you’re probably too young to know about prank calling, what with caller ID and all). Those folks, we catch on to them pretty quick and they’re immediately branded as trolls and kept around just for our amusement.

Stevens wasn’t exhonerated, he was just given a free get-out-of-jail card. Just because Holder wishes to mislead the voter of Alaskas, doesn’t mean that the vote is invalid.
The voters of Alaska voted based on reality and the fact that Stevens actually did commit these crimes, and probably hundreds more that haven’t been brought up on charges.
Just because we have an attorney general who thinks his role is to protect the Republicans that have ruined our economy and standing in the world via war crimes, doesn’t mean they are not guilty. It means we still have severe problems with the Justice Department actually providing the American people justice.

One even wonders if this wasn’t the plan all along but they got the timing messed up so it backfired. Stevens did take the money, after all. Why, with a strong case, did these Bush prosecutors resort to illegal tactics? This smells rotten to me.

April 3rd, 2009 at 9:04 amLet’s suppose, for a moment, that it was Begich who had been charged with a crime, and that Stevens beat Begich in a very close election. And then let’s suppose that after the election, the charges against Begich were dropped.
What would Palin’s reaction have been if the Alaska Democratic Party suggested that Stevens resign and a special election held? My guess is that she (and all the rest of the Alaska GOP) would be laughing so hard she would be incapable of speech. And rightly so — that scenario would be ludicrous.
The election was held in November and Stevens lost a tight race. Assuming the election itself was run fairly (and there’s no evidence to suggest it wasn’t), the results stand with no redos.
If Stevens believes somebody intentionally sabotaged his reputation to cost him the election, then he may sue. However, if he sues, the burden of proof will be upon him to show there was no basis for any charges to be brought against him in the first place. If he’s unwilling or unable to do that, he should fade into the background and enjoy his retirement — and thank his lucky stars that incompetence in the DOJ kept him out of jail.
And the Alaska GOP, including Palin, should just STFU.

Anyway, Gov Palin and Stevens are like two peas in a pod. I hope she does run in 2012, so we can all hear about the free house she had built by all the contractors who got that sweet sports center deal in Wasilla. The dems pulled alot of punched from Palin, saving them for later (2012).

Palin has concluded that, because his conviction was overturned due to prosecutorial misconduct, Ted Stevens is innocent and should be allowed to reclaim his Senate seat.
During the 2008 Presidential campaign, Palin’s favorite stump speech referred to Obama “palling around with terrorists”, of course referring to Bill Ayers. Yet Ayers was never convicted due to……prosecutorial misconduct. So using her logic, Ayers was innocent and therefore she was unfairly calling him a terrorist.
What about it, Sarah? Can’t have it both ways. Oops. I forgot. She’s a Republican, so she CAN have it both ways. Hypocrisy is SOP for the GOP.

It depends upon the exculpatory evidence that should have been presented at trial for the jury to decide its weight in determining the guilt or innocence of the accused.
