Alter: Bybee ‘pretty clearly, by some lights,’ violated his oath to uphold the Constitution.

This afternoon on MSNBC, host David Shuster spoke with Newsweek columnist Jonathan Alter, who explained that while the popular political discourse has focused on one of two possible courses to resolve the Bush administration’s illegal acts of torture (a congressional or independent truth commission or criminal prosecutions), a third option also exists: impeachment. Alter noted that Federal Judge Jay Bybee is the only Bush administration torture architect still in public office and can be held to account through impeachment proceedings for his failing to “uphold the constitution”:

ALTER: There’s also a third route which would focus on the only one of these folks from the Bush White House who’s in public office now and that’s Federal Judge Jay Bybee. You could see, conceivably, a movement to impeach Judge Bybee. These other folks, there’s no indication that they violated an oath to uphold the constitution in the way he did, or if they have, they are no longer in a position of public trust, the way he is.

    These other folks, there’s no indication that they violated an oath to uphold the constitution in the way he did, or if they have, they are no longer in a position of public trust, the way he is.

    Excuse me? Just because one is not in the position to do it again means they can’t be held accountable for violating the same oath?

    Just when did our legal system contain the idea that unless you are caught in the act you get to go free?

    Uh really? The memos indicate they violated their oath’s to the constitution and regardless of whether they are in positions of power or not, there is not statute of limitations on murder. Let’s call it what it is.

    Pelosi, Reid, Leahy and the rest of these scumbags are in the process of proposing a so-called “Truth Commission” without any criminal prosecution for the Bush/Cheney Criminal/War Crimes Cartel….My stomach is still rolling!

    The purpose is clear: To “stonewall” and “whitewash” everything…bury it in investigations for years!! Whenever these two “class clowns” get their noses into anything it’s ALWAYS NEVER IN THE INTERESTS OF THE AMERICAN PEOPLE!! Looks like the “Fix is in”, and I bet Obama is so happy he probably pissed his pants!

    For crying out loud!!! Judge Bybee is a Republican. Enough said. They are the party of death and pain. They like it. They embrace it like the right wing christians (small c) like the rapture. The question of legality does not enter into it for them. The only questions are: how much can we do? And can we get away with it? Can I watch it? Or do I have to look at it? Take your pick.

    The people that prescribed it, that endorsed it, and that did it, or morally moribund creatures. expecting them to see it for what it is, is like trying to explain color to someone color blind.

    So do 99% of everyone in government. Most of what the federal government does is unconstitutional.
