Greg Sargent notes that despite the media’s reluctance to describe it as such, a new poll out today by the New York Times and CBS News found that 71 percent of Americans consider waterboarding to be “a form of torture“:

The poll also found that 87 percent of Americans believe that the U.S. health care system needs to be fundamentally changed or rebuilt completely. Additionally, 42 percent said that they believe gay couples should be allowed to marry, an increase of nine percentage points from March 2009. In total, 67 percent support either same-sex marriage or civil unions.
Well, DUH! Apologists for the torture-happy crowd make demonstrably false cklaims that torture somehow produces rsults that have helped save American lives. There is not one single case of torture doing such a thing. People who are tortured will say anything to get the torture to stop, period.
Didn’t the Bush Administration use water-boarding torture to fabricate a tentative (and false) link between al Quida and Iraq to justify going to war to the detriment of the “war on terror”?
April 28th, 2009 at 9:54 amThis demonstrates how right-tilted our public discourse is.
If a hypothetical Democratic President had been caught waterboarding, there would be no phony debate on whether torture is torture.
April 28th, 2009 at 9:54 amPoll: 71 percent believe that waterboarding is torture.
While the remaining percentage is related to Dick Cheney ……..
April 28th, 2009 at 9:54 amOf course it is torture. And of course the far right Republicanics are for it. After all, “interrogation” is just a fancy word for “talking” and the far right Republicanics do not accept “talking to our enemies”. Gotta hurt ‘em, you betcha.
April 28th, 2009 at 9:59 amPoll: 71 percent believe that waterboarding is torture.
– - 71% of the poll respondents are more honest/smarter than Newt Gingrich. Shocking. Not so much.
April 28th, 2009 at 9:59 amOnly 71%?
Wow, who are the other 29% that doesn’t understand that drowning someone slowly and deliberately is torture?
People can talk until they are blue in the face, but waterboarding is torture. The issue is, can these torture deniers disingenuously pretend that waterboarding is not torture by extending the discussion.
The best thing to do is admit that waterboarding is torture, lest we look stupid to the world. Then the debate can focus on should we torture. Of course the answer to this question is as simple as the other.
April 28th, 2009 at 10:00 amWaterboarding is only one of many techniques condemned universally as torture; the media preference to use a euphemism – enhanced interrogation – instead of the accepted terminology has contributed to public disinformation and allowed the apologists for torture to hair-split their own definitions.
This is debated now because Bush&Co used these illegal tactics and tried mightily to re-write laws and the interpretation of same to accommodate their immorality.
For a century or more, this was not a topic for debate – that it is debated now is further demonstration of the vast corruption of Bush&Co.
April 28th, 2009 at 10:01 amThe sad part is that its NOT 100%.
So 29% of the nation doesn’t believe in the rule of law?
April 28th, 2009 at 10:04 amFirst they denied they used torture, then they admitted they used it (but limited to a few), then came photos and testimony, so now they claim that torture is legal (by their definition). If it is legal, why did they deny it?
April 28th, 2009 at 10:04 amFunny how that 25-31% number keeps coming up….
April 28th, 2009 at 10:07 amPresident Obama states “The United States does not torture.”
Great, but it needs to be followed up with “and we will investigate and prosecute anyone involved in torture on behalf of the United States.”
The people have weighed in on this issue, Mr. President. Take action now.

April 28th, 2009 at 10:07 amThis is all wrong, wrong, wrong. The media and all of the Twitteratti and Glenn Beck’s militia media tell me that America is a center right nation.

April 28th, 2009 at 10:08 amMrBrown asks:
So 29% of the nation doesn’t believe in the rule of law?
I believe in every society there exists a certain percentage of sadists and misanthropes and miscreants – 29% seems a bit high even for that, so perhaps we also have a few brainwashed fools who think they get fair and balanced news from Fox.
April 28th, 2009 at 10:08 amWell, I’m glad that 71% “believe” waterboarding to be torture, because according to international law, IT IS.
No belief required.
April 28th, 2009 at 10:10 amDammit, twenty nine percent still believe fox.
April 28th, 2009 at 10:15 amI think we’ll be seeing the percentage 20+/- for a loooooooooonnnnnnnngggg time guys.
April 28th, 2009 at 10:16 am29% believe waterboarding is NOT torture!
29%.
Now, where have I heard that figure before?
Why, the Bush apologists, of course.
April 28th, 2009 at 10:18 amIt does boggle the mind, though, to see that percentage so high.
Again, why do they continuously lap the scrotum of CONservatives, who blatantly disregarded the Geneva Convention, against international law?
Would the be so willing to blindly follow the stupid nonsense of whether waterboarding is torture if it happened to one of our brave soldiers?
Or a family member?
The other 29% must be mostly repugnicants, Lamebaugh supporters, and rightwingnut crazies. Anyone that believes waterboarding is not torture has got to be NUTZ. These types will probably always exist in the US. I’m glad they’re in the minority.
April 28th, 2009 at 10:20 amI don’t think there’s any doubt that what the Bush Administration did was torture–this isn’t merely “Law & Order” rerun justice where the cops grill the suspect with hot lights and billy clubs. These are practices used in the past by people who were convicted for them.
I think the GOP’s conundrum is that they are both trying to deny this is torture AND convince the public that, if it was torture, it was justified. It’s a buffering layer to act as insurance when it is verified that these are torturing practices.
This poll won’t convince pundits that it is torture. Sadly, it will convince them that the Obama electorate is blind because they hate the Bush Administration.
Or it will just be another poll for them to ignore.
April 28th, 2009 at 10:20 amThe hypocrisy, illegality and immense immorality of the Bush regime will haunt the US for decades to come.
Mission accomplished.
April 28th, 2009 at 10:21 amSo despite six years of neocons attempting to skew the facts on waterboarding, 71% of Americans clearly see it for what it has always been accepted to be…torture. The apologists and defenders of torture are the most un-American piss ants this nation has EVER witnessed. Torture, more than almost anything else that I can think of, goes directly against what this Nation was founded on, a dream of true freedom based on rule of law. Republicans in both the Senate and Congress should be condemning these crimes as well as the divisive self-serving talking heads on Reich Radio and TV and demanding investigations if they want to cling to any shred of the old “party of law and order”, or if they hold any hope of re-election in 2010. Fortunately for the Democrats this will not happen because what remains of the Republican Party is the basest of divisieness and hatred of true America. For years the right had convinced itself that the bible thumpers and gun toting rubes WERE the essence of America. Now that we see that this crowd of teabaggers is ALL that the right has left we can clearly assertain that the Nation is most definitely left of center. Sorry moonbats, it must suck to be part of what is left of your sorry party. Face it, left is the new center and you misguided fools on the far right are nothing but fodder to be ridiculed at the least, criminals and treasonors at the worst.
April 28th, 2009 at 10:22 amInteresting but does not matter.
Waterboarding is PROHBITIED under BOTH the Geneva Convention ADN the U.S. Army Field Manual.
Why is this even debatable??

April 28th, 2009 at 10:55 amI think it works pretty well actually.
April 28th, 2009 at 11:04 amWho gives a rats a$$ if pole responders BELIEVE waterboarding is torture or not? It is. And IT IS illegal. Period! Opinions be damned.
Not enough emphasis is being put on the fact that we’re not just talking waterboarding here. Sleep deprivation, humiliation, stress positions, etc. In combination, hard to defend the “not torture” argument. Even the most ardent “not torture” defenders have to reasonably agree that, at the very least, such treatment constitutes cruel and unusual punishment…still illegal.
How many were tortured? Any estimates?
Here’s a hypothetical question. Let’s say it’s found that “private contractors” utilized torture on their own volition. Would they be offered the same “immunity” as CIA agents? (No time to respond today if anyone answers)
April 28th, 2009 at 11:08 amOf course it is torture; it was invented to BE torture. It’s been described and defined as torture by just about everyone. It has been prosecuted as torture for centuries. How anyone could think there is still any debate about this is stupefyingly ignorant.

Tell em about it! This issue probably points out the ludicris attitude of the MSM to create the false sense of “balance” on their reports. To entertain the debate on whether or not waterboarding is torture gives some credence to the insane argument that it ISN’T torture and the media has completely botched it.

April 28th, 2009 at 12:04 pmIt doesn’t matter IF PEOPLE BELIEVE that waterboarding is torture or not because it is ALREADY RECOGNIZED UNDER CURRENT U.S. LAW AS A CRIME! Opinions on that are absolutely irrelevant! You might as well have a poll stating that “71% of people believe that murder is a crime.” When a crime is committed, our court system does not poll the public to see whether or not they agree that the actions were a crime or not. but instead they prosecute the crime because it is already recognized as a matter of current black-letter law.

http://abcnews.go.com/sections/us/polls/torture_poll_040527.html
It is ok that you have no decency and approve of torture. Just remember that YOU are the fringe, not us. ENHANCED interrogation techniques seem to mean things like hooding and noise bombing. A majority wont even support threats, more from the poll
Far fewer Americans accept other practices. Four in 10 call it acceptable to threaten to shoot a suspect, or expose a suspect to extreme heat or cold. Punching or kicking is deemed acceptable by 29 percent. And 16 percent call sexual humiliation — alleged to have occurred at the Abu Ghraib prison in Baghdad — acceptable in some cases.

The STUPID in this statement is jaw dropping. Lets start with who is THEY? I mean if we are talking to him then he obviously has never blown himself up. So are you saying that because SOME Muslims HAVE been suicide bombers that justifies us torturing ANY Muslims at ANY time so you can feel safer? Not BE safer just feel that way. You really are a coward. Since THEY obviously doesnt mean suicide bomber what IS the criteria? Do we need to PROVE they have done something wrong? In COURT? If not it is inevitable we will torture innocent people. In fact we already HAVE at least twice, once because the guy had a NAME similar to the one we wanted. THEY want to kill us. Who exactly are you talking about? Muslims in general? You are a coward. You dont care about guilt or innocence, you dont care about American values. You seem only to care about how YOU feel while you are shivering under your mommys bed and are willing to appolgize for warcrimes in order to make the scary thoughts about scary turban guys go away. What level of attrocities are you willing to appolgize for? Would you say drop daisy cutters at random through the middle East as Ann Coulter advised? How about killing one hundred million Muslims, virtually at random as Micheal Savage advised? Get help. You are sick, stupid and sick

NO. You mistake YOUR cowardice for EVERYONEs feelings. If you have to torture someone to save my life. Let me die. What good is it to save my life if I lose my soul and THAT is what we are talking about the SOUL of America. For our good country to lose our soul is too high a price to pay for my life. I understand. YOU are a coward and not a very bright one so you see it differently. Fine. Just dont expect us to overlook the fact it means you HAVE. NO. DECENCY.
