House Minority Leader John Boehner (R-OH) said President Obama’s push for progressive policies, including a hate crimes bill, “makes me want to throw up,” and declared Obama has “no plan for keeping America safe.” When asked by the Washington Times to grade his party’s 100 days of opposition, Boehner replied, “I think our team’s doing fairly well, considering the barrage that’s coming at us.”
Yesterday, a three-judge panel of the Ninth Circuit Court of Appeals rejected the Obama administration’s state secrets privilege claim, allowing an “extraordinary rendition” case brought by five detainees against Boeing subsidiary Jeppesen Dataplan to proceed. The Justice Department has invoked state secrets in three court cases since Obama took office. Glenn Greenwald has more.
“American authorities confirmed the first death outside of Mexico from swine flu” today, as Dr. Richard Besser, acting director of the Centers for Disease Control and Prevention, said on CNN this morning “that the first American death of the disease was a 23-month-old child in Texas.” Besser gave no other details about the child.
Today, the Supreme Court will be hearing a challenge to Section 5 of the Voting Rights Act (VRA), which “requires selected jurisdictions across the country to ‘preclear’ new voting rules with the Justice Department or a federal court.” The NYT writes that it would be “judicial activism” to take away Congress’s right to protect minority voters, and Sen. Patrick Leahy (D-VT) has an op-ed with evidence that the VRA is still needed.
Yesterday, White House Press Secretary Robert Gibbs “pointedly refused to rule out a firing in the case of the Air Force One backup’s flight that terrified some in New York City on Monday.” Gibbs said that the White House Deputy Chief of Staff will conduct a review of the incident and the President “will take steps based on the outcome of the review.”
Attorney General Eric Holder will make a “public appeal” to European officials for help in closing the U.S. prison at Guantanamo Bay by taking some of the freed inmates. Yesterday, Czech Interior Minister Ivan Langer suggested that European nations would be receptive to Holder’s appeal, saying, “I expect Europe will take some, and there is a strong will do so among some countries.”
On the 99th day of his term in office, President Obama’s Cabinet was finally completed yesterday when the Senate confirmed Health and Human Services Secretary Kathleen Sebelius with a vote of 65-31. “We wanted to swear her in right away because we’ve got a significant public health challenge that requires her immediate attention,” said Obama last night as Sebelius took the oath of office.
The achievement gap between black and white students has not narrowed, “despite President George W. Bush’s frequent assertions that the No Child law was having a dramatic effect.” Although minority students “all scored much higher on the federal test than they did three decades ago, most of those gains were not made in recent years, but during the desegregation efforts of the 1970s and 1980s.”
And finally: On Monday, House Minority Leader John Boehner (R-OH) received a reminder that politics is “a full-body-contact sport” when he “collided with a teenage skateboarder while strolling along Pennsylvania Avenue.” Boehner reportedly “was knocked off his feet, but not totally off his game; he stumbled, but didn’t completely wipe out, after the crash.” Boehner and the teen then “exchanged wary looks.”

That particular voting group did not really care about any other social issue and has always had a “my way or the highway” mentality.
The “Evangelical Christians” will continue to “purify” the Republican Party, adding more black and white litmus tests: for gun control; against equal pay for women; for prayer in schools; against unionization; for deregulation; against social welfare, and so on.
In some ways, their model is an authoritarian/libertarian government: the only function of government is to keep them safe from outside attack and crime (authoritarian). Other than that, it’s every man for himself (libertarian). And, yes, every man for himself; women are to tend the home and make babies. That’s the Republican Evangelical Christian Utopia, in a nutshell.

How do you know when someone has commited a hate crime? When a young black man kills another young black man, is that a hate crime? Since a hate crime can only be perpetrated against a minority, isn’t the killer, also a minority, incapable of hating while killing? What if a Mexican kills another Mexican, would that be murder or a hate crime? I only ask because the mass murder of blacks and Hispanics by white folks hasn’t materialized, so what do we do with all of the minority on minority crimes after we pass “hate crime” legislation? You appear to be operating on a couple of erroneous assumptions here. First, that hate crimes can only be perpetuated against minorities, and second, that only hate crimes can be prosecuted as crimes.
Do you really not know what a hate crime is? It’s bias-motivated violence against another person. That bias doesn’t necessarily have to be against a person’s race — it can also be against a person’s religion, nationality, or sexual orientation. So if a black man assaults another black man because that man happens to be gay, that’s a hate crime. And one need not be a minority to be a victim — if a black man kills a white man because he’s white, that’s a hate crime.
I’m sure you’re smart enough to realize that not all violent crimes are motivated by prejudice and hatred. People kill others, assault others, and vandalize others’ property for a wide variety of reasons. They’re still crimes, and are prosecuted as such. It’s not like people are getting off scot-free if hate can’t be proven.
Furthermore, the designation of “hate crime” isn’t a stand-alone charge. What it does is augment the charge of the crime itself, calling for a greater sentence. For example, if a couple of Klansmen knock out a Jewish man because he’s Jewish, tie him to the bumper of a car, and drag him along the road until he’s dead, that’s a hate crime. But the charge will still be murder, with the “hate crime” charge tacked on — resulting in a harsher sentence.

In the interim between 9/11 and Iraq, the thing that most bewildered me about the Republicans was their complete lack of interest, even for PE purposes, in things like container shipping, chemical plants, and railroad shipments. One thing I agreed on with my more paranoid friends was that we should get used to soldiers manning the airport scanners for the foreseeable. But no, after the initial fear offensive, it was back to letting chemical companies supply their own security, container shipping uninspected, and the first responders? Who cared about them? It was bewildering. Their attitude seemed to be that fun’s fun, and we’ll give you orange alerts but forget about things that would actually cost a corporation money. Were they that stupid.
Ultimately, yes. Their ownership of the media was enough to win the 2004 elections, yes. And I think they felt that that was all they needed. And it wasn’t.
One of my paranoid friends, who was constantly going on about martial law and the cancellation of elections, gradually stopped doing so, mainly because the Republicans were treating the military so shabbily. Any banana republic dictator would have shaken his head in disgust–but Bush and Cheney were not warriors, but war profiteers.
Al the theories about the republicans being the ‘daddy party’ are off target when it comes to the current party. They aren’t Daddy–they’re Mommy’s shiftless boyfriend who lifts the kids’ lunch money. The 8-year Republican Hegemony turned out not to be a spectacle of militarization of the US, though they did destroy the civil rights structure of our country. But what they did with it was not totalitarian state with a soldier on every corner, but a colossal flim-flam that looted the nation.
If there’s one thing the American people don’t feel right now, it’s safe. And the polls show that they know who to blame–and it ain’t Barack Obama.

My father was a staunch conservative all his life. We used to have political discussions and never agreed on anything. He was about as far right as someone could be politically and I was about as far left. He once told me that he predicted that once, before I die, I will vote for a Republican.
Well, guess what. He voted for Clinton twice! He died before Bush was elected but I doubt he would have voted for him. I tried to talk to him about his conversion but his response was “I don’t want to talk about it”. If the Republican party could drive out someone as conservative as my father was, that’s saying something.

Actually, bias-motivation can be proved. In a court of law (as well as everywhere else), “proof” is subjective. All it takes to prove something in court is to convince a jury of 12 people that something is true. Murder is proved when the jury is convinced it was murder. Hate-based motive is proved the same way. And when a murder victim is hanging from a rope tied to a tree branch with the N-word carved into his body, it’s not that tough to convince a jury that racial hatred was a motivation. Or when somebody’s home is spray-painted with the word “fagg0t”.
And no — I’m not a supporter of the death penalty except in extreme cases where imprisoning somebody without possibility of parole fails to remove the threat to society that person represents. There are a number of reasons for my position on this — 1) capital punishment does absolutely nothing to deter capital crime (if it did, Texas would have the lowest murder rate in the country), 2) capital punishment is costlier to taxpayers than imprisonment for life, 3) capital punishment tends to make martyrs of perpetrators (candlelight vigil, anyone?) and focus more attention on them than on their victims, and 4) loss of freedom for life is IMO a worse punishment than loss of life.

– I’d give a harsher punishment for a hate crime. Although murder for any reason is a very serious crime and merits a very serious punishment.

– No, it’s not really moot just because I’m not a fan of capital punishment. If the sentence given for a crime is the maximum possible sentence for any crime (whether it’s life without parole or death), you’re right that adding additional punishment for hate motivation would be impossible. Where a harsher sentence would come into play would be if the basic crime results in a lesser sentence — such as life WITH the possibility of parole, or a long non-life sentence (20 years or more, for example). But even if I supported the death penalty, adding the hate crime designation still wouldn’t add any severity to the sentence if the penalty without it is death.

Who said you can’t get a jury in a federal court. Here’s a clue, there are federal courts all over the country you don’t have to go to Washington or anything. If a local prosecutor messes up or the police do as in the OJ Simpson case you mentioned, if there’s clear evidence that the crime was motivated by religious, sexual or racial hatred it gives another court a chance to provide justice without double jeopardy. Why do you and Boehner want criminals to go free?

I would sentence someone to a harsher punishment if the crime was motivated by the victim’s race, ethnicity, gender, orientation, religion, or other factors.
A crime motivated by money or personal grudge only targets the individual victim. A crime motivated by hate for a group targets the broader group, and is thus a more serious and detrimental crime to society as a whole. It therefore makes logical sense to punish these crimes more harshly.
It’s not a witch trial at all. Quite the opposite, in fact, considering that the Salem witch trials were quite a good example of hate crimes motivated by gender and religion.

I feel this is especially important for hate crimes that would otherwise fit into the legal category of a less serious offense. Without the definition of a hate crime, burning a cross in a black family’s yard, or painting nazi graffiti on a jewish home, would just be criminal trespass, or vandalism, or some such when both the act and it’s effect on the victim clearly amount to more.
