On Wednesday, Senate Judiciary Committee Chairman Patrick Leahy (D-VT) sent a letter to Judge Jay Bybee inviting him to testify about his “views” about torture and his “role” in drafting the torture memos. In the letter, Leahy wrote, “I look forward to your cooperation and your testimony.” But the Los Angeles Times reports today that Bybee has “declined to respond” to Leahy’s letter. Bybee’s law clerks initially gave contradictory messages about how the judge would respond, but law clerk Keith Woffinden tried to clean up the confusion, telling the paper, “my impression is that there won’t be any further statements” beyond Bybee’s comments to the New York Times.

He talks about his torture memo as a mistake. Like a traffic ticket, or a faux paux during dinner. Like, gosh how did I know Bush would take it seriously and really torture someone.
Bush, a man who made fun of someone who was going to be put to death when he was the governor of Texas. “Don’t kill me, don’t kill me.” When I saw that interview it made me sick. That’s when I knew what kind of man Bush was. And this memo is how we all know what kind of man Bybee is. If he didn’t have to see it, or do it, then he was just a simple error and not real.

I think this Congress needs to issue a letter of apology to everybody brought to Capitol Hill for the Army/McCarthy trials. Perhaps if they’d realized back then that you don’t actually have to respond to subpoenas, a lot of lives might not have been utterly ruined.
