Rove Hypocritically Argues Right Should Oppose Potential Obama Court Pick Just Because She’s Liberal

This morning on Fox News, former Bush political adviser Karl Rove criticized Judge Sonia Sotomayor, a potential nominee for the upcoming Supreme Court vacancy. “She could be even more liberal than Souter was,” Rove said. “She has a reputation on the Court of Appeals that she’s on for being very liberal.” He then argued that Sotomayor’s views would be cause for conservatives to oppose her, despite her qualifications for the position:

On the other hand, she’s also likely to draw opposition from conservatives because her opinions on the Circuit Court of Appeals have been very liberal and very expansive. In fact, this is going to be one the big dividing lines. President Obama…said he wanted a judge who would uphold the Constitution, but also a judge would be empathetic. These two things are in conflict.

Watch it:

Needless to say, Rove is being hypocritical. When he was shepherding Bush’s Supreme Court nominees through the process, he explicitly made the argument the President was owed deference to choose a qualified nominee and opposition party had a “responsibility to back” that pick. Here’s what Rove told the Washington Post in July 2005:

Karl Rove, President Bush’s chief political architect, said precedents from the most recent Supreme Court vacancies suggest that opposition-party senators have a responsibility to back a president’s choice if they believe a nominee is qualified, even if they disagree with the person’s views. He also maintained that a strongly held ideological stance would not amount to “extraordinary circumstances” justifying a Democratic filibuster under a recent bipartisan Senate deal. [...]

Rove made clear that Bush will consult with senators in both parties, but that he has no interest in any kind of grand bargain between the White House and Congress in which legislators would give support in exchange for advance input on the president’s choice. Some Democratic groups have suggested that Bush seek an early consensus. Rove, however, cited his own weekend reading of the Federalist Papers to argue that the framers of the Constitution envisioned no such role for Congress, leaving the president alone to make nominations.

In the interview with Fox News this morning, Rove lauded the Bush White House’s preparedness for filling the Supreme Court vacancies when they arose and suggested the Obama White House is unprepared for making a nomination. It seems Rove has quickly forgotten his “active role” in the disastrous nomination of Harriet Miers, who came under relentless assault from Bush’s conservative base.

Update Last night, MSNBC's Ed Schultz argued, "I think it's time to say it. This is no time for bi-partisanship, we need a liberal on the Supreme Court. ... Will President Obama put a liberal lion on the Supreme Court, and I mean no shame, no apologies. Or will he cave in when the Party of No starts crying about a consensus choice? May I remind Americans tonight, we had a consensus back in November, it was called an election. They lost. Elections have consequences. This is our time to shape the future of this country."
Update The National Review's Matthew Franck urges GOP senators not to filibuster Obama's nominee. "Supreme Court nominations deserve an up-or-down vote," he writes. But he also urges "Republicans to throw some sand in the gears" to slow down the confirmation process.

This man will say anything to make a point, and it makes no difference at all if what he says is true or not.

    The critics started as soon as the Souter rumor began – speculation on whow Obama would select and why that person would be wrong. They have shown that they will filibuster, object, and create chaos around any nominee; character assassination is not beneath them – even before they even know who it is!

    For today Rove has selected the first one to be vilified – expect radio and TV campaigns, frothing-at-the-mouth repugs expressing indignation, and Fox news going ape-sh!t.

    Rove speaks for no one – he has nothing but a dubious reputation at best. But he’s one of the few spokesmen for the rethugs — so desperate and pathetic are they – yet they cling to the big mouths of the past, the ones who brought them this enormous defeat at the poles and defection of millions from the electorate – because they don’t know how to change, nor do they want to acknowledge their errors.
    These are not the people to lead America – not at any time.

He already said he plans to replace Souter with someone like Souter, and Souter voted like a moderate Liberal (which to me means someone in the middle of the Liberal spectrum – not someone who is on the left on the Moderate spectrum, which would be a liberal Moderate).     A)He’s implying that liberalism conflicts with the Constitution–i.e unconstitutional.

    B)He’s implying that empathy is incompatible with the Constitution.

    Either implication is utter BS.

    The US Constitution established principles and a structure of government and justice that were in total significantly and historically empathetic to the common man, as was the Bill of Rights.

    The subtext of Rove’s words is that liberal/progressive attitudes are a threat to the foundations of this country, and it’s all part of a theme that conservatives have chosen to emphasize now more than ever (think of the “list of socalists”, Bachmann’s call for “investigations” etc.).

    It doesn’t matter whether the conservatives actually believe it or not. If they believe it, there’s no changing their beleifs. If they are just pandering to a base that worked for them in the past then they have sufficient allies and enablers in the media to continue “catapulting the propaganda” and to maintain what is really a psy-ops campaign.

    The Republi-Cons policy is now wholly about undermining the present government in any way they can. This is asymmetric political ‘warfare’.

    After re-reading this several times, it appears that he wants to show republicans are still relevant to the confirmation process, by re-inforcing the “party of No” label with real-world examples. He doesn’t say a qualified Obama nominee deserves to be confirmed, just that they shouldn’t give in too quickly. That is a tacit acknowledgement of political powerlessness. To “throw sand in the gears” could refer to political sausage-making, but in the Republic of No, all democratic desires are doa, so they can’t obstruct the process by offering to vote for democratic proposals in exchange for democratic nay votes on judicial nominees.

    I will be interested to watch this SCOTUS selection process unfold. I expect that Obama will appoint someone with a record that is (1) progressive and (2)collaborative (that is, more like Roberts than Scalia in terms of temperment).

    Whoever it is, I am confident that it will be an excellent choice. The President, after all, is a former constitutional law professor and a deep thinker. It won’t be another Harriet Miers that’s for sure.

    Rove can complain all he wants. He doesn’t have a vote. The more that Rove, Limpballs and Little Seanie Vanity remain the loudest voices of the republican party, the better. All they are doing is sealing the republicans’ future as a minority party.

    We discussed the no votes on Durbin’s bill the day of the vote. Where were you? It’s safe to say that nobody here voted for any of those blue dog (faux) Democrats.     This reflects one of the problems with having a two-and-only-two party system of government. Too many people think that the answers lie with one party or the other. Often times, both parties are wrong about an issue.

    I also believe that it is a mistake for Americans to only view things along Liberal-Conservative lines. I believe that most Americans are more Libertarian than Authoritarian, and it is the Authoritarian wing of the Republican Party that has caused the most damage to our nation. Unfortunately for us, the Democrats also have their Authoritarian wing, and they too often join the Authoritarian Republicans in bringing this country down.

    We need to have multiple parties in Congress, enough so that no one party controls either House. Make it harder to pass any kind of legislation strictly along party lines. As we can see (thanks to the Bluedog Democrats), it doesn’t seem to matter to which party one belongs. It matters not only how Liberal or Conservative one is, but also how Libertarian or Authoritarian one is.

    Not every issue needs to be boiled down to this or that, one or the other, black or white, in order to justify having two and only two parties. That system is not serving the American people well.

    Personally I feel the Supreme Court should remain a moderate court, like it’s current makeup. Maybe a little more liberal of a swing justice. But I feel that having a moderate court allows a more mainstream look at how the Constitution applies to current state of the country.

    Om C-SPAN yesterday I had the opportunity to watch a moot court competition from George Washington Law School. Justice Sotomayor was a member of the tribunal. So was chief Roberts and a colleague of Judge Sotomayor from the Second Circuit, Justice Guido Calabresi.

    Both Justices Sotomayor and Calabresi were very impressive. I’d be happy to see either of them elevated to the Supreme Court. Justice Sotomayor may have the inside track since she’s a woman and is younger by 22 years but either would be a terrific addition to the Court.

So, if you can prove that Pelosi (and Reid) knew about the details of the torture techniques being used on prisoners, I want to see it.

    And you know what? If they are guilty, then they should go to jail, too. Hell, we’re already pissed off at them for not impeaching bush when they won in 2006. You’ll find few people here who want to see those two remain in their leadership positions.

Opining that torture didn’t take place under Clinton’s program…but it did under Bush’s is just about the dumbest thing I’ve ever heard. Do a sanity check on that one and get back to me.

    As for Pelosi…she and several members of Congress were toured around a detention facility and explained what interrogation techniques were being applied…to which Pelosi asked “are you sure we’re being tough enough?”

    Also, as a “perk” of her position…she received numerous briefings on the subject of enhanced interrogation techniques. (also included in the article).

    I honestly wonder what it’s like to blindly follow without questioning…because it’s obvious to me that’s what you’ve been doing. Not wanting to do your own research on the topic you’re defending…instead relying on your elected officials to tell you what’s “right” and what’s “wrong”.

    So sad…

    What is so wrong about wanting a Supreme court justice to follow the law of the Constitution? I could care less if a person is liberal or conservative, what is important they make decisions based on the constitution and not use the position to legislate.

    It is a never ending war that is based on FEDERAL power. If Pro life wins . .an underground market is created and the war goes on till again Pro choice wins and funnels endless federal dollars into the assembly line programs to “control population”, the TRUE core reason it is such a hot issue. Progressive environmental concerns about over population.

    What if we decide to take the position that the federal government has no place at all in the choice. Zero. Zilch. Nada. Nothing. No position at all. OK . .Pro life does not get a law that would not have stopped the practice anyway. What they DO get is a rock solid foundation to stop any and all funding of any kind going to family planing. The FED will not be involved in any way what so ever with a womans choices OR responsibility. That will be between her and her god. Do that, refund Family planing, and you close the assembly line. THAT will do more to reduce the NUMBER of abortions than anything we have done to date. Take the funding.

    Actually, it was a matter of me asking you to back up something you said. I also said I would re-evaluate any opinions I had based on the new information. So I will repeat what I said above:

    And you know what? If they are guilty, then they should go to jail, too. Hell, we’re already pissed off at them for not impeaching bush when they won in 2006. You’ll find few people here who want to see those two remain in their leadership positions.

    If she is guilty of conspiracy to commit a war crime, then she should be prosecuted along with Bush and Cheney and Rumsfeld and Rice and Bybee and Yoo and Gonzales and…
