California Supreme Court Upholds Prop. 8 Gay Marriage Ban, But Allows Current Gay Marriages To Stand

marriageIn a six-to-one decision, the California Supreme Court upheld the state’s ban on gay marriage, the Proposition 8 referendum voters approved last November. The court ruled that Prop. 8 “constitutes a permissible constitutional amendment (rather than an impermissible constitutional revision).” However, the court declared that the 18,000 same-sex marriages conducted last summer, prior to the passage of the proposition, would remain legal and recognized.

Importantly, though the court upheld the ban on the use of the term “marriage” by same-sex couples, it reaffirmed the fundamental constitutional rights of gay couples (p. 7):

[T]he measure carves out a narrow and limited exception to these state constitutional rights, reserving the official designation of the term “marriage” for the union of opposite-sex couples as a matter of state constitutional law, but leaving undisturbed all of the other extremely significant substantive aspects of a same-sex couple’s state constitutional right to establish an officially recognized and protected family relationship and the guarantee of equal protection of the laws.

Indeed, the bulk of the court’s May 2008 ruling that originally legalized gay marriage — which emphasized “respect and dignity” — stands. The LA Times noted that gay people in California will still enjoy greater rights than gay Americans elsewhere:

Sexual orientation will continue to receive the strongest constitutional protection possible when California courts consider cases of alleged discrimination. The California Supreme Court is the only state high court in the nation to have elevated sexual orientation to the status of race and gender in weighing discrimination claims.

The LA Times pointed out that the case for overturning Prop 8 was always a “long shot,” noting that the gay rights’ lawyers “had no solid legal precedent on their side, and some of the court’s earlier holdings on constitutional revisions mildly undercut their arguments.”

The court’s majority concluded “that if there is to be a change to the state constitutional rule embodied in that measure, it must ‘find its expression at the ballot box.’” The ruling virtually ensures such a fight, and it is already getting started

Update Noting that the number of states allowing gay marriage has more than doubled since November, the Center for American Progress's Winnie Stachelberg said, "The California Supreme Court’s decision to uphold Proposition 8 is disappointing, but it should not distract us from the progress that is being made toward marriage equality."
Update In a dissenting opinion, Justice Carlos Moreno wrote that the decision "weakens the status of our state Constitution as a bulwark of fundamental rights for minorities protected from the will of the majority." Moreno also rejected the majority's claim that banning full marriage rights was a "narrow" civil rights restriction for gay couples. Regardless how narrow the restriction, he argued, the ruling violates these couples' right to equal protection:
Denying the designation of marriage to same-sex couples cannot fairly be described as a “narrow” or “limited” exception to the requirement of equal protection; the passionate public debate over whether same-sex couples should be allowed to marry, even in a state that offers largely equivalent substantive rights through the alternative of domestic partnership, belies such a description. [...]

But even a narrow and limited exception to the promise of full equality strikes at the core of, and thus fundamentally alters, the guarantee of equal treatment that has pervaded the California Constitution since 1849. Promising equal treatment to some is fundamentally different from promising equal treatment to all. Promising treatment that is almost equal is fundamentally different from ensuring truly equal treatment. Granting a disfavored minority only some of the rights enjoyed by the majority is fundamentally different from recognizing, as a constitutional imperative, that they must be granted all of those rights. (p. 155-7)

    This is disgusting. There’s a little bit of a silver lining, and it will definitely galvanize the movement for equality. We’ll have to wait a little longer for generational shift, a movement that will more effectively reach out to all communities in California. What’s important since Prop. 8 came down and the ensuing judicial debate is that the dialogue is staying open, we are discussing this with our families and communities, and I don’t think we’ll be disappointed come 2010 when we go back to the booths!

    He enlisted in 67. Got blown up driving a deuce and a half over a land mine. He came away from fairly unscathed. Was there for Tet, and made it home in one peace.physically .
    He’s been a Democrat his entire life. And still is.
    My nephew, Jesse, has done 2 tours in Iraq. Got blown up by an IED. He got peppered with shrapnel. But he survived intact. That was his first tour. He went back and did another tour.
    After that, he found himself on a mountain top in Afghanistan.
    Drawing fire so the others could find the shooters.
    He made it home in one piece. He was all about re-uping.
    I asked him to think it over before he signed on the line.
    They offered him 32k to reup with a 8k signing bonus.
    I said don’t make any hasty decisions and give it sometime so he could think about it. He didn’t do it. He said no thanks. He’s still in one piece,but he’s got the scars to show what happened to him. We’re keeping a close eye on him now. He’s got us. We’ll help him when he needs it.

    This is a good day in American History. The judges bowed to the law instead of political pressure. Prop 8. or some form thereof will probably pass at sometime. And they’re all missing something.

    Of course, we won’t agree on what is the center. I suspect you would be unable to even recognize something as slanting to the right. But if we were to accept some ground rules of objectivity from which to work, we could eventually at least recognize each other’s positions. Right now, your position looks as alien to me as mine probably does to you.

    Which is odd, since they claim to study the bible a lot.

    Also note that it is explicitly stated that all monotheists must murder bi/homosexuals on sight. The fact that they fail to do so means they’re sinning to the same degree as teh gays are. No two ways about it, bible-thumpers: open war or nothing. Ditto any child who disrespects his parents – the law isn’t “don’t disrespect your parents,” it’s “put to death anybody who does.” Therefore, all bratty kids must be murdered immediately.

    As an interesting side note, that Leviticus citation completely says nothing whatsoever about lesbians. Neither is lesbianism mentioned anywhere else. They get a free pass, biblically speaking. You’d think that the bible-thumpers would take this into account, if they want to be consistent: it’s OK with God for girls to lick clam.

    If you officially make this a “Christian nation,” chances are you won’t get the specific flavor of Christianity you were hoping for, which means that everybody who has divorced and remarried will find themselves in the exact same legal status as teh gays. It’s worth noting in this regard that all of those pundits who do the “Christian nation” thing point at the Pilgrims, who escaped to America from… a Christian nation. It’s not that they were trying to get away from heathenism, it’s just that their brand of Christianity was unpopular there, which is why they were so for the separation of Church and State. When you get Church in your State, you also get State in your Church. Just ask any Iranian.

    My general point regarding legislating versions of the bible is – look, most of the anti-gay people are Protestants. Most of them (at least most of their politicians) are in second, third marriages, etc. Marriage has historically been “defined” as a permanent bond between one man and one woman. Mind you, the word “permanent” is easily forgotten by Protestants since Henry VIII redefined marriage to suit his own lifestyle choice. The fact is, Catholics are still the most populous Christian group in America. Which means that if we vote to make it a “Christian Nation,” then all of those people expecting the state to condone their lifestyle choice of extramarital adultury (aka. getting divorced and remarried) will lose their legal rights.

    I’m looking at you, Newt… McCain… Giuliani… Hell, just about all of ‘em.

    If you’re a “bible fearing” Protestant who wants America to legislate “Christian values” then you just might want to think twice about where that leads.

    Wanting marriage to remain the union between a man and a woman isn’t the same as wanting to legislate Christian values. Like President Obama has said, a society can choose to recognize the common family structure while still allowing unions for same sex couples which give them the same rights.

    Get out of my water fountain, second-class citizen. If the rights are exactly the same, then there’s no reason the name shouldn’t be the same. Every where in history where the names have been different, the actual rights have been different too. There is a huge amount of parallel case law on my side on exactly this point.

    I would be willing to get rid of all legal “marriage” and replace them all with “civil unions” whether gay or straight. So long as everybody gets the same thing (no special terms for you), I’m happy.

    Bizarrely, no wingnuts have considered that option – get rid of all legal “marriage” and replace all legal two-person-bonds with “civil unions.” Consider the benefits to the religious right: presently, in order to determine who can perform marriages, states have to keep rolls of legal churches and reverends, many of which include Wiccans and Satanists. Thus technically, the state endorses Witchcraft and Satanism. Under a civil union system, that “endorsement” would cease to exist. It’s pretty much the same situation as with the state endorsing gay marriages. And yet, the bible-thumpers seem to have no problem with legal Satanist reverends, while they totally draw the line at two dudes getting hitched. If I was a bible thumper, I’d draw the line at least the other way around.

    A “civil unions for all” system would completely fix all of these problems.

    But I’m not propogating it here. I’m just pointing out how interesting it is that the religious right completely ignores this option. Teh “Christians” don’t really give a crap about the fact that the government already blesses Satanist ministers; they just want to make sure it doesn’t bless dudes porking other dudes in the butt.

    Of course you are “propogating” it here. I’m really sorry that you are upset by Christian acceptance of freedom of religion. Most Christians are uninterested in what people are doing in the privacy of their bedrooms. It’s the attempt to draw attention to those actions by unnecessarily changing a basic societal institution to which some object. If civil unions don’t afford all the legal rights of marriage, you have an argument. Otherwise, you are just trying to force your views on others. ;)

    upright left, it’s obvious that PROP 8 was supported, voted on, and final ruled in favor of the people. If you oppose Prop 8, you’ll get your chance to vote again in 2010 on this. And it will probably get voted on to favor the hetero masses. It’s interesting to see all the holes getting punched, no pun intended, of each sides position. Let’s not forget how Gavin Newsome energized the Prop 8 movement with “wether you like it or not, gay marriage is coming”. Thankyou Gavin, can you run your yap one more time for another golden blurb we can use for our campaign? Nobody said life was fair!! And for all this talk about religion, every single one you does have a religion wether it’s arrogance, intellectualism, bookwormism, hedonism, narcicism, etc. Why in the hell would I want to follow you and all your bull$hit when I can simply turn to the bible, and find the best standard to live by?
