Hannity: We Should Take Note Of Only The Bad Things Anonymous Lawyers Have Said About Sotomayor

Last night, Fox’s Sean Hannity continued his attack against Supreme Court nominee Sonia Sotomayor using cherry-picked quotes about her from a profile of Sotomayor in the Almanac of the Federal Judiciary, which relies on anonymous quotes from lawyers who have tried cases in her court room. Hannity used the quotes to characterize Sotomayor as “agressive,” “out-of-control,” and, “nasty”:

HANNITY: [W]hat do the lawyers who have appeared in her courtroom think of her judicial temperament? Well, not much. The Almanac of the Federal Judiciary solicits commentary from practicing attorneys about our federal judges. Now here’s what some lawyers who have argued before Judge Sotomayor had to say about her. Quote, She is a terror on the bench. She is overly aggressive, not very judicial. She behaves in an out-of-control manner. She is nasty to lawyers.

Hannity then turned to Jay Sekulow from Pat Robertson’s American Center for Law and Justice and Andrew McCarthy of the National Review to confirm his extremely distorted view of Sotomayor. Watch it:

Had Hannity wanted to present a “fair and balanced” view of Sotomayor’s reputation, he would have noted that lawyers quoted in the edition of the Almanac of the Federal Judiciary from which he drew his statements also had many positive things to say about Sotomayor. Indeed, they said she was “very smart,” “very intelligent,” “an exceptional judge overall,” and that “she has a very good commonsense approach to the law.”

Additionally, as Rob Kar at PrawfsBlawg found, the 2000 edition of the Almanac painted, on balance, a much more positive image of Sotomayor than the more recent edition that Hannity quoted. Indeed, the 2000 edition lacks any description of her being a “terror” or “out-of-control.” Instead, she is described as “not rude in any way, but she’s exacting,” “professional,” and “all business”:

Lawyer’s found Sotomayor to be demanding. “I think she’s fine.” “She can be tough. She’s not rude in any way, but she’s exacting.” “She’s all business.” “I’ve never had any problem with her, but I know some lawyer’s don’t care for her temperament.” “She can be tough as nails, but, in truth, I think some lawyers give her a hard time or are threatened by her. She’s very accomplished and clearly smart, and, in truth, I think they’re intimidated. She has always been decent enough to me.” “She’s professional. She’s not quite as friendly or as approachable as some of the other circuit court judges are. She’s a little more stern.” “She’s very smart and well-prepared, and she expects lawyers to rise to her level. She has very little tolerance for lawyers who can’t match her intellectually.”

    If any judge got 100% positive comments from lawyers presenting to him or her, then that judge would have to be corrupt. A good judge will make “enemies” of some lawyers. The percentage for Sotomayor seems about right to say she has been an outstanding judge.

    I suspect a number of these negative comments are coming from lawyers who lost their case in front of her. Unfortunately, because these are anonymous quotes, we have no way of finding that out.

    Trying to take all the comments together, it appears that Sotomayor is compentent, intelligent, does her homework, and expects others to do the same. When I hear a comment like “she is nasty to lawyers”, that tells me she probably has a low b*llsh!t threshold and probably doesn’t put up with cheap lawyer tricks.

    There are also a number of people who love to hang the “b!tch” label on any woman who isn’t shy, demure, deferential to men, and “knows her place”. This mindset has dogged Hillary Clinton for about 17 years now. But that hasn’t stopped her. And it won’t stop Sonio Sotomayor, either.

    So we have varying accounts on how lawyers view Ms. Sotomayor’s deciding ability and judgments. Can anyone confirm what the most up-to-date copy of this evaluation provides?

    If Hannity’s source is less recent than other sources that provide a better perception of Ms. Sotomayor, it appears to me that she may have changed her bench demeanor if she was allowed to view these evaluations. I know that my demeanor changes when I view my work evaluations. That’s the point of these things–to improve a person’s ability to work and uplift their level.

    On a semi-serious note, if any of you have been on jury duty lately, this all just part of being a lawyer and a judge. Assuming public office means you get to brave the public scrutinizing you. So who really cares what Bill or the press say about Sonia. The numbers are in her favor and she’s going to get in. The Supreme court already ruled in favor of the 2nd amendment thank God, so all we really have to worry about is wether the cops and joe citizen are going to be able to get their ammo. This could be a good thing though as alot of liberals will be defenseless in this new world order and wait their turn for good police service.     The complaint resulted from a dinner conversation between Sotomayor and a Shaw Pittman partner, Martin Krall. According to news reports at the time, Krall asked her whether she would have been admitted to law school if she were not Puerto Rican and whether law firms did a disservice by hiring minority students with inferior credentials and then firing them a few years later.

    Notice that nothing anybody has said about her thus far has been a substantive criticism of anything in her relevant case history. If the questions you want to ask are on-topic and respectful, then you’re perfectly free to ask them. However, when you keep making sexist and racist implications, we’re going to keep calling you a sexist and a racist.

    The thing about the Supreme Court appointment is that it’s the top rung. It’s sometimes hard to say what happens to an ambitious person who actually gets the prize they’ve wanted. All of a sudden they don’t need to make deals, don’t need to maneuver–they’re there.
    Grover Cleveland was a ruthless and ambitious politician, wheeling and dealing–but once he became president (The first Democratic President since the Civil War) he turned out to be an excellent President, a tireless worker. (His major accomplishment–instituting the Civil Service–should not be misunderestimated. It changed the face of American politics fundamentally, and for the better.) Earl Warren was an Eisenhower appointee and a supposed reliable conservative.
    The thing about a Justice’s status is that they are not absolutely powerful, but they are absolutely free. (as free as anyone can be in human society. It’s a peculiar state.
    It’s a powerful inducement to grow. Warren, Burger, Rehnquist–they changed significantly while in the Chief Justice’s seat. Rehnquist remained a conservative until the day he died–but he grew less predictable as the freedom gripped him.
    THe dismal part for me is watching Scalia and Thomas. Scalia is just an ss hole: full of himself, not just convinced he’s right, but convinced that he’s a genius and a hero. Freedom’s wasted on him. And Thomas is just out of his depth. He stuck like a scared child to Scalia for years, still just sits there stuck to the ideology becausehe’s scared to let go.

    Roberts and Alito? Remains to be seen. Roberts just seems to be a ttrue believer, interested less in the trust and the challenge of theCourt than whathe can do for the movement. Alito seems to be a less-polished version of the ame thing.

    But that may change. One morning Roberts might wake up and realize what really has been given to him–and that he can do what he thinks is just, not what the Federalist Society wants.
    Or maybe not.

    Sotomayor seems to be a jurist that the Court would be good for. Open to growth.

    Both of Sotomayor’s parents were born in Puerto Rico, and Puerto Ricans have had naturalized U.S. citizenship since the Jones-Shafroth Act of 1917. So unless they were born before 1917 and gained citizenship some other way, they were naturalized.
