Wendy Long Takes A Swing At Sotomayor…And Misses

wendy Wendy Long, Chief Counsel for the right-wing Judicial Confirmation Network, sent a letter to the Senate Judiciary Committee today accusing Judge Sotomayor of misrepresenting her record on the death penalty:

Dear Senators:

A first read through Judge Sonia Sotomayor’s U.S. Senate questionnaire for her Supreme Court nomination raises more questions than it answers. It is already clear that she has omitted controversial material from her past in which she asserts that “[c]apital punishment is associated with evident racism in our society” and advocates public opposition to restoring the death penalty in New York state.

The “controversial material from her past” that Long refers to is an 1981 internal memorandum, co-signed by Sotomayor, which was prepared by a Puerto Rican Legal Defense and Education Fund task force for that organization’s board. That memo does indeed include the statement that “[c]apital punishment is associated with evident racism in our society.”

Although the internal memorandum is not specifically disclosed in Sotomayor’s questionnaire, Sotomayor did disclose, and provide senators with multiple copies of a 1981 letter she drafted on behalf of the Puerto Rican Legal Defense and Education Fund. That letter states that “capital punishment represents ongoing racism in our society,” a virtually identical statement to the one Long accuses Sotomayor of hiding. Sotomayor’s 1981 letter can be viewed at the Senate Judicary Committee’s website.

Sotomayor kept no secrets from the Senate about how she felt about the death penalty in 1981, and Long shouldn’t waste the Senate’s time by grasping at straws.

    The statistics are clear on this. Unless (like some wingnuts we could name) you believe that non-white people are naturally vicious and evil, so many more non-whites are executed than whites that the only possible explanation is that capital sentence decisions are being skewed by racism.

    If we can have justices that are pro death penalty (even thought they say they are “pro life”) and justices who are anti-choice, then why can’t we have a justice who opposes the death penalty and pro choice?

    The right is doing itself a lot or harm with the continued smears on Judge Sonia Sotomayor. They really don’t know when to stop digging that hole that is collapsing on top of them.

    As of May, 2007, the Innocence Project has won the release of 201 prisoners based on DNA evidence. Of that 201, 15 were on death row.

    Sotomyor was required to “[s]upply four (4) copies of any reports, memoranda, or policy statements you prepared or contributed to the preparation of on behalf of any bar association, committee, conference, or organization of which you were or are a member or in which you have participated.” Disclosing a view is not enough. She must supply the actual memoranda so that the Senators or their staff can read and decide for themselves.

    I’ve actually studied Judge Sotomayor quite a bit and, I haven’t seen anything to suggest she’s passionate and enthusiastic about her work. Her writings reveal a depth of experience, a profound insight, and even good humor.

    Her record in cases dealing with discrimination displays nothing but even-handedness. She decided in agreement with her colleagues around 90% of the time and shows a strong propensity to follow precedent. And, her court tended to rule against claims of discrimination in about 80% of cases.

    And, My point, CFP, is that nominees provided information under the assumption that each batch will result in requests for more info and missing documentation. Ms. Long’s implication of wrongdoing is ridiculous.

    I’m glad she’s against capital punishment. Everyone should be. Yes, I know that it is not unconstitutional, but that doesn’t mean it’s the right thing to do. One cannot logically claim to oppose abortion on the grounds of being “pro-life” but still support the use of capital punishment. Yet many Republicans in Congress do call themselves “pro-life” because they oppose abortion, but they still support capital punishment. Capital punishment is wrong.

    If your opposition to abortion is based on the idea that “all life is sacred”, then who are you to decide that another person should die? You would have no more right to say a prisoner should be put to death than you claim a woman has to terminate a pregnancy. “All life” means “all life”. And if you are concerned about the “innocent” people killed by abortion (they aren’t “people”, they are often just a collection of cells), then you should also be concerned about the innocent people killed by capital punishment.

    If your support of capital punishment is based on how much it costs to house a prisoner, then you would spend a lot less if you sentence the person to life in prison without possibility of parole. Every prisoner sentenced to death gets automatic appeals that taxpayers pay for, and the cost to us can easily reach the millions. Odds are that they won’t live long enough in prison to spend more than that (which has to be spent anyway while their appeals go through the process.)

    If your thinking is that capital punishment is more of a “punishment” than death, I would re-think that one, too. Convicts do not like the prospect of spending decades in prison, especially if they know they’re guilty. They would eventually reach a point where they would welcome death. Keeping them alive would serve as even greater punishment; executing them would end their misery. Is that what you want? Look at Timothy McVeigh’s case. He was sentenced to death and still had some appeals to go through before his sentence was carried out. But he did not want to be in prison all that time just to lose in the end anyway. So he waived all his appeals and asked President George W. Bush for clemency. After Bush stopped laughing, he said, “No” and McVeigh’s sentence was carried out.

    In the end, there is no moral justification for the use of capital punishment.

    The problem then is that any thread jay comes into becomes about jay and nothing else. He only touches on the topic until people start talking to/about him directly, and then he manically does back-and-forth with extremely short insulting posts until the topic is completely forgotten. This alone has driven comment counts into the 600 or even 700 range on multiple occasions.

    I think the appropriate thing to do is – if they’re commenting on topic (no matter how wrong they are) then they’re available for response. If they’re not commenting on the topic, but it’s still a topical political matter, then maybe. But if they aren’t talking about politics at all, just pretend they’re not there.

    As long as they’re on-topic, I really don’t care what their motivations are. Trolls exist to help us clarify our positions, inciting us to do research and construct logical responses to their mouth-breathing, knuckle-dragging “arguments.”

    I know a lot more now about why I believe what I believe than before I came here, and I have many on-topic trolls to thank for it.
