Cantor Falsely Claims There Are No ‘Judicial Precedents’ For The Prosecution Of Suspected Terrorists On U.S. Soil

Today, Guantanamo detainee Ahmed Ghailani was transferred to New York to face trial for the bombing of the U.S. embassies in Tanzania and Kenya. Discussing his case last month, President Obama said that, “after over a decade, it is time to finally see that justice is served, and that is what we intend to do.” Attorney General Eric Holder has noted that the Justice Department “has a long history of securely detaining and successfully prosecuting terror suspects through the criminal justice system.”

The right wing, however, has seized the opportunity to launch baseless, fearmongering attacks, with House Minority Leader John Boehner (R-OH) leading the way:

This is the first step in the Democrats’ plan to import terrorists into America. Without a plan to close the prison at Guantanamo Bay, the Administration has made the decision to begin transferring these terrorists into the United States…Do they plan to give them the same legal rights as the American people?

Similarly, on MSNBC today, Rep. Eric Cantor (R-VA) said that the transfer was “counterintuitive” because there are “no judicial precedents for the conviction of someone like this”:

CANTOR: Well, you know, Norah, it’s just counterintuitive. Why in the world would somebody be so focused on the rights of a terrorist instead of keeping Americans safe? There are so many unanswered questions about bringing these detainees on to U.S. soil. We have no judicial precedents for the conviction of someone like this. It is just wrong for us to be bringing these detainees here given the current situation and the unanswered questions. We ought to be putting the safety of American citizens first.

However, the Justice Department today put out a lengthy fact sheet listing nine of major international and domestic terrorism cases that just the U.S. Attorney’s Office for the Southern District of New York alone has successfully prosecuted since the 1990s. The release also responded to right-wing criticisms that U.S. prisons can’t handle terrorists:

There are currently 216 inmates in Bureau of Prisons (BOP) custody who have a history of/or nexus to international terrorism. Sixty seven of these individuals were extradited to the United States for prosecution, while 149 were not extradited. Seventy two of these individuals are U.S. citizens (45 of them born in the United States, 27 of them naturalized). The “Supermax” facility in Florence, Colo. (ADX Florence), which is BOP’s most secure facility, houses 33 of these international terrorists. There has never been an escape from ADX Florence, and BOP has housed some of these international terrorists since the early 1990s.

In fact, NBC’s Pete Williams said that Ghailani’s transfer “makes sense, because other defendants in the embassy bombings were tried and convicted” in New York.

Update This morning, Sen. Russ Feingold (D-WI) led a hearing to discuss prolonged detention. The right wing's favorite lawyer, David Rivkin, warned that because of Obama's actions, soon there will be "hundreds of terrorists walking around this country." Watch it:

    do they not understand, besides, it seems, unalienable? It does actually say “all men”. Not “all Americans” or “all men on our side” or even “all men not trying to blow us up”. Just “all men”. It also says these rights come not from Congress, or Teh Eeevil Democrats or any such thing. They exist independent of such constructs.

    These bootlicking Republicans would have us believe that nobody has any inherent rights, save for what they and their masters might see fit to grant in their largess. Funny, but that strikes me as the reason we kicked the King out in the first place.

    Once we opened Gitmo and held people without charge for years and years, we lost our moral authority to protest anything that North Korea has done. At least they gave the women a trial, kangaroo court though it was. Until we clean up our act and start acting like something other than a bunch of thugs, we won’t be able to object to anything a foreign government does to our people. We certainly cannot complain if a foreign government detains and tortures our citizens, now can we?

    As a former democrat, now an independent who despises both parties although my hatred for the republicans is ten times the level of hatred for the democratic party, I want to know, where are all the new jobs President Obama promised?

    The only jobs being created at this point are construction jobs, what happens when the construction projects end? I’ve seen our stimulus money locally being used for coating certain highways with a fresh coat of asphalt. It didn’t need to be done and I’m sure the money could have been used on more important street or highway projects.

    I voted for President Obama because I trusted and believed in him and his words. The other option (McCain/Palin) was unacceptable to me. But I should have known better when senator Obama voted on the FISA bill.

    Since than he has said he will not go after Bush & Cheney for war crimes. We are still in Iraq. We are adding more troops in Afghanistan. Federal taxes on tobacco have been raised, how does that not affect those who make under $200,000.00 and happen to smoke or chew tobacco? All I see are a lot of broken promises and a lot of talk from the Obama administration as they continue the bail out that the Bush administration started.

    He had been held without charge in a hellhole for seven years.

    In 2005 he was down to 86 pounds because of a hunger strike.

    He entered Gitmo at 124lbs.

    Massive Human Rights violations aside, these right-wing pansies are afraid of a 124lb man.

    Actually, it shows how insufficient the effort was. Most underwater homeowners are in too deep for Obama’s plan (only good for homes with a mortgage that is no more than 105% of current assessed value) My mortgage is at $185,000, but my home value is only $139,000, now that the bottom has fallen out of the market, and there is no way my lender (Wells Fargo) will write down the difference.

    Too little to help most homeowners in trouble.

    But while I lived in Charleston we hosted the guy accused of plotting terrorism via dirty bomb. He was held there for many, many years.

    Should I assume from this, then, that Cantor thinks the phrase “domestic terrorism” is automatically a contradiction in terms? I guess the names “Theodore Kaczynski” and “Timothy McVeigh” don’t mean anything to him.

    With regard to Timothy McVeigh in particular, would Cantor — or perhaps we should call him Can’t-Or? — care to explain how driving a truck filled with explosives into a building so with the intent of killing people does constitute terrorism when it’s committed by a foreigner against American citizens but somehow doesn’t constitute terrorism when it’s committed by a fellow citizen? I seem to recall that McVeigh was executed after being convicted of all eleven charges leveled against him including “use of a weapon of mass destruction” — and since Republicans have often cited weapons of mass destruction as being the primary point of concern with regard to terrorism, I think we can infer that McVeigh meets the definition of a terrorist — and we didn’t seem to have any problem dealing with him.

    With regard to Timothy McVeigh in particular, would Cantor — or perhaps we should call him Can’t-Or? — care to explain how driving a truck filled with explosives into a building so with the intent of killing people does constitute terrorism when it’s committed by a foreigner against American citizens but somehow doesn’t constitute terrorism when it’s committed by a fellow citizen?

    If the Bureau of Prisons would release accurate data about the number of terrorist that are currently incarcerated in our Supermax and/or CMU units…then the GOP talking point would be totally deflated.

    Both Boehner and Cantor are in the same league as Inhofe – ignorant, anti-anything the Democrats propose. Are these men afraid that the US can’t stand up to terrorist? I guess 9/11 really did change these chicken hawks into living fear of some poor Arab/Asian Muslim carrying a bomb. Is this the way republicans show leadership, by running away from the fight. Shame on them for showing us their true color – YELLOW!

    One of those Fox news clowns said “Americans don’t want these people in their communities,” making it sound like you just might run into Khalid Sheik Muhammed when you drop by Starbucks for coffee. I don’t think I’d want the people that are in the maximum security prisons in my “community” either but that’s not where they are. They’re locked up. The only safety concern I’d have is for the prisoners themselves. I wonder how a bunch of Arab terrorists will do in a prison system stratified by black, hispanic, and white gangs. Probably about as well as Jeffrey Dahmer did.
