Yesterday, Jane Hamsher reported that the detainee photo amendment sponsored by Sens. Joe Lieberman (I-CT) and Lindsey Graham (R-SC) was stripped from the war supplemental in committee. The amendment would have allowed the Obama administration to suppress any “photograph taken between September 11, 2001 and January 22, 2009 relating to the treatment of individuals engaged, captured, or detained” after 9/11 by U.S. forces. This afternoon, Graham and Lieberman held a press conference to register their objections to dropping the measure and announce that they had “added our original legislation as an amendment to the FDA regulation of tobacco bill that’s on the floor right now”:
LIEBERMAN: [W]e’re going to vote against cloture on the bill, and I’m going to do everything I can to see if I can convince other Democrats to do that.
We’re just not going to roll over because some folks in the House don’t like this amendment. [W]e’re going to do everything we can to hold up the supplemental appropriations bill until we’re sure that this amendment prohibiting the release of these dangerous photographs is on that bill. And then we’ll continue to do everything we can to attach it to other legislation, to slow up the process.
Graham said the amendment was needed because “These photos, if they’re released, will be used by the enemy to incite violence as they walk down these streets.” A “senior Democratic aide” told the Weekly Standard that the two senators would “attach [the amendment] to every piece of legislation that comes down the pike.”
When Obama denies the photo release, he thinks, “This will protect the troops.”
When Lieberman and Graham (and Cheney, etc.) deny the photo release, they think, “Cover our asses.”

June 9th, 2009 at 6:09 pmThe refusal to release the torture photos isn’t because it will entice terrorists to attack the us, it’s because the parties involved in the torture of detainees are afraid they will get prosecuted if those photos are publicly displayed. The FOIA must be enforced and those photos must be released to expose those who have perpetrated the use of as well as those who allowed it to happen. Bush and the members of his dictatorship must be prosecuted to the fullest extent of the law and punished accordingly. Refusing the release of the photos is IMO an obstruction of Justice and Obama MUST follow through on the court order suggesting their release. It’s the law Barry and a lawyer such as yourself should know that.

Graham said the amendment was needed because “These photos, if they’re released, will be used by the enemy to incite violence as they walk down these streets.”
Meaning, he knows these cases wiil be thrown out of court, and the detainees released. He knows this, because he knows the cases are shaky, using evidence gained by torture. So to his mind, having released detainees walk the streets is inevitable, and better than if they haven’t seen the photos.
But, with the photos unreleased, the enemy can create horrors much worse than any torture we inflicted, and we cannot rebut their claims. This makes the situation much more potentially explosive, than the mere sight of the pictures themselves.
Openness is the best tactic in this case.

I have been dialing back my hopeful anticipation since he took office, but this is a bright line of political demarcation for me. Besides, releasing the information won’t tell our enemies or their sympathizers anything they don’t already believe anyways. What it will tell a lot of people “over there” is that we’re owning up to what we’ve done and are in the process of making it right. You miss the point. The point is to hide/destroy the evidence so that these people won’t be prosecuted. Hell, already, some three dozen or so people have died in custody, and not a single conviction of murder, despite a fair number of these deaths being ruled homicides.
