OK, if torture “works,” then why haven’t we caught OBL? That’s kind of a critical test for their theory. This guy told them where he was. Presumably he wasn’t there, since we haven’t caught him. Therefore, torture elicited false information. If you disagree, then produce OBL as proof. If you can’t, then you’re wrong.

The only way to avoid that test was to presume that he’s now lying about what he was asked. But that raises the question – if we didn’t torture people to find out OBL’s location, then why not? Wouldn’t that be the most important thing we’d want to know? Kind of the first order of business?

Torture does not tell you anything you don’t already know. Up until it turned out we were doing that, everyone already knew that. We’ve known it for centuries. But wingnuts have an amazing capacity to forget long-held common knowledge the instant it becomes inconvenient, and pretend it was never so.

If you have to ask whether torturing people is legal, you’ve got no business being in any job that involves “defending the Constitution.”

In any case, it’s obvious that this would be how it works. Being tortured gives you incentive only to say whatever’s the most plausible, regardless of whether it’s true. The quickest way to stop being tortured is to confirm whatever the torturer may already believe, whatever that may be.
