Eight months after the 2008 election, the Minnesota Supreme Court has declared Democrat Al Franken the winner of the state’s U.S. Senate election. The unanimous decision clears the way for Franken to be seated:
For all of the foregoing reasons, we affirm the decision of the trial court that Al Franken received the highest number of votes legally cast and is entitled under Minn. 32 Stat. § 204C.40 (2008) to receive the certificate of election as United States Senator from the State of Minnesota.
This weekend on CNN, Gov. Tim Pawlenty (R) said that he would be ready to “sign” the certificate officially declaring Franken the winner as soon as the supreme court gave the “green light“:
CNN: Your state supreme court has a ruling before it, it could come very soon. After that ruling, the next step would be for you to certify the election. Will you certify the election based on your state’s supreme court ruling, is that for you?
PAWLENTY: I’m going to follow the direction of the court, John. We expect that ruling any day now. I also expect them to give guidance and direction as to the certificate of election. I’m prepared to sign it as soon as they give the green light.
Today’s decision doesn’t contain any language specifically instructing Pawlenty to sign the certificate of election — which isn’t surprising, since the governor wasn’t a party to the litigation.
Coleman still has the option to “seek a review from the U.S. Supreme Court or file a whole new case in U.S. District Court.” If he does so and the court says to “put a limit on or stop the effect of the state court ruling,” Pawlenty said that he will abide by that decision. However, he said that “if that doesn’t happen promptly or drags out for any period of time, then we need to move ahead with signing this, particularly if I’m ordered to do that by the state court.”
TPM’s Eric Kleefeld has also raised the possibility that the Senate GOP could “attempt to filibuster” Franken’s acceptance, even if Pawlenty signs the certificate. NRSC Chairman John Cornyn (R-TX) has said that he’s willing to wage “World War III” if Democrats try to seat Franken before Coleman carries his case out through federal court — even though it could take “years” to resolve.
Franken will be the 60th Democrat in the U.S. Senate, giving the party enough votes to overcome Republican filibusters.

Without the certificate, Democrats have declined to attempt to seat Franken.
Coleman was the leader after Election Day, but a recount showed Franken overtaking him. A three-judge panel then affirmed Franken’s victory, which led to Coleman’s appeal to the state Supreme Court.
Coleman can still file suit in federal court, which could issue an order preventing Franken from being seated. It’s not yet clear whether Coleman will pursue further legal action, as his legal bills mount and public patience with his challenge wanes.
The former senator has seen several members of his staff disperse in recent months including, recently, his campaign manager.

I suspect that reply was directed at the court and they were more than happy to comply with the request. Coleman can still appeal to the federal court but I am hard pressed to see where there is a federal issue involved. This should be the last word. I seriously doubt Republican Senators would want to block Franken being seated now that he will have certification.

If Coleman finally concedes, then Gov. Pawlenty will certify Al Franken as Minnesota’s senator, but if Coleman takes his case to federal court, then Pawlenty won’t certify…which, of course, flies in the face of Republican claims that they are for state’s right, just like what happened in the 2000 presidential election in which the Florida Supreme Court’s ruling to continue the recount wasn’t final and the conservative Rehnquist Supreme Court seated George W. Bush as president even though he’d lost the popular vote.
Republicans equal state’s rights? Hardly. They are only for state’s rights when it fits their hardcore right-wing agenda, but when they gain control of our federal government (like they did during the criminal Bush/Cheney years) then their attitude is state’s-rights-be-damned, fascism-full-steam-ahead.

It all depends on what the Republic party leaders tell him to do. If they come to the conclusion that fighting Franken is doing them more harm than good, they will tell Pawlenty to sign the certificate. Otherwise, they will tell him not to. I doubt that Pawlenty is capable of independent thought so whatever he does will be at the behest of his party. He is, after all, one of the party before country crowd.

Keith Olberman made a good point the other night about Republics who stray and get caught vs Democrats who do. The difference is the Democrats either quit their jobs on their own or are forced out by their party, whereas the Republics are giving standing ovations. Regardless of how I personally feel about Franken (I think he’s an idiot) or the thought of a 60-count Dem majority (gag), he is now the Senator-elect, and since the last obstacle has been overcome (both the Court ruling and Coleman bowing out), Pawlenty needs to sign, and Franken needs to be sworn into office ASAP.

At least Reagan had experience in politics, with his work as president of screen actors guild in the era of black listing, then as governor of California. It is also scary when your primary reason seems to be to get to the magic number 60 to stop republicans. then you say the republicans are the party of no (when the democrats stopped Bush from making any progress on welfare, health care reform, etc.) Doesn’t it seem hypocritical to cricize the republicans for being sheep that follow their leader, when you you celebrate that all 60 democrats would vote the same way? First, if you look at the Senate, a good number of them are from non-political pasts. Be it “heck of a job Brownie” or Michele Bachman, being qualified isn’t always a genuine seal of approval (which is the point I think you’re making about Reagan).

People who understand what a theory is and so forth, and are capable of doing research as a regular part of their decision making process. Congress needs people who can deliberate. Congress needs people who want to serve the people. I’ll bet Franken is all of those things, plus he is comfortable in the lime-light and media savvy.

Franken is not unqualified. Being a politician your whole life isnt the only way to be qualified. That is why we VOTE. Franken got a degree in Polic Sci from Harvard and has had his fingers in politics since he was IN Harvard. Anyone who thinks, and several here have pointed out it is naive to do so, that Dems will vote lockstep is fooling themselves. Franken is a smart, strong progressive voice and THAT is why I sent him money even though I live in Arizona. That and Coleman was a weasel

I have great respect for anyone who sticks to his guns when the easiest route is to turn tail—like so many of the Democrats have done in the past 8 years. But you, sir, have not! But your tribulations are just beginning. Dirty politics will continue, hitting you with every thing they have; right, left and below the belt. I have placed faith on many politicians, especially, the Democrats. They have betrayed their duties and the promises they made to reverse the criminal acts and actions of the Bush administration. This included President Obama. But you are different. You stood your ground while other Democrats would have found an excuse to quit, to get paid off or hop over to the other side. Your long battle is not over, sir. It’s just beginning. To come to the aid of the common man, the ordinary guy and gal, who work hard for their daily bread, means you’ll be giving rub burns to the corporate/industrial/financial monsters , the pro conservative power structure of this nation. They don’t give up, they don’t play fair and they don’t forget or forgive. Be prepare, Mr. Franken. The most dangerous opponents you will be facing will be your “liberal” cohorts, beginning with the President. They will try to discredit you for your “attempt” to right the wrongs what this Congress have visited upon this nation. In other words, trying to upset their ill-gotten apple carts.
Again, my whole hardiness and congratulation on your senatorial success.
