As ThinkProgress has repeatedly pointed out, Rep. Michele Bachmann (R-MN) has been bragging about the fact that she plans not to answer Census questions this year, which is a violation of federal law punishable with a fine up to $5,000. Bachmann has been mocked by Stephen Colbert and criticized harshly by the largest Minnesota newspaper for her conspiratorial stance.
Now, in the latest rebuke of her off-the-wall claims about the Census, three out of the four House Republicans on the subcommittee that oversees the Census have released a statement calling her boycott plan “llogical, illegal and not in the best interest of our country”:
“Boycotting the constitutionally mandated Census is illogical, illegal and not in the best interest of our country,” Reps. Patrick McHenry (N.C.), Lynn Westmoreland (Ga.) and John Mica (Fla.), members of the Oversight and Government Reform Subcommittee on Information Policy, Census and National Achieves, said in a statement Wednesday.
“[A] boycott opens the door for partisans to statistically adjust Census results,” the trio’s statement said. “The partisan manipulation of census data would irreparably transform the Census from being the baseline of our entire statistical system into a tool used to wield political power in Washington.”
According to Roll Call, the three Republicans “approached Bachmann privately over the past few weeks and asked her to stop the boycott,” but “decided to go public because Bachmann appeared unfazed by their request.” Bachmann pushed her boycott plan on Monday in an interview with Sean Hannity.
Census officials have been meeting with Bachmann to try to talk her down from her illogical concerns. CongressDaily reports that McHenry even “showed her printed census materials in the attempt to dispel her fears.” But she remained skeptical. A GOP source said, “As long as Fox News keeps calling, she’s going to keep going.”

A little sacrifice here and there, a little time, and not spending their money with those sponsors could put them both on their heels in less than a year. Americans simply don’t have the discipline to see something like that through. Most modern day Americans are weak and cowardly.They have more interest in fag or freak shows on television than their own person.

I don’t know what the laws in Minnesota are, perhaps one of my fellow TP’ers can clarify them, but isn’t a call to willfully violate federal law an offense worthy of a recall? This was funny a few days ago, but it’s actually quite serious. She is encouraging her constituents to break the law.
Now, I’ve heard a lot of legislators speak out against laws they don’t like, fight against laws they don’t want, or advocate laws that they do want, but I’ve never heard of one calling for the direct and blatant violation of the law. That is such a stunning example of incompetence, (and considering her government position and the Constitutional mandate for census taking, it strikes me as possible that such actions are treasonous), she has no business being anywhere NEAR Congress.

Since the local MSM has been largely silent about her alarming extremism, I applaud every source who brings her up. Every mention she gets serves to expose her to a largely ignorant base of support.
Stories like this give us hope. Hope that the truth will come out before the next election. Hope that her future opponents will receive national backing. And even hope that concerned citizens like us might force her colleagues to officially censure her and send a message that her kind of hateful batscat is intolerable.

I don’t understand the big deal about voter registration fraud. ACORN paid volunteers/employees based on the number of voters they got to register, which provided them with incentive to file false registration applications, right? Well how did this affect the outcome of the election? Fraudulent registration does not equal fraudulent votes. So I really don’t see what the big stink is about. Yes, any instance of fraud is bad, especially in connection with elections b/c it diminishes the process’s credibility. But claims from the extreme right that imply that the 2008 presidential election was “stolen” by the dems in through ACORN are just ludicrous.

Perhaps…a yin and yang? One part positive spin, one part negative spin?
Or perhaps I just ought to be looking more at other progressive sites too.

Today, the controlling law for the U.S. Census is Title 13 of the U.S. Code. There is a lot of census data collected in the United States today, such as economic figures, sales and production figures, and agricultural statistics. Still, the head count is the only part of the census that is called for by the Constitution. The code for the enumeration can be found in 13 USC 141. In this code, the census is directed to be taken in 1980 and every ten years thereafter, and that the count is to be taken on April 1. The returns must be completed within nine months for use in apportionment of representatives. The code also specifies a mid-decade census be taken in 1985 and every ten years thereafter. This count need not be a head count (sampling may be used) though the data cannot be used for apportionment.
The code, at §141(g), notes that “As used in this section, ‘census of population’ means a census of population, housing, and matters relating to population and housing.”
There are fines for non-response and for false response as well, though the amount has risen from the 1790’s $20. Today failure to respond can result in a $100 fine; providing false answers is a more severe offense, and carries a $500 fine. Recent news reports, however, indicate that punishment for failure to respond is not usually enforced. The controlling section of the Code is 13 USC 221.

July 2nd, 2009 at 11:31 amAs a disgruntled Republican, it is my wish that Bachmann continues to push these inane ideas so that she may be one of the casualties of her own stupidity. I guess she does not even understand that the Census directly controls the number of Representatives from each state. Perhaps Republicans would be lucky enough that her own seat would be obliterated due to her leadership in the illegal “don’t fill our the form” movement. Of course, we would probably not be that lucky for this sort of unintended consequences to occur. So Sad, Too Bad!!!!
July 2nd, 2009 at 6:42 pmLet’s be accurate about what Rep. Bachmann has called for. First of all she did not say that she would not answer any and all questions on the 2010 census. She said that she would answer the question about how many people were in her household and that would be it. The constitution in article 1, section 2 calls for this ‘actual enumeration’ so that the apportionment of representatives can be accomplished. She believes that any other questions to be an invasion of privacy and unconstitutional. So in answering the questions about the number of people in her household and if others followed suit MN or any other state would not lose any representation. She may be a whackjob but at least let’s be accurate about what she called for.
