Birther soldier refuses to serve under President Obama.

U.S. Army Maj. Stefan Frederick Cook, who should be getting ready to deploy to Afghanistan, is instead seeking a temporary restraining order under the guise of being a conscientious objector. Cook is a birther who is arguing that President Obama is not a natural born citizen and, therefore, ineligible to be commander-in-chief. Cook’s lawyer is Orly Taitz — dubbed The Queen Bee of Birferstan for challenging the legitimacy of Obama’s presidency in California:

In the 20-page document — filed July 8 with the U.S. District Court for the Middle District of Georgia — the California-based Taitz asks the court to consider granting his client’s request based upon Cook’s belief that Obama is not a natural-born citizen of the United States and is therefore ineligible to serve as commander-in-chief of the U.S. Armed Forces.

Cook further states he “would be acting in violation of international law by engaging in military actions outside the United States under this President’s command. … simultaneously subjecting himself to possible prosecution as a war criminal by the faithful execution of these duties.”

When not filing suit against his commander-in-chief, Cook has also made time to post at the conservative website FreeRepublic.

    What I can’t understand is what the birthers think is sacrosanct about a birth certificate.

    If the birth is in a hospital, sure the doctor and nurse are witness, etc. But the identity of the father is still based on the say-so of the mother.

    If the birth is outside the hospital, the birth certificate in most states is based on the statement of the mother.

    Then, to get a copy of a birth certificate in most states, all you have to do is provide some personal info (varies by state, but is the type of info you could get from other sources) and sign a letter saying that it is you. So it isn’t too hard to get someone else’s birth certificate and start a fake identity.

    A conscientious objector (CO) is an individual who, on religious, moral or ethical grounds, refuses to participate as a combatant in war or, in some cases, to take any role that would support a combatant organization armed forces.

    I somehow doubt that U.S. Army Maj. Stefan Frederick Cook would have risen to the rank of Major if he had a religious, moral or ethical objection to serving in the Army…

    Barack Obama’s mother had to produce a U.S. birth certificate for him so that he could receive a passport many years ago. Minor children were not allowed to simply travel with a parent if the child did not have his/her own passport.

    My parents obtained passports for my siblings and myself 40 years ago when we traveled to Europe.

    The right to be heard is a part of Due Process which means you have right to present your evidence during a trial. It is not an absolute right to file baseless lawsuits without any legal basis. Courts do not exist to hear frivolous lawsuits.

    None of this addresses the audacity of the major claiming to be a conscientious objector, when that term applies to someone whose moral or religious grounds prevent him/her from serving in combat. During the Vietnam War, many (most?) Selective Service boards refused to grant CO status to anyone at all. It would be a gross miscarriage of justice if this was granted to someone who clearly has no objections to combat, but has swallowed the kool-aid in denying that a birth certificate really is a birth certificate.

    Frankly, the guy is apparently too stupid to serve, especially as an officer.

    My grandfather was a conscientious objecter in WW2. He just didn’t want to carry a gun or shoot people. He joined the Army to fight for the cause, and they had him drive an ambulance and picking up the dead and wounded on the battlefields in Europe.

    Barack Obama did not order the major to Afghanistan–his immediate superiors did. Moreover, the War in Afghanistan was not started by Barack Obama, but by his predecessor.
    So the major is not objecting to an action of Barack Obama’s that he finds illegitimate. He’s saying that Gen. Stanley A. McChrystal has no right to give him orders basd on McChrystal’s own judgment, nor any other officer ofthe United States Armed forces, because of a question about the CinC’s status.

    What he’s basically saying is ‘not my government.” The same argument could be applied to refusing to pay for a fishing license or to drive on the right side of the road. Because Barack Obama is not qualified to be President of the United States, I don’t have to do anything the government says. I can rob a bank or kill someone because the government is illegitimate.

    THis is what the militias say–and do–all the time.

    The military chain of command says that you do what your superior officer orders you to do. Period. If you disobey a direct order, it’s grounds for court martial. On the battlefirld, it’s grounds for execution.

    What this guy is asserting is that an officer can disobey a colonel’s order because the commanding general has been court-martialed or relieved of duty–which is nonsense. The colonel’s order stands because he is the major’s commanding officer. PERIOD.

    The only out given by the Nuremberg Trials is having a problem with the order itself, as to whether it orders an unconscionable act. Bot the qualifications of the person giving the order.

    The President is not the king. He isn’t the government. He’s one officer in that government. If Barack Obama has perpetrated a fraud on the government, then he should be impeached and tried and removed from office. (To do so, of course, mean you have to, you know, prove your accusations.) But theis joker says I don’t have to obey anybody in the government, obey any laws, perform any public duties, because of charges about one member of that government.

    Our government is one of laws and not of men. The wingnuts don’t get that, At one end the flap their arms and shriek, “Because of the super-cyborg ninja terrorists, wecan’t have due process and court trials any more!” And on the other side they say “I don’t have to obey any laws at all if I make n allegation about the President!”

    Their view is tribal, and antithetical to civilization. It’s the children’s playground–and the militia compound.

    I joined the Navy back in 1973, knowing that my CinC would be Richard Nixon. A man I considered to be a crook, and therefore not fit for the office he held. I served anyway, believing I was serving my country more than I was serving a crook in the White House. As it turns out, enough people agreed with me that he was a crook, and he resigned before I’d been in uniform even a year.

    There have been times when I believed the man serving as President was not doing so legitimately. Nixon was one example — George W. Bush was another. And I believe I had a more substantive argument on my side than a fanciful (and well-debunked) tale about a birth certificate.

    I don’t know if Stefan Cook is adopting this position all on his own, or if he is being used by the birthers to get their case to court (there’s good reason to believe it’s the latter). Either way, he must truly believe in his cause — not only will he wind up going to jail, not only is his military career (and just about any other career he wishes to have) ruined, but he will spend the rest of his life being a laughingstock.

    And I can take comfort that the military that serves my country will no longer include this imbecile in its ranks.

    Only if he’s objecting conscientiously, which Mr. Cook is not. He’s arguing that Obama isn’t president. That’s a matter that can be quantitatively proved or disproved, which is not the same as a qualitative moral objection – which is what the conscientious objector status was created for in the first place.

    The “Birther” point is moot! The time for such discovery was prior to the Congress of the United States of America recognizing the Obama Presidency. He is the recognized leader of the Free World, like it or not. The actions of any soldier who alledgedly disobeys an order from the Commander and Chief are criminal in the least and punishable by Court Martial and dishonorary discharge, if found guilty.

    In this particular case the charge may rise to the level of mutiny, given that the refusal to obey an order is based on an accuasation, not proven fact (simple opinion), and a direct challenge to the leader’s legitimacy to lead, and has potential to incite greater dissertion within the military.

    My family has served honorably in wars from the first one (Independence) through to the current conflict in Iraq, and I am proud of them. I – and indeed most of the folks I know (who are most certainly Democrat) – have always supported the people in harm’s way, and it’s an insult to suggest otherwise. Your criticism might be better aimed at the Bush administration that consistently left our military underfunded and underequipped.

    This is simple. When you join, you take an oath, as you should know if you served. If you break it, you will be tried, convicted and suffer the consequences, as have those many who have chosen to not return to iraqnam or afghanistan for their 3rd or 4th deployments for whatever reasons.

    You are free to “support” this officer’s desertion as we are to support any other troops who desert, eh?

    Why don’t you try googling “us military desertions” and begin reading how many THOUSANDS of troops desert each year…….

    IMHO that’s much better than suicide……try googling “us military suicides” and you might begin to understand that supporting the troops is not necessarily supporting their mission, but the persons themselves. Get help if you need it and encourage others to do the same.

    At first I was going to take exception at being called “son”, but then I see you were a Vietnam vet so you’re my senior. You get to call me “son”. Thanks for your service. Seriously.

    However, I have to disagree with your claim about so-called “progressives” (BTW, what constitutes “progress” in this connection still eludes me) not denigrating “the troops”. That is false. You know it and I know it. You may not be denigrating the troops and I suspect you would not given your service record, but I have plenty of “progressive” friends who, for example, were among the first to pile on the Haditha Marines and who remained strangely silent after they were acquitted of the charges brought against them. Anyone who ever served as a foot soldier (not to mention anyone with respect for our system of law) knew they deserved at least the benefit of the doubt until the facts were investigated and made known.

    As for you and other commentators trying to convince me, as did one Obamabot in my neighborhood, that this administration “supports the troops” whereas the previous administration did not, all I need do is point you to the recent change in ROE ordered in Afghanistan, preventing troops from engaging the enemy within 100m of a dwelling, ostensibly to reduce “collateral damage”. I was an infantryman. So is almost everyone else I know in the service. We all agree that is a deadly decision and it’s going to get US soldiers killed. How it could be anything but politically-motivated I have no idea. It should be rescinded or we should pull out of Afghanistan. You can’t fight on the ground unless you can close with an enemy and kill them. If they get to take free potshots at you from “friendly” houses, you’re going to have a bad day.

I have asked all of the aforementioned friends the question “What, to you, represents progress?” only to be met with confusion or sometimes sneers. It’s a fair question. My dictionary defines “progress” as:

    advance or development toward a better, more complete, or more modern condition

    I’m an educated man. I know that words like “better”, “complete” and “modern” semantically require dimensions along which things are more or less “better”, “complete” and “modern” in order to have meaning. It is not a “generalized insult” to ask someone what their conception of those dimensions is and what a positive change along those dimensions would mean personally and in the realm of public policy. It is what we call in English a “question”.

    But never mind all that. I tried to be respectful – even thanking you for your military service. That’s not a political statement. That was a soldier-to-soldier courtesy, and one I extend to anyone, whatever their politics, who has served honorably. But somehow you got the idea, because I questioned the orthodoxy that holds sway in groups like this, that I just might be some kind of right-wing pathogen that needs to be driven out of the “progressive” body. I guess the service of throwbacks like myself doesn’t count, huh?

    You know what’s funny? I’ve even exchanged civil words with Cindy Sheehan. We disagreed on many things, but you know, she’s a genuinely kind person. I’m getting the feeling you’re not. You have the instincts of a Kommissar.

After all, natural born citizenship IS one of the requirements by law to be the leader of our nation. So why HASN’T it been addressed to the nation and why didn’t WE as a nation make sure it was proven before we put him into office? #2) If there is a ligitimate claim that this man (and all the other soldiers who protect our nation for that matter) CAN in fact be held or punished for war crimes by following orders & engaging in this conflict at a later time; then I think the argument SHOULD be heard. Our soldiers SHOULD be protected if there is any risk!

Did you know that if a reservist goes awol, he was subject to being called up to active duty? Did any of you question his right to be potus because of his LACK of ONE document proving he served out his term?

    Were the orders to deploy valid under lilaWol? Were the congressional authorizations valid then? Would they not also be valid now?

    I followed this link and read the article as well as looked at what they have as a copy of the certificate…(I can say there are some pretty stupid comments under the story regarding the type face used and whether or not laser printers were invented back in 1961…some pretty ignorant people.)
    One thing that does strike me in the arguemnts though is the fact that, yes, that may be a copy of a certificate (it is a replacement actually and not the original people are referring to) BUT…on that certificate, I agree with the fact it is questionable to me because even thought there is a printed seal at the top of the page..the IS NOT an empressed seal on that document and there is no official signature either. I know both of these things are on certified copies of certificates because I have copies of my children’s. It is one thing that WOULD legitimize the document…but its not present. So yes I would want more sufficient proof as well if my life & freedom were at stake…

    First, I see no reason for you to attack me for a simple comment…I was not rude when I responded to your post, nor did I tell you that your information was BS, call you “not so bright”, that you didn’t know WTF you were talking about, and I certainly didn’t question your loyalty to your country or your ability/willingness to serve it! I was simply stating a point that was comparing the copy, on the site YOU gave as a reference, to US certified copies I have of personal documents that could possibly STOP the arguments from all nay-sayers. I never said it wasn’t REAL… If you were in a possible position of being imprisoned or executed over such a circumstance would you NOT want to be certain before taking action?

    Second, the other point was…it seems the problem isn’t whether or not the CIA, Pentagon & US Law Enforcement believes it or not…every word he says oral or written is documented on record for the duration of his term; every detail about him is now part of history. What I am saying here is every aspect of his life is public…ok…so what’s the big deal about providing documents now? It simply makes him look bad by continuing to refuse to provide such things that would easily stop the entire issue from ever being raised again! With all the insults being thrown around in here I would also add this soldier ISN’T the first one to raise this objection…there are other soldiers that are documented as well that are on active duty in Iraq that have also asked for this same proof, as well as, 2 more enlisted Americans that have added their names to the list today even AFTER this case was dismissed in court(only making the point again, why not stop the argument now?)!

    And to answer your question…if it WERE me in that situation where showing proof of my birth was under such scrutiny
    for a position that important…then YES I would do everything in my power to provide a document of that calibur to prove it without hesitation and as quickly as possible…

    By your reaction, are you implying that you wouldn’t want answers or that you wouldn’t provide such proof if it was you in the situation???

    My point is that if you can present YOUR own birth certificate in some form that’s better than that, let’s see it. You cannot do so, because our BC are given to us as COPIES, just like what is posted on the link from LA Times…

    Otherwise, accept the FACT that Obama DID present his birth certificate and all US govt. agencies that deal with such matters accept it as FACT. Just because YOU and a handful of political partisans and their DUPES choose not to is of no concern to anyone else.

    WTF? There’s a fairly large difference between Bush lying in order to invade Iraq (WMDs anyone?) – a known FACT – and Cook making up Obama isn’t a US Citizen – a known LIE.
