Sen. Jeff Sessions Slams Sotomayor For Not Voting Like Other Puerto Ricans

This morning, Sen. Jeff Sessions (R-AL) castigated Sotomayor for not ruling with her fellow Puerto Rican colleague, conservative Judge José A. Cabranes, when she decided to deny an en banc appeal in Ricci v. DeStefano, a process in which all judges of a court hear a case (as opposed to a three-judge panel of them). Sessions seemed to indicate that people of the same ancestry should vote the same way:

SESSIONS: You voted not to reconsider the prior case. You voted to stay with the decision of the circuit. And in fact your vote was the key vote. Had you voted with Judge Cabranes, himself of Puerto Rican ancestry, had you voted with him, you could’ve changed that case.

Watch it:

Sessions slammed Sotomayor as being “unsuitable for the bench” due to her past affiliation with the Puerto Rican Legal Defense and Education Fund (PRLDEF). Apparently, Sessions didn’t realize that Judge Cabranes also served on PRLDEF’s board.

Sessions, a former prosecutor and attorney general in his home state, was nominated to serve as a federal judge by President Ronald Reagan in 1986. Maybe he’s just bitter that he was denied a seat on the federal bench by the Senate Judiciary Committee in a 9-9 vote which deemed him “grossly insensitive” on racial issues. During his own hearings, Sessions admitted to “frequently joking in an off-color sort of way.” Looks like not much has changed.

Update During his questioning, Sessions said he wished Sotomayor acted more like Judge Miriam Cedarbaum, who “believes that judges must transcend their personal sympathies and prejudices.” “My friend Judge Cedarbaum is here,” Sotomayor responded, to Sessions’ apparent surprise. For her part, Cedarbaum told the WSJ, “I don’t believe for a minute that there are any differences in our approach to judging, and her personal predilections have no effect on her approach to judging.”
Update Yglesias writes, "I would pay good money to hear Sonia Sotomayor say, 'Senator Sessions, I think it’s ironic to be facing these questions from a man whose judicial nomination was rejected by this very committee on the grounds that he’s a huge racist.'"

    I like how subtle she is in the clip. Her face never changes when Sessions makes his comment, her pen simply stops moving and she looks up. Were I in her place, I’d have been snorting uncontrollably with derision while rolling my eyes. I have to say her technique placed emphasis on his idiocy while being totally unobjectionable.

    This process will do more than anything else to debunk the GOP talking point that Sotomayor is “difficult to get along with” and has a “bad temper”.

    If she can deal with this circus while maintaining her dignity, I’m sure she can deal with anything thrown her way in the SCOTUS.

    Sessions was denied a federal judgeship because he was deemed “grossly insensitive,” even during a time when the Dems were abject pu$$ie$ in the face of Reagan’s (bewildering) popularity.

    And yet AP just described him thusly:

    “Known as a friendly, unassuming senator, Sessions went out of his way to preface critical questions with an explanation of why the debate is important.”

    In what alternate universe is he known as such? He’s famous for being a bigot, so is it OK if he’s a jocular bigot? This guy didn’t think so during Sessions’ judicial confirmation hearing:

    “Another damaging witness–a black former assistant U.S. Attorney in Alabama named Thomas Figures–testified that, during a 1981 murder investigation involving the Ku Klux Klan, Sessions was heard by several colleagues commenting that he “used to think they [the Klan] were OK” until he found out some of them were “pot smokers.” Sessions claimed the comment was clearly said in jest. Figures didn’t see it that way. Sessions, he said, had called him “boy” and, after overhearing him chastise a secretary, warned him to “be careful what you say to white folks.”

    It’s a disgrace to the system that Sessions is even in the Senate, much less in a position to question SCOTUS nominees.

    The same argument could be made for Senator Sessions not voting like other white males in the Senate. They do have the majority, and the majority of that majority are Democrats, so Sessions voting with his ‘pub buds is not voting with the majority of his race and sex.

    Of the Hispanics I know, most don’t talk about their religion. Of the ones that do, I know several Mormons and a few Buddhists, but no Catholics. To extrapolate, no Hispanics are Catholic.

    If this is a concern of Sessions’ then he should be very upset with Roberts because Robert’s “personal sympathies and prejudices” lie with corporations. Roberts has voted consistently in favor of corporations and against “we the people”.

    Actually, Sessions is wrong (what a huge surprise). The three judge panel voted unanimously. So, if Judge Sotomayor had voted in opposition to the other two judges (both coincidentally being conservative judges) it would not have made one bit of difference in the ruling.

    Mr. Sessions has this post by reason of seniority. Not by respect for his judgment. In fact when he himself had his name submitted for her position, he was dumped for not being qualified enough for the position. So his being head of this committee is real irony. He is supposed to decide along with others, her qualifications.

    This woman is brilliant. And now Specter and Graham must both vote yes on her qualifications as they did when she was made a judge a few years ago. She cannot all of the sudden be unqualified.     It would not matter how qualified she was. Or anyone else the President nominated. The Republicans will do as they have done for the last six months. They will say no to every single thing suggested by the Democratic President. As if empathy is something terrible. Even though one of the judges on the Supreme Court said at his hearing the very same thing. But of course he was a Republican and that’s different isn’t it? They continue to have total amnesia about what they say at any given time.

    Someone in Session’s staff is going to have hell to pay for not reminding Sessions of the similar paths Sessions and Cedarbaum took until he was revealed as an unapologetic racist; and if that isn’t enough karma, it turns out Cedarbaum not only mentored Sotomayor, they are good friends.

    Well well, this comment explains why all of the OWGs(old white guys) all vote the same way. It has nothing to do with what they are voting on and everything to do with how the other OWGs have voted.

    Serving with the Arm Forces back during the Korean War, I came across these dumn ass inbred southern hillbillies. I had more respect for the North Koreans than I had for these pieces of southern craps!

    The Sotomayor hearing’s been making me CRAZY; esp with Senator Sessions’ embarrassing questioning of this uber-qualified candidate. I shudder and hang my head in shame when I think of my friends and other leaders around the world who may be watching.

    I’m so relieved to find this forum and others who feel as I do… props for all the very clever (and dead on!) comments!

    We’re blessed with such a great country and there’s room for so many points of view, but surely we can ALL do better than this bunch embarrASSments. PLEASE vote next time around! I wanna move to AL just so I can vote against Jeff.
