DoJ official finds it ‘surreal’ to have to respond to Franken’s concerns about Patriot Act.

Yesterday, the Senate Judiciary Committee held a hearing to discuss the reauthorization of the USA Patriot Act. Committee member Sen. Al Franken (D-MN) used his question-and-answer period to investigate the provision that authorizes “roving wiretaps,” expressing concern that the law does not require federal authorities to identify the target with specificity before proceeding with surveillance. Franken then read the Fourth Amendment to one of the panelists, Assistant Attorney General David Kris, emphasizing that, “no Warrants shall issue but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” “That’s pretty explicit language,” noted Franken, asking Kris how the “roving wiretap” provision meets that constitutional requirement. The Washington Independent’s Daphne Eviatar reports what happened next:

Kris looked flustered and mumbled that “this is surreal,” apparently referring to having to respond to Franken’s question. “I would defer to the other branch of government,” he said, referring to the courts, prompting Franken to interject: “I know what that is.”

    Sure, MN elected Batshit Bachmann, & we have to live with ‘that’. But Franken is beginning to show his intelligence and true colors as a Progressive.

Franken has graduated cum laude from Harvard with a degree in Political Science, has been a political commentator for years, has served as a Fellow with Harvard’s Kennedy School of Government. He made a more valid point at yesterday’s hearing than any other member of the Senate so I would say that you, as usual, are full of shit.

    The bit that Frankin read was from the Constitution, not the Patriot Act. A roving wiretap is one in which no specific person or place is mentioned. You cannot have probable cause to search an unnamed person or place. That does not make a warrant, it makes a blank check to search anyone or anywhere you want. That right is not afforded, and is in fact denied directly, by the Fourth Amendment to the US Constitution.

    This does not take a lot of common sense, but then you have ZERO common sense, as evidenced by the fact that you are pathetically wrong and still arguing your point. Just shut up. You only make yourself look even dumber than we already knew you were.

    Harley Davidson makes a much better bike today that requires less “maintenance” than previously, but only because they were competing against Honda, Suzuki, etc and realized they were going down the toilet unless they addressed reliability issues. Kudos to them for following through; the American auto manufacturers should have paid more attention to HD.

    Tracist, I can be as perceptive as the next guy, but when someone makes it a habit to dodge direct questions and post confrontational challenges instead of answers, I tend to recognize it.

    And there’s always a reason for such weaselish behavior. So my approach at that point is to go back to basics, and ask for specific information so that there’s no misunderstanding.

    As I said, given your habit of cryptic answers, being understood easily by others doesn’t seem to be a high priority for you.

    The probable cause is there as is the description of the place or person being searched as stated by Assistant Attorney General David Kris and even Franken himself. Franken stated that the Patriot Act doen’t require authorities to identify the individual, but the statute does require the government to either give the name or a description of the individual(s) or place the place.

    Uh…you are aware that they’re talking about wire-tapping without warrants because they don’t NEED probably cause, right? They can just wire-tap because they want to.
