Yesterday, the Senate Judiciary Committee held a hearing to discuss the reauthorization of the USA Patriot Act. Committee member Sen. Al Franken (D-MN) used his question-and-answer period to investigate the provision that authorizes “roving wiretaps,” expressing concern that the law does not require federal authorities to identify the target with specificity before proceeding with surveillance. Franken then read the Fourth Amendment to one of the panelists, Assistant Attorney General David Kris, emphasizing that, “no Warrants shall issue but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.” “That’s pretty explicit language,” noted Franken, asking Kris how the “roving wiretap” provision meets that constitutional requirement. The Washington Independent’s Daphne Eviatar reports what happened next:
Kris looked flustered and mumbled that “this is surreal,” apparently referring to having to respond to Franken’s question. “I would defer to the other branch of government,” he said, referring to the courts, prompting Franken to interject: “I know what that is.”
Watch it:
If Coleman had won the Senate race here in MN, he would be asking for MORE secrecy with the Patriot Act.
Sure, MN elected Batshit Bachmann, & we have to live with ‘that’. But Franken is beginning to show his intelligence and true colors as a Progressive.
Keep asking real questions, Al. If those being questioned feel it’s ’surreal’, it’s just because nobody has had the balls to ask them real questions until you finally were seated in the Senate.
September 24th, 2009 at 10:02 amIt’s “surreal” for the DoJ to answer to the Senate Judiciary Committee?
Interesting…
September 24th, 2009 at 10:04 amI find it somewhat surreal that nobody has ever asked the DoJ this obvious question.
I’m glad we have Al Franken in the Senate. We need a few more who aren’t afraid to point out that the Emperor is buck nekkid.
September 24th, 2009 at 10:05 amHow is wrist slitting learning on the job T5?
September 24th, 2009 at 10:05 amWell, read the fourth amendment. Franken is rightfully challenging these warrantless, roving, wiretaps. This is why the framers put it in the Bill of Rights.

Franken learning on the job. Good for him.
_____________________________________________________________
“Learning”? It appears he has his act together. Certainly more than the DoJ does.
September 24th, 2009 at 10:07 amLeave it to the newest Senator, a former writer and comedian no less, to school the corrupted idiots who believe they’re above the law.
WELCOME TO THE REALITY, FCUKWITS.
September 24th, 2009 at 10:07 amThus far,I have been impressed with Franken’s thoughtfulness and reasoning process.
It’s ironic. After all the sniping from the republicans about him being a comic, it turns out that he is a real legislator and they are the a**clowns.
September 24th, 2009 at 10:07 amShorter Kris: The reality based are surreal
September 24th, 2009 at 10:08 amFranken frightens the right wingers because he is smart, articulate, and has the facts on his side.
poor little pansies like tracist just quiver in fear of people like that
September 24th, 2009 at 10:09 amObtuser T5: I want big brother gubyahmint.
September 24th, 2009 at 10:11 amObviously, Tracy has never heard of Al Frankin. Tracy, in the future, when you don’t know what you are talking about, please STFU.
September 24th, 2009 at 10:12 amthat would condemn him to an eternity of silence
September 24th, 2009 at 10:13 amHmm, only 8 unique posters needed to take down one troll comment.
Thank you silent lurkers…
September 24th, 2009 at 10:14 amman, i’d think it was surreal too if i had a very famous former comedian schooling me on the constitution.
Franken is boss, no doubt.
September 24th, 2009 at 10:15 amWhat’s really unbelievable is that the DoJ has not been asked to defend their actions versus the Constitution before this!
September 24th, 2009 at 10:16 amFranken is one of the brightest and most intelligent members of the Senate to date. Franken has graduated cum laude from Harvard with a degree in Political Science, has been a political commentator for years, has served as a Fellow with Harvard’s Kennedy School of Government. You must be afraid of what he brings to the table Tracy or you wouldn’t be wearing your ignorance so proudly on your sleeve today. He made a more valid point at yesterday’s hearing than any other member of the Senate so I would say that you, as usual, are full of shit.
September 24th, 2009 at 10:16 amYeah, it must come as an absolute surprise to the DoJ that they actually have to answer to that inferior branch of government (the legislative) after 8 long years of complete invulnerability to questioning.
Franken will turn out to be one of the best Senators we’ve seen in quite some time.
September 24th, 2009 at 10:17 amTracy__5 says:
As far as Franken getting schooled in this matter…
September 24th, 2009 at 10:17 am
Did you even look at the post? Clearly you have reading comprehension issues.
September 24th, 2009 at 10:18 amIt is refreshing to hear the Constitution read on the Senate Floor… under the previous administration, it was almost as if it never existed.
September 24th, 2009 at 10:19 amFunny how Norm Coleman spent 6 long years in that Senate seat without learning a goddamn thing, much less ever taking a look at the 4th Amendment. Yet, empty-headed Republican drones like Tracist never noticed.
September 24th, 2009 at 10:19 amFrom my inbox:
IT’S TIME TO ROLL BACK THE SO-CALLED PATRIOT ACT
A group of Senate Democrats led by Russ Feingold (WI) and Dick Durbin
(IL) have proposed the Judicious Use of Surveillance Tools in
Counter-terrorism Efforts (JUSTICE) Act, a bill that would introduce
stronger safeguards and higher standards of judicial oversight for
surveillance activity. It aims to reform the most abusive
characteristics of the PATRIOT Act and would also roll back a
controversial provision of the FISA Amendment Act that granted
telecom companies retroactive immunity for their participation in the
Bush administration’s extralegal warrantless surveillance program.
Senator Feingold says that the goal of the act is to ensure that
surveillance and intelligence-gathering activities are properly
empowered while guaranteeing that rights are respected and
investigative privileges are not misused. The proposal is broadly
endorsed by privacy advocates and civil liberties groups, including
the American Civil Liberties Union and the Electronic Frontier
Foundation. But in order for it to pass, WE THE PEOPLE must speak out
to demand it.

September 24th, 2009 at 10:20 amSomebody explain things to the Tracist, I have to get to school.
:-D

must be sad to go through life with such a large imagined chip on your shoulder

Were you born stupid or just raised that way?
September 24th, 2009 at 10:23 amTracist, why do you hate the Constitution of the United States of America?
September 24th, 2009 at 10:25 amAfter six years of that idiot Coleman, we in Minnesota now have a person in Franken that fills the shoes of Wellstone.
September 24th, 2009 at 10:25 am****
Kris learning on the job. Too bad for him.
:|
September 24th, 2009 at 10:26 amRemember when all we heard was “Progressives are wrong when they say Bush is an idiot, he went to Yale”?
And now that we have a President who graduated from Columbia University AND Harvard Law and Senator Franken who graduated from Harvard, suddenly being an alum from those places doesn’t seem to matter as much.
September 24th, 2009 at 10:27 amjoe, it doesn’t sound to me like Kris (or Tracist) learned anything.
September 24th, 2009 at 10:28 amWhat??? How DARE a jumped-up lib comedian ask questions about the fact that the Bush administration ordered wiretaps without warrants?? That’s not FAIR!!! Hey!!! Cut it out, you big lib poopyhead! You aren’t following the RULES!!!!
/snark
I find it surreal that nobody has actually asked this question up until now.
September 24th, 2009 at 10:29 amI found this in Wiki. Apparently this guy used to understand the 4th Amendment, but forgot about it. Hopefully, Sen. Franken jogged his memory.
Kris attracted significant public attention when he released a 23-page legal memorandum, in his personal capacity, sharply criticizing the George W. Bush administration’s legal argument that it had authority to conduct warrantless domestic wiretapping due to the Authorization for Use of Military Force Against Terrorists passed by Congress on September 18, 2001.

The language and original intent of FISA was to allow wire-tapping without a warrant for a period of 72 hours before HAVING TO PRESENT A WARRANT , you moron………..
September 24th, 2009 at 10:38 amKey word in number 39, tracist: BEFORE (having to present a warrant).
September 24th, 2009 at 10:41 amOnce again Al Franken does not disapoint. He’s shown all of his critics the level of his intelligence.
September 24th, 2009 at 10:47 amTracist head must be covered in bruises.
Also, she must be unaware of the practice of reading a statute/law VERBATIM, for the record, before making an argument for or against said when debating on the Senate floor.
There-there my little tiny ball of hate, there-there…
September 24th, 2009 at 10:53 am… don’t you have a men’s room to “design-build” somewhere, tracist?
LOL
September 24th, 2009 at 10:54 amOh, my. Lissen to the little tracist – knocking that degree in PolySci from Harvard!
Hey, waitaminnit – I’ve got this figured out: tracist’s AFRAID of Al Franken!!!!
Why are all you conservaturds so bedwettingly afraid of a liberal comedian????
BWAHAHAHAHAHAHAHAHAH!!!
September 24th, 2009 at 10:58 amI’m really missing something here. why should the DoJ think it odd to be asked their opinion on the constitutionality of a law ?
Gonzo wrote his opinion all over the place (and perhaps that is the problem as his opinion may be less than desirable ?).
September 24th, 2009 at 11:09 amOne thing’s for sure – Senator Al Franken gets Tracy’s shorts all in a bunch!
By all means, Tracy, you and your friends should keep smirking and considering Senator Franken just a former comedian. And, of course, as you well know, graduating with honors from Harvard with a degree in Political Science doesn’t make one an expert on the constitution. I’m sure your grasp of the constitution is far superior to some loser like Franken who has a PolySci degree from Harvard. But, you haven’t referred to him as Stuart Smalley yet. That’s always a hoot!
By the way, I think you’ve set a record for the most hysterical replies by a troll in the course of one 15 minute period. Senator Al Franken does that to people like you.
September 24th, 2009 at 11:16 amOh, and Tracy, in spite of your seasoned well-informed view that the Patriot Act is a constitutionally sound piece of legislation, it may be possible that this act is unconstitutional. I don’t want to upset you, but this may actually be what Senator Al Franken is getting at. He may be working at a level somewhere above your pedestrian thinking.
September 24th, 2009 at 11:20 amTracist also forgot (I could find the link) where I pissed her off to the point she stated she would never acknowledge me again :(
So she’s also a liar or dumb as a bag of broken hammers, and even more useless…
September 24th, 2009 at 11:22 amwhy Tracy,
because Franken is smarter than 96% of the congress,
or because he could also kick their asses?
September 24th, 2009 at 11:24 amSo, Tracist thinks it is worthless for a politician to have a degree in political science. It makes you wonder what sort of degree Tracist got to become an architect? No wonder his buildings leak.
Good point Trace. Maybe you should become a comedian.
September 24th, 2009 at 11:24 amt5 is jealous because someone besides him is getting attention.
t5: hey everybody, look at me. Pay attention to me!!!
what a baby.
September 24th, 2009 at 11:24 ami’m truly shocked
at the kinds of crybabies
coming at us from the right.
(aren’t they supposed to be tough guys?)
September 24th, 2009 at 11:27 amPoor Tracy. She goes into this assuming the Patriot Act is legitimate because it’s been voted into law. She can’t imagine that a thoughtful politician might be beginning to make a case that most of the law is unconstitutional.
September 24th, 2009 at 11:28 amJust because he is a former comedian, does not mean that he isn’t smart. Good for you Mr. Franken. The whole of the Patriot act should be allowed to die so that it can no longer terrorize the American people. It was a travesty when first passed and that has not changed.
September 24th, 2009 at 11:28 amHow awful it must be to feel like you have to tell a pointless lie or say something patently stupid to get attention. It must suck to be poor Tracy.
September 24th, 2009 at 11:29 amYes, quite the contrary. You will find that most comedians are very intelligent. You will also find that very, very few of them are right-wing Republicans.
September 24th, 2009 at 11:31 amThis sort of behavior has to be nipped in the bud. This Senator hasn’t been around long enough to be properly bought so he thinks he can just ask all sorts of cogent questions in a proper fashion. Next thing you know he will be sponsoring legislation that has nothing to do with the corporate interests the rest of us work for just because he thinks the people who elected him should have some say.
I tell you, this does not bode well. Next we will have to deal with other Senators voting their conscience and listening to constituents in their home state. Nip it! Right now?
What does he think we are running here, some kind of democracy?
September 24th, 2009 at 11:39 amTracy_5
Wow, you have no clue what you’re talking about.
The bit that Frankin read was from the Constitution, not the Patriot Act. A roving wiretap is one in which no specific person or place is mentioned. You cannot have probable cause to search an unnamed person or place. That does not make a warrant, it makes a blank check to search anyone or anywhere you want. That right is not afforded, and is in fact denied directly, by the Fourth Amendment to the US Constitution.
This does not take a lot of common sense, but then you have ZERO common sense, as evidenced by the fact that you are pathetically wrong and still arguing your point. Just shut up. You only make yourself look even dumber than we already knew you were.
September 24th, 2009 at 11:39 amYou will find that most comedians are very intelligent. You will also find that very, very few of them are right-wing Republicans.
Well, if you like jokes about trailer parks and ugly women, YOU MIGHT BE A REDNECK…
September 24th, 2009 at 11:40 amwow tracy
everthing about you has really deteriorated over the last couple years.
now you sound like the garden variety righty dummy, who lashes out at anything resembling low-hanging fruit, with no regard to the background of the individuals involved or the situation at hand…
it’s really been tough seeing you tumble downhill this way.
i’m sorry.
September 24th, 2009 at 11:41 amYou know, I don’t a rat’s ass if authoritarian grovelers, like Tracist want to give up their civil liberties. The only problem is, when they take away the liberties of piss-soaked cowards, like Tracist, they also take mine away.
September 24th, 2009 at 11:42 amTracy__5 says:
“…it may be possible that this act is unconstitutional.”
How long has the Patriot Act been in the law?
Oh, so you ARE arguing that unconstitutional laws override the Constitution. I’m so glad you finally came out and admitted that you hate America that I won’t even hold your incontinent, ignorant Wilson-esque “you lie” outburst against you.
September 24th, 2009 at 11:45 amTracy__5 says:
Yes and he sure made all of those lawyers laugh with his blatant ignorance of the law. Yes he very good a making a joke when shows his ignorance.

Whoa, cowboy… how about some serious substantiation for that contention, or is that just another hysterical rightwing talking point?
[Franken] attended Harvard College and graduated cum laude in 1973 with a bachelor of arts degree in political science.[10]
I mean, for heaven’s sake… he’s not a college drop out, like Limbaugh…
But wait… yer an architect… you KNOW more.
Pssst… your knuckles are turning white from clenching your pearls so tightly…
September 24th, 2009 at 11:46 amt5 wants to act like he has a say in any of this.
t5 wants to pretend that democratic senators don’t have the right to ask questions.
t5 is just a petty loser who want nothing more than to stop what has begun and shows no sign of stopping, the progressive movement in America.
t5 is a liar and a sore loser and a whiner.
September 24th, 2009 at 11:47 amThe wingnuts who are so afraid that Obama and Franklin are taking their Freedoms seem to have no problem with the Patriot Act. Surreal indeed.
September 24th, 2009 at 11:47 amTracy__5 says:
When someone like Franken has to be explained the precedent by multiple courts has proven this to be false one has to assume Franken has some homework to do.

September 24th, 2009 at 11:47 amcarrying a massive chip on your shoulder re: al franken
is a pretty weird thing to do.
why tracy?
did he beat you in wrestling back in the day?
September 24th, 2009 at 11:48 amoh god, I forgot his cliam to be an architect. It cracks me up when I envision him with a broom in his hands.
September 24th, 2009 at 11:49 amseems like tracy takes offense
to senator franken’s respect for the constitution.
would he also bag on tino scalia,
for reading from the nation’s charter?
strict constructionism is only ok for radical right judges?
doesn’t make ANY sense – tracy’s definitely off-the-rails.
prescription abuse? maybe. it’s at epidemic proportions.
September 24th, 2009 at 11:50 amGeez.T666 sure has her/his drawers in an uproar today.
September 24th, 2009 at 11:53 amWonder if T666 is in trouble for another shoddy building.
If you can’t handle things T666, you can get some med’s for that.
Because me thinks Franken is going to cause right-wing hypertension systems.
Or rambling screeds like T666 just posted.
tony and lido
I must give Tracist kudos for his energetic performance today. Not only did he set a new standard for troll hysteria and incoherent dervishness, he had to do it all while forcefully misrepresenting the nature of the Senator’s questioning.
That’s not elementary-level trolling, folks. That’s high-school level at least.
September 24th, 2009 at 11:55 amthere he goes….
tracy’s rockin’ the Pee Wee,
and frantically looking for an exit…
won’t be long now.
September 24th, 2009 at 12:02 pmBesides, I thought that tighty-righties like Tracist were in favor of the concept of “citizen legislators”, that is , people who were NOT professional politicians who run for office and serve for a limited time, and then return to their lives?
Wouldn’t folks like that have to “learn on the job”? Isn’t that what term limits are all about?
September 24th, 2009 at 12:04 pmpoor little tracist, too stupid to think for itself, has to rely on the radio to tell it what to think
must be sad to be so ignorant, fearful, and dishonest
September 24th, 2009 at 12:05 pmit is very fun to watch tracist getting its a$$ handed to it here every single time it posts
here’s a hint, tracist: don’t enter a battle of wits when you are so woefully outgunned
of course, maybe tracist is a masochist that simply enjoys being beaten by its intellectual superiors
September 24th, 2009 at 12:07 pmHoiw is it possible that Tracist not only copied-and-pasted but even went to the trouble of bolding the phrase
particularly describing the place to be searched, and the persons or things to be seized
and then goes on to pretend as if it weren’t there?
I really don’t understand how the tighty-righty mind works.
September 24th, 2009 at 12:07 pmHere’s a tip, Tracist; if you’re gonna accuse someone else of being “dumb”, you might wanna proof-read your comment being hitting “Submit Comment” to avoid looking stupid yourself.

September 24th, 2009 at 12:14 pmI just think it’s hilarious the way Al Franken bothers people like Tracy. It’s just what I was hoping for when Franken won his election. If a little loser like Tracy is getting this hot and bothered, O’Rielly’s head must be exploding.
September 24th, 2009 at 12:17 pmpoor little tracist
not satisfied with everyone assuming it’s an idiot, it continues to post in order to confirm it is
September 24th, 2009 at 12:17 pmtracist is too stupid to even recognize the intellect of Al Franken

why are you such a pussy, tracist?
September 24th, 2009 at 12:20 pmtracist keeps getting owned, but is too stupid to recognize it
it IS highly entertaining, though, and it demonstrates to all that read the typical right wing ignorance and cowardice
September 24th, 2009 at 12:22 pmwow tracist, you really are very stupid
why are you such an ignorant pussy?
September 24th, 2009 at 12:24 pmtracy stayed at a holiday in express last night,
where he was reading tino’s autobiography,
so that means he’s a constitutional scholar now, and we should all totally respect that.
September 24th, 2009 at 12:26 pmtracist is either very ignorant or very dishonest
I’m leaning towards tracist being both
so tracist, answer the question: why are you such a pussy?
September 24th, 2009 at 12:26 pmtracist believes anything the radio tells him to believe
tracist is just that stupid
tracist still won’t explain why it’s such a coward
September 24th, 2009 at 12:28 pmTracist 5 (your IQ):
FLAGGED FOR FLOODING!
September 24th, 2009 at 12:28 pmSenator Al Franken has got Tracy in such an hilarious snit, that poor Tracy simply can’t make sense. Here’s a great example of Tracy’s confusion:
First, he re-types the Fourth -
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
Then, hilariously, he types this:
“So where does it say in the 4th Amendment that the person or place has to be identified by name?”
Tracy, darling, what do you think this means: “…particularly describing the place to be searched, and the persons or things to be seized.”?
Do you think this may mean “some swarthy guy” or “some fat, bald guy”? Most of us think it means naming the suspect.
September 24th, 2009 at 12:28 pmNope. You’re just the guy who holds and incomprehensible grudge against al franken for reasons you won’t explain and no one can understand.
I appreciate the difference.
September 24th, 2009 at 12:29 pmPointing your finger at the sky and making “pew! pew!” noises doesn’t count, Tracist.
September 24th, 2009 at 12:29 pmi’m afraid tracy’s gone beyond the puppy principle, and hass skipped right past catching squirrels (maybe the other pups are just too much faster?) to dragging chunks of roadkill home and claiming they’re the “big game” he “stalked for days” and “fought valiantly” with.
puppies are fun, but they shouldn’t play with carrion.
ick.
i’m sorry.
September 24th, 2009 at 12:32 pmTracy: “You are in the same boat as Franken i.e. it went down in that committee hearing. The others in the room were obviously laughing at Franken’s ignorance.”
And, you’re sure that’s why they were laughing – Senator Franken’s ignorance. Hooooookaaaay. Tracy dear, don’t you think there’s a possibility that they were laughing at Franken’s humorous way of pointing out the absurdity of a given law and the way an official was flummoxed by his questioning. Unlike you, I can’t read peoples’ minds, but I’m guessing there may have been other reasons for laughing besides the perception of a Senator being ignorant.
September 24th, 2009 at 12:33 pmGood for AL!!!! Our entire Bill of Rights is under attack from the big government, globalist scum in Washington.
Now let’s reisntate the Posse Comitatus Act, repeal the Patriot Act, repeal HR6166
It’s time for the Democrats to take charge and become the party of the people. Let’s squash the Neocons and Federal Reserve!
September 24th, 2009 at 12:34 pmYow. By my count Tracist is responsible for 33 of the first 120 comments in this thread.
While it doesn’t approach troll jay’s record of over 40%, it’s still impressive — and still reveals a serious hard-on that Tracist must have for Senator Franken.
September 24th, 2009 at 12:34 pmBut what about Crazy Shelly, T?
Do you think Mittens will ask for her hand in candidacy?
Who do you think will win – Mittens or Sarah?
September 24th, 2009 at 12:35 pmTracist with the mentality of a 5 year old, your stupid amuses me. It’s a wonder why all of us point and laugh at you. Trolls like you are worthy of being smacked around like a punch doll. So were you born stupid or did the yakkers at screechmonkey AM hate radio make you that way? I think it’s both. It’s so amusing you entertain us with your clown show by regurgitating the lies screechmonkey radio tell you to regurgitate from your rotting little twat. Keep up the stupid. You’re very good at it.
But then again, even a five year old has more intelligence than you.
**DISCLAIMER** No 5 year old children were harmed in the making of this post.
September 24th, 2009 at 12:35 pmso tracist still refuses to explain why he is such a pussy
and, btw, tracist, I ride a Honda because I got tired of fixing my Harley
The Honda is a MUCH better bike
If you weren’t such an ignorant pussy, you might know that
September 24th, 2009 at 12:36 pmXisithrus says:
Obtuser T5: I want big brother gubyahmint.
I can pretty much guarantee that T5 would scream bloody murder if he found out that the government had caught him in one of those roving wiretaps.

wow tracy
everthing about you has really deteriorated over the last couple years.
Yeah, remember back when he could provide impassioned arguments for economic libertarianism? Now he’s reduced to mere character assassination. It’s sad to watch our trolls degrade like that.
.
Tracy__5 says:
When someone like Franken has to be explained the precedent by multiple courts has proven this to be false one has to assume Franken has some homework to do.
If that were the case, then Kris should have been able to describe the legal argument that the DoJ provided to said courts, yes? The fact remains that he was unprepared for the subcommittee hearing. It’s the job of the person being questioned to bring their homework to class.
September 24th, 2009 at 12:37 pmTracy__5 says:
Why are you a wann-be biker riding a pussy ass Honda?
Why are you a childish republican riding a girlie anonymous alias on a blog and whining like a child?
September 24th, 2009 at 12:37 pmWhen the Constitution states: “…particularly describing the place to be searched, and the persons or things to be seized,” Tracy interprets that as “hey, we think there may be some swarthy guy in there up to no good so we’d like to listen in on all his and anyone else in the houses conversations.”
That’s one of today’s “anti-big government” conservatives for you!

Senator Al Franken makes their heads explode.
Exactly what I was hoping for.
September 24th, 2009 at 12:39 pmwe should leave T5 alone,
all this abuse will only result in some McDonald’s counter person getting berated by him later today, and that’s not cool.

Hey, maybe THAT’S what they were all laughing at, Tracy!

Big Pharma wants you to try it, Tracy. It will make you feel better all the time. And, isn’t that what you want? To support big Pharma.

September 24th, 2009 at 12:45 pmTracist,
A warrant must specifically list the people to be seized if that’s the goal. It’s why in all of the cop shows they say “I have a warrant for your arrest”. If law enforcement has evidence that a place might involved in a crime, then the place is searched.
However neither of those can be search without probable cause, and being a minority isn’t a cause despite your natural racism and low class.
September 24th, 2009 at 12:46 pmpoor little tracist’s ideology depends on his not understanding things
if tracist weren’t such a pussy, he’d be able to handle exposing himself to the facts
alas, he’s too much of a pussy to even explain why he is such a pussy

But hey… you’re an ARCHITECT!!!!
September 24th, 2009 at 12:48 pmTracy__5 says:
Do you think this may mean “some swarthy guy” or “some fat, bald guy”?”
Yeah it’s called describing the suspect. If a name were to be required then it would have said “name” not “description” Again if a name i.e. the identity of a person were to have to be established prior to a warrant to be issued then FISA rule about phone taps being legal 72 hours prior to the warrant being issued the authorities all over the country have broken the law thousands of times.
You do realize that there must be probable cause to search a specific place, or search for a particular person right?
You’re probably too ignorant to realize this law came into place to prevent the british army for using a description of someone to go search every house they wanted.
You should spend more time reading history, and less time reading your radical rightwing whining rant sites.

Can you think of a more legitimate or precise way of describing a suspect than to name him? What would that be exactly?
September 24th, 2009 at 12:51 pmPerhaps T5 can show us where the US Supreme Court has struck down the 4th Amendment to the Constitution as unconstitutional. I really don’t remember that happening. And until it does happen, the 4th Amendment stands.

tracist thinks maintenance has anything to do with a poorly designed, and even more poorly manufactured machine
I do all the maintenance on all my bikes. I prefer to ride the ones that don’t have problems related to poor design and poor production
If you think Harleys are made or designed as well as Hondas then you are even stupider than we thought
Of course, you’re not even man enough to ride a Vespa, so you better stick with getting your mom to drag you around in the SUV
You’re still too much of a pussy to answer the question

OK, now I think I’ve got it. Tracy is an expert at fixing motorcycles. THAT’S why we should take his word for it that the Honorable Senator Al Franken is “ignorant.”
Not to mention the stupidity of claiming that only a Harley is a “real bike.” Every Harley owner I’ve ever known has had to spend a significant amount of time on “maintenance”, time that a Honda rider would have spent . . . riding.
Harley Davidson makes a much better bike today that requires less “maintenance” than previously, but only because they were competing against Honda, Suzuki, etc and realized they were going down the toilet unless they addressed reliability issues. Kudos to them for following through; the American auto manufacturers should have paid more attention to HD.
September 24th, 2009 at 1:02 pmt5, you just keep posting. It is great data for showing how ignorant the adovcates of the right are….

“If that were the case, then Kris should have been able to describe the legal argument that the DoJ provided to said courts, yes?”
He did. If you didn’t understand it then you must be confused like Franken was.
Hey idiot, that’s not the answer Franken was looking for.
I have one you.
Q: What is the difference between a vacuum cleaner and a Harley Davidson?
A: On a Harley Davidson, the dirtbag (Tracy_5) is on the outside.
September 24th, 2009 at 1:05 pmTracy_5
Explain to us how you get probable cause to search something you can’t name or locate?
You’re an idiot. The fact that you don’t realize it is even more pathetic.
September 24th, 2009 at 1:05 pmjust make fun of the ignorant troll. He’s thriving on the attention.
September 24th, 2009 at 1:07 pmhey gumble, you forgot to mention that the Honda VTX (my main bike) is built in Ohio, by Americans
and, while modern Harleys are a bit better than their ancestors, they still overheat, break down, and rattle apart
Harley is a name brand, aimed at people that are more worried about a name plate than quality
I put far too many miles on a bike to have to keep fixing it
Most Harleys are garage queens
Tracist is just an ignorant pussy, as gets proven here every time he posts
September 24th, 2009 at 1:08 pmTracy, your irrational hatred for Senator Al Franken has got you arguing that the Founders would have been fine with the government randomly going around through neighborhoods spying on citizens without warrants.
Do you know anything about the Founders’ thinking? Do you really believe this was their intent? If so, can you point to any statement or policy by anyone who signed the constitution to support that position. Because, I don’t think there are any supporting arguments and I think that’s one of the obviously unconstitutional parts of the Patriot Act.
Moreover, Al Franken has been talking about the unconstitutionality of the Patriot Act since it was passed.
September 24th, 2009 at 1:08 pmtracist is scared of my Honda

And we think he is somewhere in the city so we want a search warrant for every building in the city. Well,except your house. Thanks, Your Honor.”
September 24th, 2009 at 1:12 pmRantingTommy, I have to say that if I were to buy another bike, it would probably be a Beemer. If not, it would be another Honda.
Years ago, I knew a guy with a Sportster that I loved — because whenever he had it in the garage, his girlfriend was over at my place. We spent a lot of time together.
September 24th, 2009 at 1:12 pmtracist thinks a motorcycle is a fashion statement
Harley makes more clothes than they make bikes
I’m not the first rider to dump a Harley for the much better Honda, and I certainly won’t be the last
why pay more for something that won’t last? I guess if I rode like a pussy, the Harley could keep up, but I don’t, so it won’t
September 24th, 2009 at 1:12 pmYour post at 179 proves my point precisely.
A warrant requires that you identify a person or location to be searched. That doesn’t mean you need a name, but you do need a specific person or place. A roving wiretap does not cover a specific person or place, therefore, there can be no probable cause because there is no person or place to have probable cause on.
My god you’re stupid. It’s incredible that you’ve even figured out how to post a comment. I’m surprised you figured out what those funny looking pictures on the keyboard are.
September 24th, 2009 at 1:12 pmThe facts are in evidence.
All that needs answering is “why”.
So, why are you such a pussy?
September 24th, 2009 at 1:13 pmI’mm off to work people. It was fun playing Smack-a-Troll™ today.

September 24th, 2009 at 1:16 pmyeah, gummble, I like beemers
I’m looking at getting another r1200, but I may go with the gs1200 rs adventurer
I had an rt1100 years ago, sold it to make room for the Shadow that preceded the VTX
I won’t give up the VTX, it really is a badass bike, but now I got room for another one
BTW, I have a Nissan 350z for sale, cheap, low miles
September 24th, 2009 at 1:17 pmI’m only selling it because I never drive it and I can’t justify the payment/insurance
actually, pussy boy, I ride at least 25,000 miles a year, in any weather, including the ATL floods this past Monday
no Harley can handle that much riding without falling apart
you keep pretending it will, I’ll keep laughing at you
you’re a pussy, why?
September 24th, 2009 at 1:19 pm’cause everybody knows that
“real bikers”
are mostly fictional architects (and orthodontists)
September 24th, 2009 at 1:19 pmYOU provided the evidence, we didn’t have to
now answer the question, pussy
September 24th, 2009 at 1:19 pmI’m a little confused by the focus on person on this thread. It seemed to me that Franken was referring to the Fourth Amendment language related to “place” and the obvious fact that a “roving wiretap” is clearly in violation of that.
September 24th, 2009 at 1:20 pmwell, we are glad that you have managed to put your Lincoln Logs back in the box after you’re done playing architect so no one trips over them and hurts themselves
now, if you could just be trained to go on the paper…..
September 24th, 2009 at 1:24 pmTracy: “Sometimes the arrest warrant lists the accused person as unknown, because the alleged felon has aliases he uses. That is why the proper procedure for the felony arrest warrant calls for a reasonably definite description of the accused.”
Poor Tracy. He’s hopelessly over his head here. He doesn’t seem to understand the difference between a search warrant and an arrest warrant.
But, he IS all fired up over the thought of SENATOR AL FRANKEN!
September 24th, 2009 at 1:25 pmI can tell you one thing for certain: Senator Al Franken is totally under Tracy’s skin.
Keep it up, Al! Great work. There must be tens of thousands of lamebrains out there just tearing their hair out.
September 24th, 2009 at 1:27 pmWow! Tracy told me that the 4th Amendment to the Constitution of the United States of America is Marxist!
September 24th, 2009 at 1:29 pmPoor Tracy. He’s hopelessly over his head here. He doesn’t seem to understand the difference between a search warrant and an arrest warrant.
But even in that confusion, he still supported Frankin’s argument – that even in an arrest warrant where the person is not explicitly named, the person must still be identified in some substantive way. You can’t just have an arrest warrant that covers everyone.
September 24th, 2009 at 1:32 pmMaybe not, but it sure sucks to get rained on when you are indoors.
September 24th, 2009 at 1:32 pmI don’t think Tracy’s an architect. I think he’s an adolescent that read “Atlas Shrugged” a few years ago and has never gotten over it.
September 24th, 2009 at 1:33 pmTracy_5
Okay. Here’s why you’re a moron:
1) An arrest warrant is NOT the same thing as a search warrant.
2) Even when someone is not explicitly named, they have to be identified.
3) Probable cause cannot be attached to nothing, which is exactly what warrants for roving wiretaps attach it to.
Are you seriously this stupid? I just have a hard time believing that anyone can be this retarded.
September 24th, 2009 at 1:33 pmTracy, calm down, dear. You keep talking about arrest warrants here and the issue is search warrants. You do know the difference right? Try breathing into a paper bag.
September 24th, 2009 at 1:34 pmAccording to Tracy, they could have “roving arrests”, where they don’t even need a warrant. They would just go into an area and arrest everyone. The courts could sort it all out later.
September 24th, 2009 at 1:36 pmpoor little tracist
he thinks republicans are correct
he thinks Harelys are dependable
he thinks insurance companies care about people
he thinks Al Franken doesn’t know the Constitution
but he does demonstrate to everyone that reads this blog just how ignorant and cowardly one has to be to be a right winger these days
and he still won’t tell us why he’s such a pussy
September 24th, 2009 at 1:38 pmTracy is the Timex watch of trolls.
September 24th, 2009 at 1:43 pmYou left out a few things Tommy:
he thinks politicians should not have political science degrees
September 24th, 2009 at 1:43 pmhe thinks the 4th Amendment is Marxist
he thinks people should be taken into custody at random, in roving arrests
T5, tell us when you have ever been right about anything.
Just one prediction of yours that was even remotely close to what actually happened.
I’ve never known you to be right, why do you think you matter to anyone here?
September 24th, 2009 at 1:43 pmDon’t be so fu(kin’ stupid. How in the hell do you “describing the place to be searched, and the persons or things to be seized” without naming them? Goddamn you really can’t be that ignorant or stupid. “A black man in a white shirt somewhere in North America.” just doesn’t pass mustard for a warrant (nor should it dickhead). “Phil Smith at 1313 Mockingbird Lane in Bumpkin, MO, is suspected of planning to bomb a Federal Building. We want to look for bomb making equipment and materials at that address.” is valid.
Now grow the fu(k up already.
September 24th, 2009 at 1:48 pmOkay, I’ve got things to do. I can’t take anymore thick-headedness from Tracy_5.
Good luck, my fellow troll-whackers. I bid you all a (temporary) adieu.

September 24th, 2009 at 1:51 pmThen why do you run away from my question? Everybody here thinks you are a coward. You make it easy to come to that conclusion when you dodge other peoples questions.
tell us when you have ever been right about anything.
September 24th, 2009 at 1:55 pmI’ll be back after you have left t5 to call you a liar long after you post your last inane post.
September 24th, 2009 at 2:05 pm“Committee member Sen. Al Franken (D-MN) used his question-and-answer period to investigate the provision that authorizes “roving wiretaps,” expressing concern that the law does not require federal authorities to identify the target with specificity before proceeding with surveillance.”
Tracy: “the Patriot Act specifically says that an accurate description or the person or place must be given.”
Yes. An accurate description OR the person OR place. How can the government guarantee that when they’re using a “roving” system? That’s one of the constitutional questions here.
September 24th, 2009 at 2:09 pmpoor little tracist, I have a CBR1000RR in addition to my VTX13000c

Owned a Harley for 17 years and was constantly working on it–not just maintenence, but repair and replacement.
Harley Davidson is a status symbol and no more. If I was putting miles on a bike, it would be a BMW or Honda–they are much better engineered.
I know you don’t care troll, but you’re certainly persistent!

Perhaps, if Kris explained the precedent. He did not. He was clearly dodging a question he could not answer.
Maybe you don’t understand how Senate committee hearings work. The Senators ask questions, and the people being questioned answer them. If they can’t answer them, then it highlights their inability to properly do their job. The Senators don’t have to answer squat.

Apparently you haven’t reviewed the relevant case law on the matter. You can’t get a warrant of any kind based solely on the description of a person. You just can’t. And as for “after-the-fact” tap warrants, if the warrant is not issued, the recordings have to be destroyed as if it never happened.

Tracy__5 says:

I haven’t seen a single report anywhere claiming it went that way. All of the reports of the exchange say it went the other way. Were you in the room? No.
Once again, you’ve got nothing upon which to base your outlandish claims.

September 24th, 2009 at 3:08 pmmaybe someone handed them a cartoon drwg to go by and they actually did it the way it was drawn…..That’s my guess.
September 24th, 2009 at 3:15 pmThis guy (t5) sure is persistent. Strange that an ‘architect‘ has so much time on his hands that he can spend it here making inane statements, arguing about m’cycles, and generally acting like a five-year-old.
His idea of discussion is ‘I got you last’–just like a five-year-old.
Shameful.
September 24th, 2009 at 3:22 pmYou just proved that you don’t know what you are talking about. I knew you were no architect.
Contractors work the part of the job you’re talking about directly from the A&E dwgs. Shop dwgs are for structural steel.
You’re a phony, as if we didn’t already know that.
September 24th, 2009 at 3:34 pmnot phony Fred – that assumes planning and plotting.
T5’s just a boob on a jihad.
September 24th, 2009 at 3:40 pmSo, all the floors are clean?
September 24th, 2009 at 3:42 pmTracy will never learn. He always keeps it up until he gets caught in his own lies.
September 24th, 2009 at 3:44 pmshop drawings imply a shop is involved, the point you don’t seem to understand. Why would a fire alarm company need shop drwgs? All the rest of what you mentioned is stuctural steel department…
You’re an idiot. Just making up numbers and pretending to know what they mean doesn’t mean anything.
For your edification: Division 5 varies by company. You expect me to know what division 5 of your company covers?
You can’t embarrass me. I actually do work in the field.
September 24th, 2009 at 3:46 pmT5: RT set a time and place – two or three times you attempted to move time and place. RT even gave you an advantage: a link to himself on his bike (thus recognition).
September 24th, 2009 at 4:06 pmT5 you are hollow.
Tracy: “You asked for an address and I said I am usually here…
http://www.allenbowl.com/
….on Friday nights?”
I actually get to Texas at least once a quarter. How will I know you and will you be prepared to go to the parking lot for a fight without weapons? I’d like to kick your ass.
September 24th, 2009 at 4:14 pmOK, Tracy, I’m serious. I just talked to one of my techs and he’s going with me on a trip to Texas on Wed. and Thursday, 9-30 and 10-1. He will accompany me to Allen on the 2nd, which is a Friday night, and he will tape the entire “encounter.” I will introduce myself to you in the Bowling Alley and on the tape in the parking lot as “Ninerfan” and refer to you on tape as “Tracy5″. I will then post the video at a web address to be determined and let everyone on these boards know where they can go watch it.
I need to know that you will be there on the night of October 2nd and how to recognize you. I’m not going to come into your territory with a Niner jacket on or something like that. It’s your territory, so you need to tell me how to recognize you or who to ask for at the desk or something like that.
September 24th, 2009 at 4:24 pmso you can run out the back door?
September 24th, 2009 at 4:25 pmOK, I’ll ask for Tracy at the front desk. I should be there some time around 8:00. I’m going to have my tech tape me asking for you as well, so if you’re not there, we can show everyone a tape of me walking around the bowling alley asking for you.
September 24th, 2009 at 4:26 pmYou’re not talking to mommy, we all read it.
September 24th, 2009 at 4:29 pmBoy, tracist is sure a’skeert of Al Franken!!
Soaked yer Depends yet, tracist? Or maybe you’re on your third one of the day!!
*snicker*
September 24th, 2009 at 4:33 pmt5 finally found the threshold where he couldn’t stay in the fire. Someone pinned him hard and he ran like a little coward.
September 24th, 2009 at 4:42 pmwhat’s that sound chickens make?
September 24th, 2009 at 4:44 pmYou know, this almost sounds as if Tracist doesn’t want a video record of any encounter (or lack of one) because such a record would preclude his heretofore favored tactic of claiming that everyone else chickened out.
September 24th, 2009 at 4:45 pmWe all knew you would find a corner to hide in t5, no big deal. If you’re truly afraid of being arrested maybe you could explain the logic.
This is between you and a lot of us but we have seen trolls back out already this week. You’re doing it comes as no surprise.
September 24th, 2009 at 4:46 pmget over it t5, you guys always talk tough until it comes down to nut cutting time and then you are no where to be found.
known commodity. coward of the 5th degree.
September 24th, 2009 at 4:48 pmwould an architect use the word too incorrectly?
September 24th, 2009 at 4:49 pmseems logical that t5’s hero’s are all chickenhawks doesn’t it?
irony again? I say yes, yes, yes!
September 24th, 2009 at 4:50 pmTracy, if we don’t film this thing, how is anyone ever going to know what happened? That’s the point. To get beyond words here. It’s between me and you and my guy will stay way back. He’s a pussy. He’s just there to document. I won’t do it if we can’t document it and have a good laugh afterward. If it makes you feel better, you can have a friend film the thing as well. I don’t care. But, I would rather come find you in public before our encounter so I’ll come to the front desk and ask for you.
September 24th, 2009 at 4:51 pmBecause I will bet the 1000 dollars that aaronk owes me that you will be a no show.
September 24th, 2009 at 5:03 pmnegotiation without preconditions is bad.
don’t you remember anything, T-baby?
September 24th, 2009 at 5:03 pmYou just keep dancing t5. You will get away, but just like the chicken who escapes the fox, you will lose some feathers.
September 24th, 2009 at 5:05 pmi wouldn’t set foot in TX for love nor money.
hell – the woods of southeast kentucky would be safer.
you’re just a crazy boob jihadi, T5,
and the way you’ve spent your day here is hilarious to me.
September 24th, 2009 at 5:08 pmIs it just me, or does this sounds like a girly “well if you don’t know what you did then I’m certainly not going to tell you” dodge or what?
Tracist is just sinking deeper and deeper into an embarrassment swamp.
September 24th, 2009 at 5:14 pmt5 will allow a bunch of eye witnesses but not a camera.
What will be your excuse when Tommy agrees to that?
308, If I were you, I wouldn’t go bowling for a while.
September 24th, 2009 at 5:16 pmHmm… so Tracist refuses to allow a camera to videotape any encounter because he’s concerned about getting arrested.
Yet he’s willing to invite others who might prove to be “reliable witnesses”.
Doesn’t really sound to me like Tracist is that concerned about any possible arrests.
Sounds to me like he’s desperate to maintain a “his word against their word” kind of situation.
A video record would remove a lot of doubt. Tighty-righties, as we know, thrive on doubt.
September 24th, 2009 at 5:17 pmTracist, I’m not really inclined to travel to a bowling alley in Allen, Texas.
That’s why I for one would appreciate a video record. See, that way, I won’t have to decide who’s telling the truth when your account differs in significant ways from NinerFan’s, or Tommy’s or whoever else shows up to shame you face-to-face.
Do you really think that two sides would agree on key details, or even broad descriptions in a situation like this? Hell, the teabaggers still claim 2 million showed up in Washington two weeks ago. AND there’s video record of that false claim.
September 24th, 2009 at 5:23 pmSpeaking of wagers…
Small question… did you manage to read, ‘Against all Enemies’ yet, Tracy?
We were gonna discuss it in August but I never saw you…
September 24th, 2009 at 5:26 pmT5 sys: “You don’t need to document it for any other reason than having me arrested or trying to sue me. Either show up without your little preconditions or don’t.”
September 24th, 2009 at 5:00 pm
September 24th, 2009 at 5:29 pm~~~~~
Paranoia runs deep in this one.

Tracy__5 says:
Well, Tom bailed as suspected. Fred?
September 24th, 2009 at 5:10 pm
~~~~~
T5 – twisting and turning in the wind. You forget it’s all written in this thread and you are a loser. No matter how you try to push it back on anyone else – you own the losing side.
Maybe you forgot but I would be looking over my shoulder for a while if I were such an ignorant thug as to brag about how tough you are on the internet and then actually give directions as to how to find you(if you did’t lie about that).
I mean how piss ignorant do you have to be, really?
September 24th, 2009 at 5:30 pm
Tracy__5 says:
Doing what BTW? OK how about early Saturday morning the 3rd? I have a plane to catch back to Dallas at 10 a.m. EST.
“Hi, my name is Tracy__5. I work construction, and I’m looking for strong liberal men to come over to my place and discuss politics.”
Seriously, knock it off already. You should be posting here instead.
September 24th, 2009 at 5:33 pmNot yet. Hope you don’t mind waiting.
Nahh, kinda figured, I can see you’re busy planning brawls or whatnot.
Carry on.
September 24th, 2009 at 5:34 pmShifting excuses… not a good sign.
Tracist, no one here is thrilled with the prospect of your mug plastered all over the internet, either. If your face reflects your spirit it’s gotta one ugly scene.
But what are you planning on doing that you would make the 10 o’clock news?
September 24th, 2009 at 5:35 pmTracy: “You don’t need to document it for any other reason than having me arrested or trying to sue me. Either show up without your little preconditions or don’t.”
Let me get this straight. You want me to walk into a dark parking lot in your territory at 10:00 on a Friday night and stand next to a donations box. And, you don’t want any witnesses. And, you have a problem with my “preconditions?!” Man, I’ve got no preconditions. I already know you’re a low down dirty rat. You think I’m going to go into your house at night with no witnesses? Unbelievable. We’ll still be in your neighborhood at the end of the month. I’ll check back before we leave on that trip. My tech is already getting cold feet on this and I can’t force him. Your strange reluctance to allow witnesses just makes him more jumpy.
September 24th, 2009 at 5:36 pmUm, excuse, me, but I never made any kind of physical threat or challenge that would require me to travel to a bowling alley in Allen, TX. I think these things where people show off their web muscles are pretty silly. But in this case, I think it’s especially amusing how Tommy and NinerFan are calling your bluff and revealing how empty it is.
September 24th, 2009 at 5:39 pmAnd you insist on NO CAMERAS.
Why should HE accept YOUR preconditions?
September 24th, 2009 at 5:51 pmFace it, Tracist…. anyone who is afraid of a video record of an encounter… has something to hide.
We figure, based on your body of work here, that what you seek to hide is your cowardice. Unfortunately, you don’t realize that it’s already common knowledge.
September 24th, 2009 at 5:53 pmYou guys all know that in the end Tyler Durden turned out to be made up, right?
And that there never was any ransom money paid out for Bunny Lebowski?
Just thought you should all know that before this ‘dumb bell in the tumbleweeds’ thingy happens…
September 24th, 2009 at 5:53 pm“bailed”, as in stuck to a lonstanding matter of personal principle?
sure boob.
good luck on the jihad.
September 24th, 2009 at 5:56 pmpretty good dancing. Same way limballs does it, ie cherry pick.
you trying to be the new tom delay
September 24th, 2009 at 5:56 pmTo my “benefit”? WTF does that mean?
Unless I’m reading you wrong, your response to my lack of enthusiasm for a trip to a bowling alley in Allen, Texas was a thinly veiled reference to some form of cowardice, the same thing you’re accusing those who you say refuse to show up to challenge you.
Am I reading you wrong?
What else is, “Well we already knew that….no matter what the circumstances were.” supposed to mean?
Tracist, your opinion of me and my status as an internet tough guy is really of less interest to me than Glenn Beck’s opinion of Dancing With the Stars. But I do like to make sure I’m reading comments accurately.
September 24th, 2009 at 5:59 pmI wouldn’t get myself in a pissing match on an internet forum and challenge someone I’ve never met, whose real name I don’t even know, to come to my home town bowling alley and meet me in the parking lot, in the first place.
But since you were stupid enough to do that, you must have something to prove. Since you have something to prove, a video record of the encounter seems the least disputable way to establish proof.
Yet it seems that you cultivate a measure of disputability without having the balls to acknowledge it.
September 24th, 2009 at 6:02 pmSo you say.
But if NinerFan shows and you don’t, and he says you didn’t show but you claim you did, all we will have his his word against yours.
Which seems to be the way you want it.
September 24th, 2009 at 6:04 pmSo is that an answer?
You were calling me a coward for not wishing to travel 1500 miles on a Friday night to witness some internet-generated rumble, even though I never issued any kind of threat or challenge?
Sorry, but your answer was a little cryptic, as yours generally tend to be when someone asks you a direct question.
September 24th, 2009 at 6:06 pmThat does it, I’m flagging all this crap. Reason: “using TP to arrange personal meetings”
September 24th, 2009 at 6:11 pmUm, yeah… no matter what they said to me.
See, I’m not stupid enough to think that the real people behind these anonymous screen names are necessarily anything like the personalities they portray.
And I long ago got over the schoolyard tough guy dance where an insult, whoever cutting, is always best handling through physical violence.
What you’re so deep in right now? It’s childish. Yeah, it’s childish on Tommy’s part too, but you’re the one who’s making these elaborate arrangements and setting preconditions and giving directions to your hometown bowling alley based on the illusion of the mean liberals on a blog who said something mean to you.
If you could see how foolish you look…
September 24th, 2009 at 6:13 pmHow about these Reasons:
“It’s incredibly juvenile.”
‘and cliched.’
‘and stupid.’
‘really stupid.’
September 24th, 2009 at 6:14 pmYes, they CAN be, but what happens when they’re not? Is this the same kind of conservative thinking that said “oh, the oil revenues will pay for the Iraq War? What could go wrong?”
Yeah. I’m gonna leave my wife and spend the money to travel 1500 miles on a Friday to stake out a bowling alley in Allen, Texas because I’m “truely (sic) interested” in whether a rumble between internet tough guys ever takes place.
That makes a lot of sense.
Nah, the simplest solution to remove any possibility for dispute is to let someone videotape the encounter if it happens.
You have some real problems with that solution, which makes me think your real purpose is to preserve the ability to dispute someone else’s account. it’s the only explanation that makes sense. (And I don’t mean “Tracist sense”.)
September 24th, 2009 at 6:18 pmTracy: ““Man, I’ve got no preconditions.”
BS. You insist on video taping it.”
Tracy, documenting our encounter isn’t a precondition. It’s a necessity. Our encounter will be filmed from a distance of at least 20 or 30 feet because my guy tells me he will not get any closer to you than that. He thinks I’m going to get shot. From that distance at 10 in the evening, your face will not be plastered all around the internet and you know it. So, your problem is a non-problem. My problem, which I think is more important, is that I don’t want to get murdered. It’s your neighborhood. That’s what I meant by “your house.” The video is for my protection and my enjoyment. If it’s a fair fight, nobody has a case in court anyway and you know it – especially in fricking Texas!
September 24th, 2009 at 6:19 pmTwacie:
And to think I called this juvenile…
‘Look at all the other kids who are messing around! If you tell on me, I’ll so tell on you!’
September 24th, 2009 at 6:20 pmAh, but YOU issued a challenge for someone to meet you, and there is no evidence that you showed up as appointed.
I never made such a challenge. See the difference?
Obviously, you have a problem with direct answers to direct questions.
That could be a cognitive problem or an emotional problem. there’s evidence to support both, but I’m gonna go with an emotional problem for now, given your inability to control yourself when confronted with other internet tough guys.
September 24th, 2009 at 6:21 pmYes. Tell me, Tracist, what does they matter, the taunts of an anonymous poster on an internet blog?
To me, they’re insignificant, especially since anyone launching such an insult doesn’t even know my wife or my family. They’re just reacting immaturely to some imagined provocation on an internet blog.
If you think that’s important to deal with… then it explains a lot about your behavior here.
I have no interest in taking sides, but having come back to this thread after a few hours running errands I must say there is a WHOLE LOT of dick wagging around here.
I remember an incident some time back where a TP commenter claimed that he’d met a challenge at some gym (in Texas?) and that his challenger didn’t show up. A phone call to the gym established that the blowhard (who happened to be a troll) had never been there.
That could be why someone insists on video, I dunno. Everyone could wear masks!
But, serious, a lot of dick-wagging.
September 24th, 2009 at 6:30 pmLet’s review… Tracist first said that he didn’t want a videotape record because of the possibility NinerFan would use it to have Tracist arrested.
Now Tracist scoffs at the notion that a videotape record could be in any way used as protection.
Shall we spell it out for Tracist?
Suppose the presence of a video camera inhibited some otherwise criminal action on the part of the one being videotaped? Could that be a possibility?
Ya think?
September 24th, 2009 at 6:36 pmWhy? Will some indisputable evidence from that past encounter surface somehow? Are you keeping it classified like George W. Bush kept his father’s presidential papers classified?
So… does that mean you see the difference? You never actually have the balls to say what you mean. Always cryptic and incomplete. I guess that works for you.
Please point out where this assumption of yours is “according to me”.
Or did you use language improperly again? You seem prone to a fairly common conservative habit — choosing words based not on what they mean, but rather on what emotions they can generate.
Again, I guess it works for you somehow. Being understood by others doesn’t seem to be a high priority for you.
September 24th, 2009 at 6:42 pmAgree to Twacie”s demand for no camera
I have a nice 400mm lens for my Cannon and would
Tracist thinks that “witnesses would give the same result” as a videotape record.
Tracist lives in a dream world.
But then, we knew that.
September 24th, 2009 at 6:49 pm“Lost Calls (’please dial that number, again!’)”
Cell phones are essential, and can sound, unexpectedly(”adjust me!?”)!
Dialoguing with ‘Information Assistance’,
may cause the words “(you’re)breaking up!” or “(you have a)bad connection!” (call back!)(it’s your low battery??)
Sadly, cell phone, interruptions are normal (did I hear a pin drop?)
In other words, words extinguished, will never again, resound as preciently!?
September 24th, 2009 at 6:56 pmAre you saying that you can’t point out where I said what you attributed to me?
September 24th, 2009 at 6:58 pmralph the wonder llama says:
Are you saying that you can’t point out where I said what you attributed to me?
Difficult to read that particular ambiguous weasel wording any other way.
September 24th, 2009 at 7:00 pmTracist, I can be as perceptive as the next guy, but when someone makes it a habit to dodge direct questions and post confrontational challenges instead of answers, I tend to recognize it.
And there’s always a reason for such weaselish behavior. So my approach at that point is to go back to basics, and ask for specific information so that there’s no misunderstanding.
As I said, given your habit of cryptic answers, being understood easily by others doesn’t seem to be a high priority for you.
September 24th, 2009 at 7:01 pmTwacie:
What’s your point?
You are using the camera to weasel out of the meeting.
Almost everyone carries a camera in their cell phone
Me thinks that the troll doth protest too much
Since this thread is about spying on people without a legitimate purpose, I’ll just say all of your responses can be summed up as grossly negligent hypocrisy. I’ll ask you the same question you wingnut extremists used to justify the patriot act. What do you have to hide? If you have nothing to hide, you won’t mind being recorded or spied on. Right?
You have nothing, and you are a waste of bandwidth. Just remain silent as children are meant to when adults are in discussions? Oh wait. Republicans only like rules that others follow, right hypocrite t-racist? ;)
The probable cause is there as is the description of the place or person being searched as stated by Assistant Attorney General David Kris and even Franken himself. Franken stated that the Patriot Act doen’t require authorities to identify the individual, but the statute does require the government to either give the name or a description of the individual(s) or place the place.
Uh…you are aware that they’re talking about wire-tapping without warrants because they don’t NEED probably cause, right? They can just wire-tap because they want to.
And you’re also aware that the quotes you put up only emphasis further how Franken pretty much shows how the Patriot Act is unconstitutional to begin with?
Really, Tracy, one might think that when trying to argue your side, you wouldn’t put out evidence that basically proves the *other* side.
September 24th, 2009 at 10:38 pmUm BTW roving wiretaps were declared unconstitutional:
“Detroir District Court judge Anna Diggs Taylor had originally ruled on August 17, 2006 that the program is illegal under FISA as well as unconstitutional under the First and Fourth Amendments of the United States Constitution”
