Mukasey: Rep. Moran Has ‘Lost Touch With Reality’ And Should ‘Get Professional Help’ From Major Nidal Hasan

Michael Mukasey Last week, Rep. Jim Moran (D-VA) came out in strong support of Attorney General Eric Holder’s decision to prosecute the five 9/11 defendants in U.S. federal court and sharply criticized Republicans who were attacking the decision. “They will seize on any opportunity to [demagogue], and that means they’ll even take a stand that’s un-American. It’s un-American to hold anyone indefinitely without trial. It’s against our principles as a nation.”

Former Bush attorney general Michael Mukasey is one of the Republicans who has been speaking out against Holder. Last week at a Federalist Society conference, Mukasey said that holding the trial in Manhattan increased the risk of a terrorist attack on the city.

In an interview with Washington Times radio this morning, the hosts asked Mukasey about Moran’s comments. Mukasey responded by suggesting that the congressman “get professional help” from Maj. Nidal Hasan:

Q: Congressman Jim Moran of Virginia says anybody that questions KSM coming to New York City for a civilian trial — that they’re un-American. What is your reaction to that?

MUKASEY: I think he’s lost touch with reality. He ought to get professional help, perhaps from Maj. Nidal.

The segment then ends with the hosts laughing over Mukasey’s “joke.” Listen here:

Nidal, of course, is the Army psychiatrist suspected of going on a brutal rampage at Fort Hood and killing 13 people.

Asked for a response to Mukasey’s comments, Moran’s spokesperson Emily Blout said, “Leading conservative activists and scholars agree with Mr. Moran’s position, which is based on this nation’s long history of upholding its most fundamental values- even in the face of horrific crimes.”

Update In a similar bit of rhetoric, Rep. John Shadegg (R-AZ) went on the House floor last night and personally went after New York City Mayor Michael Bloomberg for supporting having the 9/11 trial in Manhattan. "I saw the Mayor of New York said today, 'We're tough. We can do it,'" said Shadegg. "Well, Mayor, how are you going to feel when it's your daughter that's kidnapped at school by a terrorist? How are you going to feel when it's some clerk -- some innocent clerk of the court -- whose daughter or son is kidnapped? Or the jailer's little brother or little sister? This is political correctness run amok."
Update Shadegg has apologized for his remarks.

    Why do Republicans hate America and its rule of law? I am aghast that Shadegg calls the rule of law “political correctness.” America was also attacked at Pearl Harbor, and did not abandon its rule of law and willingness to prosecute war criminals in court after World War II. Sept. 11, 2001 was awful, but did not result in nearly as many American deaths as World War II. To abandon American principles now is just too, too much, and similarly, Republicans doth protest too much. Perhaps in truth they are fearful that facts that show Bush-Cheney and other members of the GOP in an unfavorable or even criminal light will come out. I say, let the sun shine in on these court proceedings!

    Correct me if I’m wrong, but why, exactly, is it so incredibly dangerous to try Guantanamo detainees in the United States?

    I seem to recall that some of the perpetrators of the 1993 WTC attack were tried in the USA (those who didn’t flee the country), and they were convicted and are now serving the rest of their lives in prison here in this country. It’s not even a secret where they are (the supermax prison in Colorado). We’ve managed to do all this without abnormal fear of terrorist attacks on either their trial venue or their place of incarceration.

    Are these people more scary than — say, Manson family members? The Unabomber? Timothy McVeigh? Mafia dons? Drug kingpins?

    Enough of the political posturing — especially by people who are irrelevant. We have a constitution. Let’s use it. And let’s show the world that we’re willing to live by our own rules.

    I doubt the feds would be making a case if there were a chance KSM could get off on a technicality. What they fear, I think, is the public seeing that this is just a man, and our law is sufficient to deal with him. The whole GWOT with its torture and suspension of civil rights was justified by an hysterical reaction. Rather than face the fact that our air defense system failed, and focus on our shortcomings, terrorists were made out to be superhuman beings that could defeat NORAD with boxcutters for mystical reasons.

    Way too predictable, cd. First of all, the USSR is long gone. Second, the “enforced atheism” of the USSR is overstated. And third, one can argue that the atheism attributed to the USSR was merely a substitution of the State for God.

    Frankly, the communism promulgated by Stalin was as much a religion as it was a political system, with him as God. It’s basically the same system as any king or tyrant in history with a few fancy words provided by Karl Marx and Lenin.

    Although this has not been said, I would suggest that the decision to prosecute the terrorists in New York was taken in consultation with the mayor and police chief of NYC. If Bloomberg objected to the trial, I believe Holder would have found an alternative venue. These conservatives who claim they are thinking about the security of NYC are grandstanding. It is common sense that the trials should not be politicized, but the Republicans are grasping at everything to continue their 24/7 Hate-Obama-thon. Appalling.

    If the evidence is barred it will be because of Bush. The evidentiary issues are dealt with before trial begins. Those matters will resolve whether the evidence is tainted by the torture. A federal judge will have hearings on the evidence issues but the rulings may not be disclosed since it is probable that a gag order for the parties will be in effect. These hearings will also dispose of the evidentiary issues regarding national security.

    I’ll grant you one thing, his writings seem to indicate that his madness had taken him past any recognizable religion. Or humanity for that matter. He may indeed have renounced God. But, the thing that remains clear is that he is a racist. A zealot. A worshiper of his own delusions and devoted to the destruction of one particular religion.

    Even within the broad tent of atheism there’s a whole bunch that would leave him outside any reasonable definition.

My point is that I haven’t seen anything where he, personally, makes any claims about his personal belief in a supreme being or otherwise. It’s obvious that he Believes in a twisted agenda of racial purity/superiority but the references to religion are ambiguous.

    I suppose it’s possible that he merely conflated “Jews” with a race but, Judaism is a religion and not a race. So, logically, his hatred had some element of religious bigotry. Otherwise he would have written volumes about his hatred for other religions or even God. I can’t seem to find those in the record.

    More and more, it is obvious that the AG from the Bush administration may be a big part of their failure to follow constitutional provisions in the treatment of POWs. The silly nomenclature of “enemy combatant” is simply a euphemism to perpetrate crimes against humanity and our constitution. Amazing that a legal education had not seemed ot help Mr. Mucasey to get this all straight and constitutional. So now when my grandson goes to war and if he gets picked up by some rogue nation, or if he is on some clandestine mission, I will not be able to expect my government to have any moral authority to settle the problem because of the way the entire Bush Administration ditched the Constitution.
