O’Reilly Upset Over 9/11 Trials: ‘I Don’t Care About The Constitution!’

Since Attorney General Eric Holder announced his decision to move five Guantanamo Bay detainees — including Khalid Sheikh Mohammad — to New York for civilian trials on charges related to the Sept. 11, 2001 terror attacks, Fox News personalities have been up in arms. Karl Rove called it a “long-standing plot” by the Obama administration’s “left-wing lawyers who do not love America.”

But last night on Fox, the network’s top legal analyst Judge Andrew Napolitano — who has been known to disagree with Fox’s right-wing narratives on legal issues — disputed that view, citing the constitutional right to be tried in the place where the crime has been committed. “I don’t care about the Constitution!” host Bill O’Reilly responded. The debate continued:

O’REILLY: So why is he entitled to come to New York City to be tried in the civilian criminal court if he’s arrested in Pakistan?

NAPOLITANO: Because the document you don’t want me to talk about says when the government is going to prosecute you, it must do so in the place where the alleged harm was caused.

Later in the program, Fox analyst Brit Hume said he’d “been scouring the columns of various people opining about this to see if somebody makes a good argument for doing it,” adding, “And I really haven’t heard one.” Hume then noted Napolitano’s opinion and said, “I’m not certain I agree with that.” Watch it:

Holder’s “bold and principled” decision was “a victory for the rule of law and the American system of justice,” the Center for American Progress’ Ken Gude said.

“If you are accused, you get to know what you know what you are accused of, you get to face your accusers, and you get to defend yourself in court, and then you face a trial and a conviction. This is who we are as a system,” said Tom Andrews, director of the National Campaign to Close Guantanamo. “The Taliban? You can get a trial and a beheading in a few hours. That’s not our system of justice.”

    The Right have no idea how predictable they are. Their beliefs are always given, and the arguments and factoids are cooked up later.

    If Holder had decided not to go with civilian trials, the Right would be agonizing over this lack of faith in the system and how it weakens America and the whole bit. They would be very worked up about it, to, bless their hearts.

    I don’t think the righties are really that afraid of these detainees being prosecuted on US soil. What they ARE afraid of, and I think it makes them really nervous, is the prospect that the whole “torture” fiasco may come to the forefront at some point during these trials. If the media were to start talking about how much evidence was thrown out because it was obtained through torture, Americans may start to question the Bush Administration’s crimes and motives all over again. The right has been successful (with a little help from a dis-interested MSM) so far in burying these crimes and the last thing that they want is for a new light to be shone on it. If you look closely at exactly who is denouncing these trials you will see that they are all the same faces that stridently defended Cheney and the torture program from day one.

    This is an ongoing case of reality having a liberal bias. The fox narrative has no legal basis, it’s purely the ignorant opinion of laypersons.

    Co-workers were saying this week that Obama wants to let Gitmo prisoners go in the US and get them jobs. I asked rhetorically where they get such an absurd idea, but I know it comes from fox.

    One point I don’t hear any conservative hacks like Brit Hume and O’Reilly bring up is whether or not they realize how illegal immigrant murderers are treated by the court system in the USA as compared to terrorists. Do we send illegals to Gitmo and try them before military commissions? No. We try them in American courts, where they get universal – not just American – rights like HABEUS CORPUS, just like we’re doing with KSM, and just like we did with hundreds of other non-American criminals/terrorists like Zacharias Moussaoui, the Blind Sheik and others.

    I’ve also heard other wingnuts ask “Why KSM is going to American courts, while U.S.S. Cole bombers are going before military commissions in Gitmo”? Um, how about the fact that criminals who kill Americans OUTSIDE of America – like the Cole suspects – don’t get treated the same as criminals who kill Americans INSIDE of the country. That’s just too much commonn sense for some wingnuts to understand, I guess.

    I don’t know what it might do to our image as a people and a Government were we to prove our government’s involvement in 9/11.. I’m sure it will diminish our standing in the world. But the fact that our people pursued justice and attained it – that would overcome such a loss.

    Our strength is in the rule of law.. and that we punish our criminals.. not in one reckless – and arguably heartless administration.

    You are wrong. The Constitution applies to citizens and any person within the borders of the US.

    Unfortunately, many of the most vocal critics of the current plan (to try the accused in a Federal court) are of the mind that ANY trial is unwarranted and that the accused should simply be summarily found guilty and executed.

    Somewhat akin to what is done in some theocracies and dictatorships around the world…

    I’m all for the rule of law and standing for our principles. I do believe that holding someone without trial and military commissions are inherently a very bad idea and created a ‘tiered’ justice system which is really no system at all.

    However, Holder and Obama are anything but “bold and principled” in this decision. They haven’t a leg to stand on because while they are trying these five men they continue to hold others indefinitely and send others to military commissions. They are trying give lip-service to being fair and even handed when all they are really doing (and Holder pretty much admitted this) is sending the terrorists to the federal justice system only if they feel it’s a slam-dunk case. Otherwise they’ll just deny them any rights and continue using the same tactics the Bush Administration used.

    I guess I’m just playing Cheney’s advocate here, but KSM’s crime is planning and coordinating (conspiracy) the murder of thousands of Americans, yes? And he did this while outside of the U.S., didn’t he? And therefore perhaps is not subject to any Constitutional rights? I would appreciate if someone could help me see that this isn’t some technicality that could be exploited by KSM or the Right or the Bill Orallys of the world. Thanks
