Woman Who Was Denied Insurance Due To Pre-Existing Condition Looking To Get Married For Health Care

finterri One of the worst abuses of the private insurance industry is its practice of excluding people with certain pre-existing conditions from coverage, effectively denying them the right to get adequate health care coverage because covering them is not profitable enough.

45-year-old mother and divorcee Terri Carlson knows what life is like with a pre-existing condition. She has a rare genetic disease called C4 Complement Deficiency, that involves the immune system having “inadequate levels of complement proteins,” which leaves the body more prone to infections. “[It] makes me unable to process bacteria and viruses efficiently and my body attacks itself. It’s very similar to lupus,” Carlson explained to the press.

Because she recently divorced, she has “one year left under COBRA health coverage, but after that she will have nothing to pay for numerous doctors appointments and dozens of medications.” Due to the fact that Complement Deficiency is considered a pre-existing condition by many health insurance companies, Carlson has been unable to find anyone willing to cover her following the expiration of her COBRA coverage. “I’ve looked, I’ve searched, there is absolutely no stone that I’ve left unturned. And there are no other options for me,” she told a reporter.

After fruitlessly searching for months for a way to get health coverage, Carlson decided that she had only one way to get affordable coverage: She would get married. She has set up a website called WillMarryForHealthInsurance.com and is offering to marry someone whose health insurance will cover her as well. “You know, I am not happy I was delt this deck of cards in my life. However, if I don’t fight for myself nobody will. While the goverment fights over healthcare reform people like me suffer … as drastic as it sounds, I will marry for health insurance,” she writes on the site.

CBS News interviewed Carlson today. She told the news network that she can’t afford to care what her future husband looks like — “The lower the co-pay, the sexier you are to me!” Watch it:

Carlson told CBS that some people have accused her of being part of a left-wing conspiracy by using her case to illustrate the need for health reform, but that she doesn’t mind the charge: “I’m just like every other middle American that’s suffering with a pre-existing condition and caught in the middle. And if that makes me the poster child for President Obama, I’m happy to do it.”

It is worth noting that the United States is the only developed country without a universal, cradle-to-the-grave health care system. In no other developed country would a woman feel like she was forced to marry someone, even if she didn’t love them, just to be able to get decent health care coverage.

I am so embarrassed for my country that a woman is reduced to this.

A co-worker of mine married a woman a few years ago because she had terminal cancer and no health coverage. Because we have a group plan here she wasn’t turned down for a pre-existing condition and was able to live her last year or so with some dignity.

There is no excuse for a culture that does this to its citizens.

I’m going to say something that may sound controversial here but bear with me:

denying coverage for pre-existing conditions is not entirely unfair for an insurance company to seek to do. We lose sight of the fact that an insurance company needs to be able to protect itself against policy-shopping once an illness or condition has been diagnosed. Without such protection, a consumer could be free to forego any coverage until it was needed, and then pay premiums that would never balance out the costs to the insurer of covering the policyholder.

Of course, the reason we lose sight of this is because insurance companies have so much power that they are able to turn such reasonable protections into unconscionable profit centers by cherry-picking only the healthiest among us.

That is one more reason why the free market does not work to efficiently provide health care to the people of this nation.

Health care is not a standard consumer commodity. It is a prudent policy for a civilized society, like law enforcement or education,. both of which are “socialized”.

I’ve never seen anyone who had this disease but I’ve seen kids with lupis because as I kid while my mom was at work my friend Shawn’s mom would babysit us at the hospital. The statement of CAD is considered libel per se. I suggest that we all get together to sponsor a libel suit. We can start by demanding any evidence supporting CAD’s assertion be brought forth now. I also suggest that the site go back to trace the ISP and location of this person and provide it to MS. Carlson. Obviously, CAD will not be able to provide any reasonable basis for his allegation showing that the statement was made with malicious intent. There is no need for proof of actual damages with libel per se. Punitive damages would apply.

So, she is divorced with 2 teenage boys, a big house to take care of, unable to get a job because of her physical conditions, existing on $2600 a month spousal & child support, and no possibility of getting any more insurance (pre-existing conditions, naturally). Guess she’s just out of luck.

LOL! That’s right folks, the KKKristian f*KKKwads “altered” the study all of the way through to “fix the facts”. This wasn’t an objective study, it was nothing more than an unscientific religious propaganda gaming of the system. Exactly what you’d expect from lying conservatives.

Vitamin D3 is not a vitamin – it’s a very special hormone – a steroid hormone and it regulates the immune system – it turns it on and off.

    Vitamin D3 is NOT toxic.

I wish that were true, but “Christianity” is just as full of evil in its teachings as it is good. That’s what happens when “men” create works of morality. It’s just as flawed as the men that wrote it.

The ‘Christian’ teachings promote war, misogyny, homophobia, rape and even incest. They also promote kindness, forgiveness, peace and love – but these “dark Christians” never care about those aspects of the teachings.

It seems to me that it would be far more constructive for the defenders of the current status quo to suggest some way that this woman can get health insurance she can afford. But instead, she gets derided for being part of a left-wing conspiracy, our trolls here call her a whore and a prostitute, and she has been reduced to making a mockery of marriage just because she has this crazy idea that she has a right to live.

My understanding is that if your legally imployed in california they tax your income and that goes into ssdi I think there are a few exceptions but I doubt she’s one of them.

There are all sorts of “employed” situations in which the “employer” doesn’t withhold any taxes (state, federal, FICA) from your check. It’s also quite possible that the “stay at home mom” described her while she was still married, in which case she wasn’t then working and definitely wasn’t contributing anything to Social Security.

Qualifying for SDI is incredibly difficult. Everyone I’ve ever spoken with who was getting a check was turned down when they initially supplied, even with conditions like MS. After a year of attempts, they hire a lawyer who specializes in SDI, get approved and turn over a big chunk of the money to the attorney. But, again, if you haven’t had a regular job, you haven’t been contributing to SS and you get nothing back.

Mr Duke is claiming that without a profit motive there will be no innovation in medicine. Mr Duke clearly doesn’t post any data to support this, but expects us to take it on faith because of his GiantBrain. Too bad the data establishes something very different.

I know, I know, Mr Duke, there are way too many words in this article and your mind is already made up anyway, but still, maybe someone can explain it to you. I’ll include the summary because I think you might just be able to read it, not because I think you’ll be curious enough to follow through.

    Summary points

Prices of patented drugs are substantially higher in the US than in other affluent countries

Published reports indicate that pharmaceutical companies in affluent countries recover research and development costs from domestic sales with substantial profits

Discovery of innovative new drugs in Europe is proportionately equal to that in the US
US pharmaceutical companies invest just 1.3% of net sales in basic research

The idea that the US is subsidising other rich countries contradicts basic economics and the global nature of pharmaceutical markets

And since Mr Duke likes to pretend to understand economics far better than lowly libs:

Secondly, every student in introductory economics learns that fixed costs like research do not determine prices.21 The market sets prices, implying they are open to free trading like stock prices. Patents, and especially patent clusters, turn the market into a monopoly, and only a monopoly can claim that fixed costs determine prices because it can make that a self fulfilling prophecy. The claim by companies that they have to set prices at 50-100 times production costs to recover research and development costs has never been substantiated, because they have never opened their books to independent public inspection to prove it. What we do know is that all research and development costs are fully recovered each year from domestic sales in the UK and Canada at prices that are far lower than those in the US.

I’d rather spend less money to give them preventive care under a program that can control the costs they incur. But they oppose letting me control the costs of caring for them.

The Ninth Amendment is used to protect the citizenry from any expansion of governmental power because of the limited nature of the Bill of Rights. Because every right of the people of the United States could not possibly be mentioned in the Constitution, the Ninth Amendment was added to supplement the rights already mentioned. The amendment protects many rights implied in a universal civil code, and those which are linked to other rights already declared. It protects these personal liberties from state and federal infringement.

Zooey-wrong…the judge has ULTIMATE authority over the divorce settlement.

Right — OVER THE PARTIES IN THE DIVORCE ACTION.

The only thing the Judge could do was order the ex-husband to pay the COBRA payments for the 3 years, which he may or may not have done.

After that, there is nothing to pay, because the insurance company will not sell her coverage at any price. Since they are not a party to the divorce, the Judge has no way of ordering them to continue coverage.

But what do I know? I only worked in family law and as a court clerk for more years than I care to remember.

As has already been demonstrated again and again (not in this thread, but in the world) cutting off benefits is what these corporations do; they scarcely need a divorce action to justify their behavior, but being predatory and immoral they will certainly light upon such an excuse if it is convenient.

That is your opinion. I disagree. The profit motive is one of the big problems in the cost and quality of healthcare. They dont WANT to do preventative care because there is so much more profit margin in catastrophic care. So why diagnose someone with prostate cancer when it can be dealt with by some medicine or a thirty thousand dollar surgery when there is so much more money in taking care of them the last five months of your life in a critical care unit and make half a million instead. Private for profit insurance has FAILED to give us the high quality fair cost we deserve. They use tricks to deny care when you need it. They are unscrupulous and there needs to be an alternative. A public option is a weak but reasonable response. Single payer would be the best answer

drhunt, are you aware that your response is completely irrelevant as to the questions that I asked? You’ve provided no substance to your assertions; merely making more assertions does not elevate the one’s that came before.

At this point, besides the basic Red Herring fallacy, there is also an apparent argument from false or misleading authority going on here.

If you haven’t got the evidence, that’s OK; just be honest enough to say as much, and confine yourself to stating what you believe in terms of such belief, rather than making extravagant claims about “truths” you cannot justify.

For example, can you give even a single citation to a RECENT (very important) divorce action where the judge compelled insurance coverage against the insurance company’s will &/or stated intent to deny for pre-existing conditions EVEN AFTER THE COBRA RUNS OUT?

What I am insisting on, in order for your argument to carry any claim of relevance, is a contemporary example that is genuinely analogous. Vague announcements about things that you are “just certain about” frankly do not carry no relevant evidence for the issue at hand.

    564. drhunt says:

Family Court judge’s decision to rule primary legal custody IS binding and supercedes all other statutes.

This, again, has no relevance to the issue of maintaining Ms. Carlson’s insurance.

The preceding (that is, first) paragraph strikes me as credible, but still lacking in actual evidence. The reasoning behind the claim of the first paragraph is not helped by the irrelevance of the second paragraph.

In addition, you’ve not presented any evidence about what arguments her attorney actually presented. (It may well be the case that such information is not readily available.) What we have is HOW the judge ruled, not whether that ruling was ultimately sound. Thus even if the judge’s ruling is not sound by previous rulings (and, again, the one you cited bears no relevance):

    (1) Given the more recent SCOTUS ruling that abandoned a century of precedent regarding the status of corporations in campaign contributions, we’ve dubious a priori grounds for taking any of their previous rulings for granted.

    (2) But of even greater importance, even if #1 was not true, appealing a case up the foodchain is an expensive hobby that an uninsured stay-at-home mother is not obviously well situated to pursue. The Judge could be just as queer on this case as a three dollar bill, and it will never get turned around unless someone has the resources to challenge it of YEARS to come.

OK…how about scenario #2…in order to avoid the woman getting married….how about finding a doctor to give her total disability? At least she only has to pay 20%…or quick deed the house to one of her children and then get Medicare/Medical benefits.

    (1) That would arguably involve finding a doctor who was prepared to commit fraud. Her medical condition has to degrade beyond its current state (all the while, racking up significant medical costs) before that declaration could be safely made.

    (2) I rather doubt she could quick claim the house to anyone who was not of an age to otherwise &/or variously assume a PoA. This latter is just a guess on my part, but in the absence of concrete evidence to the contrary I would be very hard-pressed to believe that an underage child could legally assume ownership of a house in a manner that would protect the property from the legal guardian’s medical bills.

A next friend surely could exercise such a right, but the family court’s order has deprived Newdow of that status.”

Everybody has already read that; repeating an irrelevancy does not make it relevant. There is not issue at hand regarding the parent-child relationship;; Ms Carlson was not her ex-husband’s child. And since it is HER insurance — or rather, the lack thereof — that is at issue, citing case law that is relevant to the parent-child relationship is not only irrelevant, it argues for a very dubious grasp of the basic facts and logic of the issue.

Gary-permanent disability for medical conditions IS the reason doctors sign off on them. The list is quite long…RA, lupus, back injuries, even fibromyalgia are considered permanently disabling conditions…therefore the physician is not commiting fraud.

As I stated above, the condition has to be advanced to a sufficient degree before such a complete disability can be signed off. Are you saying that, in point of fact, nothing more is required for a diagnosis of 100% disability than the earliest, initial diagnosis?

I find that less than entirely credible on the face of it. Again, I’m willing to be corrected on this issue, but I’d like something more than a vague announcement.

The question I asked is not whether the conditions you name CAN EVENTUALLY be cited as 100% disability; I am not aware of anyone here who has challenged such a notion, and I know for a fact that I did not. The question I posed (and have now rephrased above) was whether the disease had to progress to a more advanced stage before such a declaration could medically be made.

(Also, of relevance here, is whether this is a matter that varies from state to state.)

A completely irrelevant and disanalogous comparison. You have, in fact, just declared that SCOTUS granted SC judge’s carte blanche authority to rule any way they please on any matter what-so-ever that happens to appear before them. Such a claim is obviously absurd.

SCOTUS did not declare that ANY and ALL decisions made by SC judge’s were absolutely binding, regardless of subject or context. SCOTUS made a specific ruling in a specific case about a specific set of relationships.

None of those specifics or relationships are of any relevance or analogy to the case at hand here.

Why if US healthcare is so bad is the Canadian premier coming here for heart surgery?

Newfoundland and Labrador. It’s because in North America people go to the most appropriate hospital they can find, thanks to NAFTA. Some from Canada come here. Some from America go there. I’ll admit that Canada currently is having some difficulty retaining high-end cardiac surgeons, which could be easily fixed with a slight adjustment to their payment schedule. However, the fact remains that the Canadian health care system will still be paying for his treatment either way.

What about all of the U.S. Citizens who can’t afford to get health care in the U.S? How does having our doctors taking care of foreigners (paid for by their governments) make up for the fact that our own people can’t afford such care?
