Supreme Court Springs A Leak; Leaks To Conservative Pundits May Have Started More Than A Month Ago

CBS News’ Jan Crawford confirms widespread rumors that Chief Justice John Roberts initially voted to strike down the Affordable Care Act’s individual mandate, but decided midway through the opinion drafting process that he could not support this constitutionally unjustifiable result. In what may be the biggest revelation of her piece, Crawford also reports that pseudo-moderate Justice Anthony Kennedy led the internal lobbying effort to bring Roberts back into the right-wing fold:

Roberts then withstood a month-long, desperate campaign to bring him back to his original position, the sources said. Ironically, Justice Anthony Kennedy – believed by many conservatives to be the justice most likely to defect and vote for the law – led the effort to try to bring Roberts back to the fold.

“He was relentless,” one source said of Kennedy’s efforts. “He was very engaged in this.”

But this time, Roberts held firm. And so the conservatives handed him their own message which, as one justice put it, essentially translated into, “You’re on your own.”

The conservatives refused to join any aspect of his opinion, including sections with which they agreed, such as his analysis imposing limits on Congress’ power under the Commerce Clause, the sources said.

Instead, the four joined forces and crafted a highly unusual, unsigned joint dissent. They deliberately ignored Roberts’ decision, the sources said, as if they were no longer even willing to engage with him in debate.

Crawford cites two unnamed sources, and there are a very limited universe of people who could have revealed this information to her. Only the justices and their personal staff would have access to this knowledge, and it is highly unlikely that a clerk or secretary would be willing to risk their entire career by revealing the Court’s confidential deliberations to the press. Crawford, moreover, is a very well connected conservative reporter who has, at times, worked closely with the Federalist Society to drive conservative legal narratives. Nothing is certain, but it is likely that one or both of Crawford’s sources is a conservative justice.

Moreover, as Linda Greenhouse points out, it is possible that the Court started springing leaks more than a month before Roberts handed down his opinion:

Around Memorial Day, a number of conservative columnists and bloggers suddenly began accusing the “liberal media” of putting “the squeeze to Justice Roberts,” as George Will expressed the thought in his Washington Post column. “They are waging an embarrassingly obvious campaign, hoping he will buckle beneath the pressure of their disapproval and declare Obamacare constitutional,” Mr. Will wrote. Although the court has been famously leakproof, Mr. Will and some of the others are well connected at the court, and I wondered at the time whether they had picked up signals that the chief justice, thought reliable after the oral argument two months earlier, was now wavering, and whether their message was really intended for him.

To be clear, at this point only two facts are confirmed: 1) According to Crawford, Roberts flipped his vote midstream; and 2) someone within the Court must have leaked her this information. It is perfectly appropriate for Justice Kennedy, or any other justice, for that matter, to internally lobby Roberts to try to obtain his vote in an important case. If a member of the Court has turned to conservative columnists like Will or reporters like Crawford in order to pressure and then embarrass Roberts, however, that would be a significant and unusual escalation from the justices’ regular tactics.

Stand Your Ground Laws Caused ‘Net Increase In Deaths’ | A second academic study, previewed in a working paper released this week, shows that among the unintended consequences of Stand Your Ground laws is a “net increase in deaths,” according to Raw Story. “Our findings raise serious doubts against the argument that Stand Your Ground laws make America safer,” the authors wrote. Using homicide data from 2006 to 2008, the study by Georgia State University’s Chandler McClellan and Erdal Tekin, found that “between 4.4 and 7.4 additional white males are killed each month as a result of these laws” in states that have adopted them. Tekin told Raw Story: “At least some of the people getting killed are bystanders, which is more than enough to raise serious concerns about these laws.” The analysis mirrors another recent study from Texas A&M University.

Republican Senator Says ObamaCare Will ‘Sovietize’ Health Care

Last week, just before the Supreme Court ruled that Affordable Care Act is constitutional, Sen. Tom Coburn (R-OK) told the Eagle Daily Investor that what ObamaCare is trying to do “is Sovietize the American health care system.”

Today on CBS’s Face The Nation, Coburn said he believes ObamaCare will Sovietize the U.S. health care system because “it means the bureaucrats and politicians are in charge of your health care”:

HOST NORAH O’DONNELL: What did you mean by that, Sovietize?

COBURN: Well it means the bureaucrats and politicians are in charge of your health care and that’s exactly what this has done there’s not going to be individual choice. Remember the components of this bill. There’s an IPAB bill, the preventative services task force, that is going to mandate what care will be given and what care won’t be. There’s the innovation council that will approve or disapprove of any new innovation. We have three agencies that are totally going to take away the options of your freedom about your care and about what you and your physician decide is best for you. So Soviet style — what I’m saying is you’re going to have a bureaucracy … government bureaucracy is one of the reasons costs are out of control.

But Coburn really shouldn’t fear the Independent Payment Advisory Board — a commission that would make recommendations for lowering Medicare spending to Congress. IPAB’s authority only kicks in if health care spending increases beyond a specific threshold and the board is specifically prohibited from rationing. The Affordable Care Act’s language specifically states that IPAB’s recommendations cannot “include any recommendation to ration health care, raise revenues or Medicare beneficiary premiums…increase Medicare beneficiary cost- sharing (including deductibles, coinsurance, and co- payments), or otherwise restrict benefits or modify eligibility criteria.”

Moreover, the CBO found that getting rid of IPAB would increase the national deficit by $3.1 billion and grow health care expenditures. And the commission is actually tasked with delivering a comprehensive proposal to reduce excess cost growth in Medicare.

Romney Advisers Reveal Strategy: Ignore Journalists, Pander To Right-Wing Conspriacy Websites

In a stunning interview with Breitbart.com, two top advisers to Mitt Romney revealed the campaign’s plan to largely ignore journalists in favor of right-wing conspiracy websites.

From the beginning of the campaign, Romney has pointedly avoided news outlets who might pose tough questions. The press dubbed it “the Mittness Protection Program.” As the campaign wore on, Romney has refused to answer direct questions about major policy issues central to the campaign. For example, Romney has still not stated whether he would undo Obama’s order ending deportations for many young undocumented immigrants.

Romney campaign spokesman Lenny Alcivar recently outlined how the campaign will avoid journalists and cooridnate and communicate their message through Brietbart.com and the Drudge Report:

When this election is over, one of the lessons that will be learned by the mainstream media is that they no longer have a toe-hold on how Americans receive their news. Never before – in a way that has taken Democrats off stride – have we seen the confluence of an aggressive online community, led by Breitbart, and an aggressive campaign team not willing to cede an inch of ground to Democrats. This combination has created a new political reality. We no longer allow the mainstream media to define the political realities in America. The rise of Breitbart, Drudge and others, combined with an aggressive Romney campaign is a powerful tool in the arsenal of the conservative movement.

…The governor will no longer allow the mainstream media to dictate the terms of this debate. This is just the beginning… We are witnessing the rise of the center right media.

The Drudge Report and Breitbart.com, founded by the late Andrew Breitbart, a Drudge protege, are actually far-right websites that reguarly traffic in paranoid and offensive conspiracy theories. A few examples:

1. The Drudge Report aggressively pushes the birther conspiracy theory. Drudge promoted Jerome Corsi’s book alleging Obama was not born in the United States. After Obama released his long form birth certificate, Drudge pushed the theory that it was a forgery. He recently featured a discredited story (first published on Brietbart.com) suggesting Obama was born in Kenya. [ThinkProgress, 5/17/12; Drudge Report, 4/20/11; TPM, 4/29/11]

2. The Drudge Report pushed the theory that Chief Justice Robert upheld Obamacare because of “cognitive problems” due to epilepsy medication. [ThinkProgress, 6/29/12]

3. The Drudge Report reguarly links to and promotes 9/11 truther Alex Jones. Jones also promotes conspiracy theories regarding “global elites enacting one-world government; secret FEMA camps; weather control; mass sterilization; the Oklahoma City bombing; the Space Shuttle Columbia disaster; vaccines; and the government using products like juice boxes to ‘encourage homosexuality with chemicals so that people don’t have children.’” [Red State, 6/20/11; Media Matters, 10/11/10]

4. Breitbart.com pushed the conspiracy theory that the Navy Seal operation last spring was a hoax and Bin Laden might be alive. [ThinkProgress, 5/2/11]

5. Breitbart.com frequently accused “President Obama of failing to release a valid birth certificate.” [Media Matters, 9/29/09]

6. Bretbart.com “routinely compares Obama to Hitler, Stalin, Lenin, Mao, Pol Pot, and Castro.” [Media Matters, 9/29/09]

It’s not just Romney’s advisors who are promoting sites like Drudge and Breitbart.com. In an interview with NewsMax, another far right site, Romney personally praised the Drudge Report.

Sen. McConnell On Whether The Massachusetts Mandate Is A Tax: Ask Romney

Ever since the Supreme Court upheld the individual mandate in the Affordable Care Act as constitutional under Congress’ power to tax, Republicans have gone into full gear falsely characterizing the law as a “massive tax hike” on the middle class. But on Fox News Sunday today, Senate Minority Leader Mitch McConnell (R-KY) refused to say whether or the individual mandate in Massachusetts — implemented by Mitt Romney — is also, therefore, a tax:

HOST CHRIS WALLACE: You didn’t answer my direct question: If the Obama mandate is a tax on the middle class, is the Romney mandate a tax on the middle class?

MCCONNELL: Well, I think Governor Romney will have to speak for himself about what was done in Massachusetts. I can tell you that every single Democratic senator voted for this tax increase and these $500 billion cuts in Medicare and it will be a huge issue in 2012. The Chief Justice has, in effect, said this will be decided by the American people. That’s why we have elections.

In Massachusetts, less than 1 percent of the populace wound up paying the penalty for not having health insurance following the implementation of an individual mandate. Meanwhile, the Affordable Care Act will actually cut taxes for millions of middle-class families.

McConnell Can’t Answer How GOP Will Insure Americans After Repealing ObamaCare: ‘That Is Not The Issue’

Since the Supreme Court last week upheld the Affordable Care Act, Republicans have been scrambling for a response. Without much to say now that the law has been ruled constitutional, the GOP has fallen back on its pledge to repeal ObamaCare. However, the new health care law provides 30 million Americans with access to health insurance. So how do Republicans plan to replace this key feature if they repeal?

Fox News’s Chris Wallace asked Senate Minority Leader Mitch McConnell (R-KY) this important question on Fox News Sunday today and the senior senator from Kentucky had no answer. After McConnell meandered through the typical GOP talking points that they plan to allow the sale of health insurance across state lines and that they will institute medical malpractice reform, he finally settled on an answer: Insuring Americans “is not the issue”:

WALLACE: One of the keys to ObamaCare is that it will extend insurance access to 30 million people who are now uninsured. In your replacement, how would you provide universal coverage?

MCCONNELL: Well first let me say the first single thing we can do for the American system is get rid of ObamaCare. … The single biggest direction we can take in terms of improving health care is to get rid of this monstrosity. [...]

WALLACE: But you’re talking about repealing and replace, how would you provide universal coverage?

MCCONNELL: I’ll get to it in a minute. [...]

WALLACE: I just want to ask, what specifically are you going to do to provide universal coverage to the 30 million people who are uninsured?

MCCONNELL: That is not the issue. The question is, how can you go step by step to improve the American health care system. … We’re not going to turn the American health care system into a Western European system.

If Republicans are successful in repealing ObamaCare, they’ll also have to answer how they’ll provide coverage for those with pre-existing conditions, lower-income Americans, and even the millions of young Americans who can now stay on their parents’ health care plans until age 26.
