- As a sign of the Obama Administration’s seriousness about striking down the unconstitutional Defense Against Marriage Act, DOJ sent Assistant Attorney General Tony West to argue against the anti-gay law’s constitutionality in federal court.
- The judge in that case, Bush-appointed Judge Jeffrey S. White, appeared very skeptical of the unconstitutional law in questions to counsel.
- Meanwhile, a gay rights group in California is gathering signatures to place repeal of that state’s anti-gay Proposition 8 on the ballot.
- An Indiana judge will consider whether that state’s school voucher law unconstitutionally funds religious education.
- Florida is facing a judge shortage of its own.
- An Alabama appeals court reversed a decision striking down a state ethics law as unconstitutional.
- A Virginia judge denied the state senate’s Democrats an injunction preventing the senate Republicans from organizing the evenly divided body as a GOP senate, although the judge indicated that the matter could come up again after the new senate convenes.
