- The Colorado Senate approved a ballot initiative that would allow the state’s voters to repeal an unconstitutional amendment to the state’s constitution targeting gay people. The anti-gay amendment was struck down by the Supreme Court in Romer v. Evans.
- Republican Judge Henry Hudson held that leading ex-gay advocate Gregory Quinlan did not commit defamation when he falsely claimed that a gay rights activist called for Quinlan to be injected with AIDS.
- Tenth Circuit nominee Judge Robert E. Bacharach is being single-handedly blocked by Sen. Tom Coburn (R-OK). Even Coburn’s fellow Oklahoma Sen. James Inhofe (R-OK) agreed to allow the nomination to move forward to a hearing.
- New York’s highest court will consider the constitutionality of a newly created state senate seat.
- And, finally, rocker and guns activist Ted Nugent pleads guilty to illegally shooting and killing a bear in Alaska.

Sen. Coburn is no longer preventing Bacharach from receiving a hearing.
