- Law professor Jack Balkin warns of a new legal theory for challenging the Affordable Care Act, which, though not supported by existing precedent, shows that “the constitutional and legal struggle over health care reform isn’t over.”
- A federal appellate court will consider a challenge to California’s DNA collection law, which allows warrantless collection of genetic samples from every person charged with a felony. Meanwhile, a group of Maryland state lawmakers have asked the U.S. Supreme Court to review a state court ruling striking down that state’s DNA collection law. U.S. Supreme Court Justice John Roberts has suggested the high court would review Maryland law.
- President Obama filed a major case with the World Trade Organization alleging China is unfairly subsidizing exports of cars and auto parts. A New York Times news analysis warns that the case may produce few results.
- Senate Republicans are considering holding a private meeting to consider the nominee to head the Department of Justice’s Antitrust Division — an unusual step that they declined to explain.
