SCOTUS Takes No Action On Marriage Equality

The Supreme Court put off until at least this Friday a decision on which, if any, of the various marriage equality cases on its docket it will hear. As a substantive matter, this delay means absolutely nothing. The Court is still overwhelmingly likely to hear one of the challenges to the unconstitutional Defense of Marriage Act, as the justices almost always agree to hear cases where a federal law was struck down by a federal appeals court. It is not certain, but still not entirely unlikely, that they will also agree to hear the challenge to California’s unconstitutional Proposition 8.
