A Michigan Court of Appeals ruled today that the claim of “gay panic” does not hold up to defend the actions of a hate crime assault. The argument, as it was presented in this trial, was that Dale Cutler was so threatened that Ryan Young would come on to him that he had no choice but to inflict serious harm upon him. A jury found Cutler guilty of assault with intent to inflict great bodily harm and he was sentenced to 11 to 25 years in prison. (Read the full Appeals Court ruling.)
