Despite the Department of Justice’s decision in January to no longer defend the Defense of Marriage Act, the United States Trustee for California has filed a Motion For Leave To Appeal the ruling by a U.S. Bankruptcy Court that DOMA is unconstitutional. The Bankruptcy Court ruled that DOMA could not constitutionally be applied to a same-sex couple because it “deprives them of the equal protection of the law to which they are entitled.”

Update

Bil Browning was told today that the Washington Blade piece was “skewed” and that the administration would not be defending DOMA.
