Reid Forces McConnell To Compromise On Judges

As ThinkProgress previously reported, Senate Majority Leader Harry Reid (D-NV) filed seventeen petitions to break Senate Republican filibusters on as many judges earlier this week. Initially, McConnell reacted to these petitions with an increasingly implausible list of reasons why the Senate could not vote on these nominees right away, before finally admitting that he was opposing the nominees because Reid made Senate Republicans “look bad” by pointing out their obstructionism.

As it turns out, this was not an effective messaging strategy for Mr. McConnell, who has now agreed to allow most of the seventeen judges to move forward:

Senate Majority Leader Harry Reid (D-Nev.) and Minority Leader Mitch McConnell (R-Ky.) announced the agreement on the floor but said they wouldn’t provide any details until they briefed their respective caucuses later in the afternoon. However, aides said the deal will allow Democrats to move 12 district court judges and 2 circuit court judges by May 7.

Now, let’s be clear, this is not a perfect deal. There is absolutely no reason whatsoever why every judge who has cleared the Senate Judiciary Committee could not be confirmed today — and there is certainly no reason why judges who received little if any opposition in committee need to wait as long as May 7. It’s also inexcusable that one of President Obama’s most outstanding nominees, Ninth Circuit nominee Paul Watford, is not on the list of judges being confirmed (a list of the judges is below the jump).

Nevertheless, today’s deal is a massive improvement over the status quo. According to data provided by the Federal Judicial Center, the 112th Congress has confirmed judges at a rate of about 4.75 judges per month. Today’s deal, by contrast, means that fourteen new judges will be confirmed in just two months. This is a significant uptick — even if it is barely enough to make a dent in the 83 currently existing judicial vacancies — and Reid deserves credit for making this happen.

Indeed, there is an important lesson here for Reid and for progressive lawmakers in general. McConnell remains the most obstructionist Senate Leader in recent history, and he has been a constant barrier to ensuring our nation functions effectively from the moment President Obama took office. Nevertheless, we know now that he can be forced to back down. Harry Reid decided to fight this week, and he was rewarded for it. He should remember that fact the next time McConnell stands in the way.

Front-Runner? Over 60 Percent Of Republican Votes Cast So Far Have Gone Against Romney

Despite his triumphs in Alabama and Mississippi, Rick Santorum still walked away with fewer delegates last night than Mitt Romney, who took smaller wins in Hawaii and American Somoa. In the delegate race, which ultimately determines the nominee for the Republican Party, Romney has taken more than 50 percent so far.

But, the media’s focus on the delegate count obscures how poorly Romney has fared. Due to the complexities, complications, and quite frankly — the unfairness — of the GOP system of awarding delegates, Romney is far more overrepresented in delegates than his popular support.

ThinkProgress analyzed the total vote counts in the 30 states and territories that have voted so far. Over the approximately 9.2 million total votes cast, Romney has earned only 38 percent of the vote (far fewer than his 53 percent portion of the delegates). Santorum, on the other hand, has earned 26 percent of the popular vote so far, on par with his 27 percent of delegates.

The graphic below documents the discordance between the popular vote and the delegate count, revealing that more than 60 percent of the vote cast so far has gone against Romney:

Despite describing himself as the presumptive nominee, Romney’s support from less than two-fifths of the GOP vote shows how fundamentally weak he remains.

The Jed Report notes that Mitt Romney last night won 34 delegates from just 1,129 voters, while Santorum received 32 delegates from over 300,000 votes.

An effort is underway to repeal that law, and yesterday, Nashville Councilman Anthony Davis testified before the State Senate’s State & Local Government Committee in favor of that repeal, explaining how businesses benefit when they don’t discriminate. The Remarkable Doonesbury Abortion Arc, And How Men Can Be Good Reproductive Rights Allies

As you may have read, about 50 of the 1,400 newspapers that carry Doonesbury have asked to run alternative strips this week while the comic takes on the spate of laws that would require women to undergo transvaginal ultrasounds before obtaining abortions. It’s too bad they’re being timid, because the arc as a whole is terrific: ferocious and funny all at once. “Will it hurt?” asks the patient about to undergo the ultrasound. “Well, it’s not comfortable, honey,” the nurse tells her. “But Texas feels you should have thought of that.”

It’s a worthwhile reminder of the standards male creators should set for themselves when trying to write about women’s issues—and frankly, women in general. The fact that Gary Trudeau’s done amazing work over the years with characters like Joanie Caucus, Lacey Davenport, Alex Doonesbury, Kim Rosenthal, and Melissa Wheeler is the reason he can speak with authority on the subject now. The strip has consistently expanded its scope on women’s issues, and I thought it was particularly brave to explore the consequences of Melissa’s command rape, when it could have been interpreted as a pivot away from B.D.’s loss of his leg. Trudeau treated what both Melissa and B.D. were suffering as equally legitimate pain, and he made treating Melissa with respect a major part of B.D.’s recovery, expanding his world in the process. Trudeau isn’t just parachuting in to abortion because the topic is trendy, he’s not the equivalent of an all-dude panel discussing women’s health. He’s a genuine ally, and a powerful one.

Uganda Gay Rights Group Sues American Homophobe | Sexual Minorities Uganda, a gay rights group, filed suit today against anti-gay activist and evangelist Scott Lively today for inciting the persecution of homosexuals in Uganda in violation of international law. Lively, who blamed the Holocaust on gays in his notorious book The Pink Swastika, made several trips to countries like Uganda through his Abiding Truth Ministries to warn that gays indoctrinate and molest children. Uganda’s proposed “Kill The Gays” bill has been traced back to Lively’s influence, as documented by Current Tv’s Vanguard in 2010. Watch it:

Family Equality Council Invites Couples To ‘Snap It And Send It’ | The Family Equality Council has launched a new campaign to challenge the antiquated language on forms and documents that same-sex couples might encounter. Throughout their lives, like at doctors’ offices, their children’s schools, or government administration, these families encounter forms that enforce gender binaries, such as “mother/father” and “husband/wife,” that simply do not account for 21st century diversity. Now, they can “Snap It and Send It,” taking a picture of the form that they can then send to forms@familyequality.org to help raise awareness about how uninclusive the culture can be in the tiniest — but still significant — of ways.

Trans Youth Face Higher Risk Of Abuse, Mental Health Problems If Not Affirmed

Two new studies on transgender and gender nonconforming youth have been published in last month’s volume of Pediatrics that provide further evidence that young people need to be accepted and affirmed for their identities. Not only do they face severe mental health consequences from stigma, but they are at higher risk for family abuse as well.

The first study (full article) found that young people who experience gender dysphoria but cannot access treatment face higher rates of psychiatric problems. Many of the kids in this study (21.6 percent) already had a history of self-mutilation or attempted suicide before seeking treatment, but helping them achieve congruence between mind and body alleviated the mental health burden. The study recommended that doctors and counselors work with families to affirm gender variation so that it does not become a source of internal conflict for the transgender child.

This approach is not without its own challenges, as the second study (full article) found that stigma against gender variation is often too close to home. In fact, gender nonconformity is a high risk factor for children to be sexually, physically, or psychologically abused, and that abuse can lead to a lifetime of post-traumatic stress disorder that often goes untreated.  The abuse can reflect parents’ discomfort with gender nonconformity, their homophobia, or a sense that their own parenting is to blame.

An accompanying editorial highlights the fact that not all young people who question or explore their gender are truly transgender, but the available research indicates the importance of affirming that exploration and assessing potential challenges the child might face:

The pediatrician or family medicine doctor should be on the lookout for the child who is gender nonconforming… The pediatrician who observes gender nonconformity should address the issue straightforwardly and look for a number of associated psychosocial problems including abuse, PTSD, difficulty in school, depression, or increased anxiety. Referral to and working with the mental health professional provides a good safety net for the child as he/she struggles with exploration of gender orientation, gender, and gender role as well as the related conditions. If indicated, adolescent patients might be referred to a pediatric endocrinologist for help in getting a better long-term physical outcome.

Though conservatives consistently object to any discussion of LGBT issues with young people, it seems it is young people and their families who need those conversations most.

North Carolina Catholic Bishops Campaign For Marriage Inequality

The bishops representing the Catholic dioceses of Charlotte and Raleigh have thrown their support behind North Carolina’s Amendment One, which would ban not only same-sex marriage, but civil unions and domestic partnerships as well. Under the guise of “protecting” marriage, Bishops Peter Jugis and Michael Burbidge explain to voters why they should vote for the discriminatory amendment:

JUGIS: Same-sex unions are unable to realize the unique and full potential that a traditional marriage relationship expresses… The Church’s position on traditional marriage is not an instance of discrimination or animosity towards homosexual persons. Marriage is based on natural law, a law that can never be changed; therefore, there will be boundaries that cannot be modified. At the same time, in light of our belief in the inherent dignity of every person without exception, individuals and society must respect those with a homosexual orientation.

BURBIDGE: Catholics belief that the Church has the authority, the obligation, the Gospel mandate, to affirm these authentic teachings and to preserve and foster the supremely sacred value of marriage in our society… Our beliefs are principled ones, divinely revealed, and to be regarded seriously in any consideration of marriage and family life.

Both also alluded to the common Catholic talking point that same-sex marriage is somehow a threat to the survival of the species. Watch their videos:

If Bishop Jugis truly wants to respect the “inherent dignity” of gay people, perhaps he shouldn’t be suggesting that their second-class status be codified into state law. Discrimination is discrimination, even if Catholic leaders say it isn’t.

Utah Legislator Defends Abstinence-Only Bill: ‘Homosexuality Does Not Relate To Sexuality’

Utah Gov. Gary R. Herbert (R) has not taken action yet on the recently passed abstinence-only/”don’t say gay” bill, but its proponents continue to defend it, even though it doesn’t enjoy popular support. Among other things, the bill prohibits “instruction in, or the advocacy of” homosexuality, but its sponsor, State Rep. Bill Wright (R), explained that homosexuality has “nothing to do with health,” except when it comes to abstaining from it:

WRIGHT: That has nothing to do with health. Homosexuality does not relate to sexuality. It’s a whole different thing… I can write the curriculum really simply. If you’re homosexual you have a high degree of [contracting] some STD. What else do you need to know? What else do I need to teach?

There are many answers to Wright’s question, but the most obvious lesson many young people need to hear is simply that “homosexuality is normal.” The entire goal of sex education is helping kids learn about their own bodies, the changes they’re experiencing, and how to make responsible decisions now that they’re being flooded with hormones. Wright wants an entire group of students — who are already stigmatized for what makes them different — to be deprived of the vital affirmation they need and deserve. If he honestly believes that “homosexuality does not relate to sexuality,” perhaps he’s not the best authority to be dictating sexuality curriculum.

Russian Orthodox Church Seeks National Ban On ‘Homosexual Propaganda’ | Officials of the Russian Orthodox Church are so pleased with St. Petersburg’s new law banning “gay propaganda” that they want to implement such a law throughout all of Russia. The new provision imposes fines of up to $16,000 on individuals and up to $160,000 on legal entities that promote LGBT issues to minors, and similar laws already exist in the Ryazan, Arkhangelsk, and Kostroma regions. Russian Orthodox priest Dimitri Pershin claims the law will “help protect children” from sexual minorities who “rally near children’s establishments.”

Washington Finalizes Wording For Referendum 74

The language has been finalized for Referendum 74, an effort by conservatives to challenge Washington state’s new marriage equality law. Though opponents of the law sought to describe it as “redefining marriage,” Judge Thomas McPhee decided against such language. Here is how the referendum will appear to voters in November, assuming its proponents gather sufficient signatures:

The legislature passed Engrossed Substitute Senate Bill 6239 concerning marriage for same-sex couples, modified domestic-partnership law, and religious freedom, and voters have filed a sufficient referendum petition on this bill. This bill would allow same-sex couples to marry, preserve domestic partnerships only for seniors, and preserve the right of clergy or religious organizations to refuse to perform, recognize, or accommodate any marriage ceremony.

Should this bill be:

[ ] APPROVED

[ ] REJECTED

Unlike efforts to overturn marriage equality in other states, referenda in Washington ask voters to uphold the law, so those who support same-sex couples will be encouraged to approve Referendum 74. This is not to be confused with campaigns in Minnesota and North Carolina to defeat the proposed discriminatory constitutional amendments.

- Meryl Streep, Johnny Depp, and Justin Bieber are among the celebrities calling on the MPAA to lower its rating on the documentary Bully so more young people can see it. Katy Butler’s Change.org petition is just shy of 300,000 signatures.
