Romney Still Unfamiliar With Basic Facts Of The Raid That Killed Osama Bin Laden

Presumptive Republican presidential nominee Mitt Romney doesn’t seem to understand the myriad considerations that went into President Obama’s decision to carry out the special operations raid that killed Osama Bin Laden. An ad put out by the Obama re-election campaign highlighting the president’s decision to strike into Pakistani territory to kill Bin Laden sparked a furor by questioning whether Romney would have made the same call.

Since the ad appeared, Romney, his surrogates, and so-called independent groups like the nouvelle swift-boaters have all rehashed the same dubious line in Romney’s defense: That any American president (or “any thinking American“) would have ordered the bin Laden raid. Just last night on Sean Hannity’s Fox News Channel show, Romney yet again issued this defense:

ROMNEY: But if the president wants to remind people of his decision, well, that’s entirely appropriate. But I think it was a big mistake for the president to try to make in this a political event by suggesting that I would not have done the same thing. I mean, frankly, Sean, almost any American in the position of presidency hearing that Osama bin Laden could have been taken out would have certainly pressed the button and said: get rid of the guy.

HANNITY: Oh, absolutely.

ROMNEY: And of course I would have.

However, Romney and his allies’ repeated responses to the ad that “any thinking American” would have ordered the raid don’t account for the actual events surrounding Obama’s call.

  • Romney assumes that Obama was 100 percent sure bin Laden was at the compound in Pakistan. However, the intelligence was far from certain:

    “There wasn’t any direct evidence that he was there. It was all circumstantial.” — Robert Gates

    “The circumstantial case of Iraq having WMD (weapons of mass destruction) was actually stronger than the circumstantial case that bin Laden is living in the Abbottabad compound.” — CIA Deputy Director Michael Morell

    “Ultimately, it was a 50/50 proposition as to whether this was actually bin Laden.” — President Obama

  • Romney thinks that anyone would have ordered the raid based on his assumption that bin Laden’s whereabouts were known. In fact, Vice President Biden and Robert Gates opposed a special operations assault that the president ultimately decided on, particularly because of uncertainty as to whether bin Laden was at the compound.
  • Romney claimed that “we haven’t heard all the different military options there were” for the bin Laden raid. But various reports have outlined a number of courses of action Obama could have taken. “Most were variations of either a JSOC raid or an airstrike. Some versions included cooperating with the Pakistani military; some did not,” the New Yorker reported.
  • In an analogous choice in 2005, George W. Bush and then-Defense Secretary Donald Rumsfeld decided not to strike at senior Al Qaeda commanders in Pakistan because of the potential risk to relations with the notoriously sensitive country. When Obama said in his first presidential campaign that he would strike in Pakistan to get bin Laden, McCain criticized him as irresponsible. Romney echoed this concern when he said in August 2007, “I do not concur in the words of Barack Obama in a plan to enter an ally of ours.

    Fox News Guest: Allowing Women To Vote ‘One Of The Greatest Mistakes That America Made’

    The Raw Story uncovered a sermon that Rev. Jesse Lee Peterson gave in March in which he spends 10 minutes lecturing his audience about how women have destroyed America. Lee is a radical pastor who says that allowing women to vote was “one of the greatest mistakes that America made.”

    “Look at every place where a women is in control,” said Peterson. “You see nothing but confusion. There’s no good in it at all, none.”

    Peterson’s sermon began with comments about Sandra Fluke, doubling down on Rush Limbaugh’s slut remarks. But halfway through his speech, he kicked the hate into another gear:

    PETERSON: “I think that one of the greatest mistakes that America made was to allow women the opportunity to vote. We should have never turned that over to women.”

    “It was a big mistake…these women are voting in the wrong people. They’re voting in people who are evil, who agree with them…Men in the good old days understood the nature of the women, they were not afraid to deal with them.”

    “Wherever women are taking over, evil reigns.”

    Amazingly, just last week, Sean Hannity, who sits on the board of Peterson’s group BOND: Brotherhood Organization for a New Destiny, invited him to sit on his Great American Panel once again to discuss the president’s comments on the one-year anniversary of the death of Osama bin Laden.

    But the conversation never quite made it that far. Fellow panelist Kirsten Powers, a Fox News columnist and political analyst, abandoned the segment to hit back against Peterson and his anti-women views, over the objections of Hannity who wanted to spend his time attacking President Obama.

    For two minutes, Powers and Peterson exchanged barbs while Hannity and the third panelist, Indiana state Treasurer Richard Mourdock (R), sat quietly on the sidelines. Powers told Hannity that she had no idea Peterson would be a guest on the show alongside her, and invited him to repudiate Peterson’s remarks (he declined).

    Peterson has made appearances on Fox News for years, fielding frequent invites from Hannity in particular despite Peterson’s history of hateful comments. And it’s not like Hannity had no warning. Peterson has previously said he “thank[s] God for slavery, because had it not, the blacks that are here would have been stuck in Africa.” He also called the victims of Hurricane Katrina “welfare-pampered,” “lazy,” and “immoral.”

    And while Powers was rightfully outraged at Fox News’ decision to offer Lee a national platform, Hannity was unapologetic, quickly shutting down the spat and pivoting to his usual agenda of attacking the president.

    EXPERTS: Hannity Could Be Required To Testify About His Conversation With George Zimmerman

    According to several experts in Florida law, Sean Hannity could be compelled to testify about his conversations with George Zimmerman. Tamara Lave, a professor of criminal law at the Universtiy of Miami who also practiced as a public defender for 10 years, told ThinkProgress it’s a “no brainer.”

    Under Florida Law, there is a “qualified privilege” for journalists that protects their conversations with sources. But this priviledge can be overcome, per Florida Evidence Code 90.5015:

    A party seeking to overcome this privilege must make a clear and specific showing that:

    (a) The information is relevant and material to unresolved issues that have been raised in the proceeding for which the information is sought;
    (b) The information cannot be obtained from alternative sources; and
    (c) A compelling interest exists for requiring disclosure of the information.

    Here’s how Hannity described his conversation with George Zimmerman:

    Now yesterday I was contacted by an individual that we in fact believe was George Zimmerman. He reached out to me, we spoke on the phone about his case, and I agreed not to report on the contents of that conversation.

    Lave said that, in her opinion, the qualified privilege could “easily” be overcome under Florida law because Zimmerman’s statements about the incident are “relevant and material to unresolved issues.” Further, there are no “alternative sources” for his statements to Hannity and there is a compelling interest for disclosure in a potential manslaughter case.

    Lyrissa Lidsky, an expert in media law at the University of Florida and the author of a book on the First Amendment, said that she also believed the factors in the Florida law would be resolved “in favor of forcing Hannity to disclose the information.”

    Michael Seigel, Director of the Criminal Justice Center at the University of Florida, agreed, stating that Hannity “may very well have opened himself up to subpoena.” Kenneth Nunn, another criminal law professor a the University of Florida, concurred and said he didn’t think the journalist’s privledge could be made successfully by Hannity.

    Sean Hannity: George Zimmerman’s New Confidante

    When George Zimmerman’s attorneys announced they were withdrawing from the case because they had not been in contact with him for several days, they cited a phone call Zimmerman had made to Sean Hannity directly. (Hannity has been using his show to mount a public defense of Zimmerman’s actions.)

    “We believe that he spoke directly with Sean off the record and he’s not even willing to tell us what our client told him,” said Hal Uhrig, one of the attorneys who had been representing Zimmerman.

    On his radio show Monday, Hannity explained that he had an “off the record” conversation with Zimmerman. The conservative host also came to Zimmerman’s defense. “I spoke to George Zimmerman, and I’m not going to reveal the contents of that conversation, but I have confirmed yes, he was a mentor to minority children. Now if you were racist, I don’t think you’d be a mentor to minority children,” Hannity said.

    Then on his Fox News show last night, Hannity again discussed his phone call with Zimmerman, saying he had promised not to report about their conversation and knew nothing about Zimmerman’s relationship with his attorneys:

    Now yesterday I was contacted by an individual that we in fact believe was George Zimmerman. He reached out to me, we spoke on the phone about his case, and I agreed not to report on the contents of that conversation. That’s it. I know nothing about his relationship with his now former attorneys.

    At the press conference yesterday, Zimmerman’s attorneys told people who are looking for him to expand their search beyond Florida, despite earlier assurances that their former client was in the state. The family of Trayvon Martin, who Zimmerman said he shot and killed in self-defense in February, had expressed concerns that Zimmerman would flee the state.

    Palin Says Obama Wants To Return To Racial Discrimination ‘That Took Place Before The Civil War’

    Sean Hannity brought Sarah Palin on his Fox News show yesterday to continue his discussion from the night before over the biggest non-story of the week — a video of President Obama from his days at Harvard Law School.

    But during their discussion, Palin opened up a new front in her attack of President Obama, apparently suggesting America’s first black president wants to return to the days “before the Civil War”:

    Now, it has taken all these years for many Americans to understand that that gravity, that mistake, took place before the Civil War and why the Civil War had to really start changing America. What Barack Obama seems to want to do is go back to before those days when we were in different classes based on income, based on color of skin.

    The “different classes” system Palin seems to be referring to is perhaps better known as slavery.

    The entire conversation is based on the mischaracterization of Derrick Bell, a pioneer in legal scholarly work. Bell was the first tenured black professor at Harvard Law School, and the video that Hannity insists is a scandal shows Barack Obama, then a student, speaking at a rally in support of Professor Bell. Students and faculty were protesting to urge Harvard to hire more minority faculty.

    Of course, Palin has struggled with history before.

    Goldline Hit With Injunction, Agrees To Repay Defrauded Customers $4.5 Million

    Conservative talker-endorsed precious metal retailer Goldline International agreed to a court order this week to repay defrauded customers $4.5 million and overhaul its business practices. The injunction, handed down by the Los Angeles County Superior Court, was obtained by the City Attorney of Santa Monica, California — where the company is based — who had filed 19 criminal counts of fraud and theft against the company last year. Those charges have now been dismissed.

    Goldline’s entire business model was essentially a scam, the city attorney found. It was a bait-and-switch: Consumers wanted to buy gold bullion, but salespeople preyed on their fears — including falsely claiming that the government could seize bullion — and misled them into buying vastly overpriced gold coins instead. Consumers typically paid more than 55 percent above the actual value of the coins, which are much harder to sell down the road, instantly wiping out a large portion of their savings.

    At the time, Goldline called the charges “preposterous” and vowed to fight them. But in addition to the $4.5 million, the court order requires Goldline to put $800,000 into a fund for future claims, and submit to a court-appointed monitor who will have full access to company’s operations, at Goldline’s expense. In addition, it will have to disclose its actual markups and stop misleading customers.

    The company is best known for its ties to conservative talk radio hosts like Glenn Beck, Sean Hannity, and Mark Levin, who were central to the company’s marketing model. Two former GOP presidential candidates — Mike Huckabee and Fred Thompson — have even endorsed the gold retailer.

    Yuri Beckelman, who conducted a separate investigation into Goldline when he served as former congressman Anthony Weiner’s Legislative Director, told ThinkProgress the endorses should have known better. “It’s unrealistic to think Glenn Beck and other Goldline spokespeople had no clue what was going on. They have a responsibility to their listeners when endorsing products, especially in tough economic times, now it’s up to their fans to hold them accountable.”

    “Goldline can try to spin it any way they want,” Beckelman added. “But when you agree to change your business model and then pay a court ordered attorney to monitor your progress for the next five years, you’re admitting that what you were doing was wrong.”

    Santorum: Panetta Is ‘Ignoring The Facts’ By Claiming That Iran Isn’t Building A Nuke

    Despite the hawkish foreign policy positions of the GOP presidential field, former Pennsylvania Sen. Rick Santorum has set himself apart in giving voice to some of the most extreme assertions about Iran’s nuclear program. In an interview with Fox News’ Sean Hannity, Santorum asserted that an Iranian nuclear weapon was a near certainty unless the U.S. takes military action.

    Santorum’s views completely ignore the International Atomic Energy Agency’s (IAEA) most recent report — the IAEA expressed “serious concerns” about the possible military dimension of the nuclear but did not assert that Iran had resumed its nuclear weapons program — and the reported consensus opinion of all 16 U.S. intelligence agencies that Iran has not yet chosen to make a weapon. Hannity led by asking Santorum about Secretary of Defense Leon Panetta’s recent statement that Iran is not trying to develop a nuclear weapon:

    HANNITY: Let me ask you one national security question. Leon Panetta was on, “Face the Nation” this weekend, he was asked whether or not Iran was trying to develop a nuclear weapon, his answer was, no. And you said that you would, as president, would take out Iranian nuclear site.

    SANTORUM: The amount of cognitive dis[sonance], the amount of just completely ignoring the facts. [...] They’re building this nuclear facility next to where the Mahdi is supposed to return.

    Where their savior is supposed to come back who’s going to bring about this glorious victory for radical Islam. It is so obvious. Why would a country that has one of the richest supplies of oil and natural gas, build a nuclear power plant?

    But what appears “so obvious” to Santorum is not so obvious to the U.S. intelligence community or the IAEA, a set of institutions presumed to have access to far more intelligence capabilities on Iran’s nuclear program than the former senator from Pennsylvania.

    Following the release of the most recent IAEA report on Iran’s nuclear program in November, a senior White House official told the National Journal:

    The IAEA does not assert that Iran has resumed a full scale nuclear weapons program nor does it have a program [sic] about how advanced the programs really are.

    And Director of National Intelligence James Clapper, in testimony on Capitol Hill last year, agreed with Senate Armed Serves Committee Chairman Carl Levin (D-MI) that “Iran has not made a decision as of this point to restart its nuclear weapons program.”

    None of the statements from the IAEA, the White House or the U.S. intelligence community preclude the possibility that Iran may someday pursue a nuclear weapon or seeks to develop a “breakout capability” while stopping short of building a nuclear weapon. But Santorum’s willingness to order airstrikes against Iran’s nuclear program appears to be more strongly rooted in his hatred of “radical Islam” and Iran than any established facts about Iran’s nuclear intentions.

    Hannity Suggests Obama Will Start War With Iran To Win Election

    On Sean Hannity’s Fox News show last night, two conservative panelists said President Obama would start a war with Iran in a strictly politically-motivated act in order to wag-the-dog and garner support for his 2012 re-election bid. The accusations came from Fox News contributor Angela McGlowan and former Sen. Alfonse D’Amato (R-NY).

    “I say he starts a war with Iran before the election which will make it very hard for the Republican to win,” Donald Trump predicted (again) on Hannity’s radio show yesterday morning. “I think it’s going to happen.” On Fox News Channel, Hannity put the question to his guests:

    HANNITY: Do you believe he would do that?

    MCGLOWAN: This man would do anything. He’s Machiavellian. He would do anything to win re-election.

    HANNITY: Do you agree with that, Senator?

    D’AMATO: Absolutely. [...] I said I wouldn’t put it past him. He is a total political animal.

    MCGLOWAN: Animal!

    D’AMATO: And he would use that if he thought it would make a difference to get him elected.

    HANNITY: …If you were right and Trump were right and Angela were right it would be the single biggest abuse of power in American history that I can think of.

    Earlier in the day on his radio show, Hannity, who dedicated an entire episode in March to a hawkish documentary, was less ambiguous about the need to attack Iran, without discussing political motives. “The answer is not to be reactive but to be proactive, which means you respond earlier,” he said. In other words, he spoke approvingly of the same action he said a few hours later would be “the single biggest abuse of power in American history.”

    Romney Admits Flip-Flops During ‘17 Year’ Political Career, Explains He First ‘Ran Against The Nation’s Leading Liberal’

    Appearing today on Sean Hannity’s radio show, Mitt Romney candidly admitted he has changed his positions on multiple issues, explaining it was inevitable because he has been running for office for “over 17 years.”

    Further, after being pressed by Hannity, Romney acknowledged there was a political motivation behind his reversals, noting that his initial positions were adopted when he “ran against the nation’s leading liberal Ted Kennedy.” Here’s the key excerpt:

    HANNITY: If you are conservative, you’re Republican, you are running in the state of Massachussetts, you might take positions or say things you otherwise might not have said, just because the nature of the state you are in. Are we wrong or right analysis of this?

    ROMNEY: Look, I say to people what I believe and do my very best to explain that. Does it mean that over, I don’t know, 17 years –I first had a public posture when I ran against the nation’s leading liberal Ted Kennedy — and have any of my views changed in 17 years? Why of course. If you don’t learn from experience, if you don’t learn when you’re wrong then you are stubborn and stupid. So of course, over that period of time, there have been items where I would have changed their mind.

    His explanation appears to directly conflict with the core message of his campaign: he is a man of the private sector while his rivals, particularly Newt Gingrich, are longtime politicans.

    Glenn Beck-Approved Goldline Charged With 19 Criminal Counts Of Fraud And Theft

    Goldline International, the precious metal retailer that has capitalized on conservatives’ anxiety about the economy by forging synergistic relationships with right wing TV and radio hosts, is facing a new series of legal challenges after authorities filed criminal charges against the company and its executives yesterday. Several major conservative talkers — including two former GOP presidential candidates — have endorsed and recommended Goldine, which critics have long contended is little more than a scam.

    After more than a year of investigating, the city attorney in Santa Monica, California, where the company is based, has filed 19 criminal charges of fraud and theft against the company, in addition to charges against top executives and salesmen, ABC News reports:

    The complaint alleges that Goldline “runs a bait and switch operation in which customers, seeking to invest in gold bullion, are switched to highly overpriced coins by using false and misleading claims,” according to a statement released by the consumer affairs division of the Santa Monica City Attorney’s office.

    The company has been charged in the court filing with misdemeanors that include theft by false pretenses, false advertising, and conspiracy, the City Attorney’s office said. In addition to the charges against the company, the complaint accuses former CEO Mark Albarian, executives Robert Fazio and Luis Beeli, and salespeople Charles Boratgis and Stephanie Howard of defrauding customers. Current CEO Scott Carter is accused of making false or misleading statements.

    Each of the charges carries a maximum penalty of one year in jail and maximum fines of between $1,000 and $10,000 per offense.

    While former Fox News conspiracy-theorist Glenn Beck is most closely associated with Goldline, Sean Hannity, Laura Ingraham, and Mark Levin, former GOP presidential candidates Mike Huckabee and Fred Thompson, and several Fox News hosts, among others, have all endorsed the company.

    Indeed, conservative talk radio is central to the company’s success, as Goldline employs a business model based not on mere advertising, but full integration with the content of conservative talk show hosts’ messages. The company’s website prominently features these endorsers, suggesting the talkers’ backing gives Goldline “credibility.” The company has said it will vigorously contest the charges.
