Colorado Appeals Court: GOP Secretary Of State Illegally Weakened Disclosure Laws

The Colorado Court of Appeals agreed with a lower court that Secretary of State Scott Gessler (R) lacked the legal authority to dilute the state’s campaign finance disclosure law. Despite a 2002 constitutional amendment approved by voters that required political contributions and expenditures above $200 be made public, Gessler sought to unilaterally raise this threshold to $5,000 for expenditures and contributions by issue committees. The court wrote “in promulgating this rule, the Secretary exceeded his authority and the rule must be set aside as void.”
