- The all important Justice Kennedy appeared to swing back and forth yesterday in a case concerning whether a person who was convicted of a crack cocaine-related crime before Congress reduced the sentences for such crimes but sentenced after Congress enacted the law is entitled to the lower sentencing formula.
- The justices, in an unanimous decision by Justice Kagan, also made it harder for a drug company to block generic drugs by expanding the scope of their patents.
